The BIOS is code and remains copyrighted regardless of the state of the device for which the code was written.However, there are a number of emulators and development environments available that will let you write code against that BIOS. They do so either by emulating the public portions of it (e.g. APIs which mostly aren’t copyrightable except if Oracle wins its case against Google over Java, which would be bad and dumb) or through a limited license that allows them to use and expose BIOS code for the purposes of development and compatibility.So no, you can’t legally just go out and grab someone’s rip of the code, but there are legal ways to make use of the BIOS code under proper arrangements.

No.Emulators require hardware that is roughly 8–10 times more powerful than the console being emulated.I’d guess a decent PC is about four times more powerful than a PS4 and about five times as expensive. After you’ve got the speed, you just need someone to think it’s worth trying to emulate. Someone willing to risk going against Sony as emulators running copied roms are illegal. Someone to program the emulator and debug the code. Someone to test every game ever produced on disc and digitally.The PS3 emulator still isn’t perfect, that console is eleven years old.Luckily the PS4 is much simpler and people are working on the emulator right now. At a guess, I’d say you only need to wait about 5 years (ish).Then once it works it’ll be about 2–3 more years before they can emulate the PS4 at a level that’s playable. Then you test and improve the code until it can run games at a decent frame-rate. Then there’s an ongoing process of improving and recoding, so that it works with as many games as possible.So, give or take a couple of years, it should be up and running in about ten years.Personally, I think it’s easier to just buy a PS4, but maybe that’s just me :)
