What to do if you car is totaled because of the engine?

Well Valerie; you are in a pickle. First off I do want to agree that one can not see the timing belt while doing standard, under-the-hood maintenance. Second: I wanted to make sure that the engine undergoes severe damage when the timing belt breaks on your car (some cars do - some don’t). I found that, yes indeed, that engine is toast. During this rudimentary research, I found that a lot of people were experiencing the same problem. Most car manufacturers recommend routine belt replacement at around 75,000 miles. It appears Kia recommends at 60,000. And, I found a lot of blown engines. More odd still, is that some of them were breaking timing belts before the 60,000 mile mark. Now Kia knows that the engine is zero tolerant for valve clearance if the belt breaks. That’s why they recommend the belt be changed sooner than most. But, it seems that is still a problem. I am rambling - the reason I’m explaining all this is to lead you to the service bulletin. This is a sort of silent recall the manufacturer puts out regarding design and engineering problems. Sometimes you can get repairs and replacements free of charge, even if you are not the original owner. I found one specific to your car and problem. You are on your own to pursue it further. Here is the information you need to get started.

I got into a bad accident yesterday and my car is unfixable and totaled sitting at the pound. The other driver hit me and he made me hit two more cars. Long story short I'm still making payments on my car , so what's exactly going to happen now ? What will happen with my payments and my insurance? Something is very fishy. A 2005 Prius with 12000 miles on it has a retail book value of $26050. according to Kelly Blue Book.

A 2006 with less than say 2500 miles would be at least that and more.

The $17500 estimate by the adjuster is less than the industry 85% standard for a total. Not knowing the items damaged on your car, I am sure that the adjuster has put a notation on the estimate that there will most likely be additional damage found if repairs are done that will push the repairs over the 85% figure.

Assuming that to be the case, then the very least that the adjuster should be offering you is in the neighborhood of $22800. as a settlement value on the car. Since the 2005 is still valued at $26050 in excellent condtion then a 2 month old 2006 should book at at least the same. Very good arguement to demand full replacement. PERIOD. Contact a good accident attorney (one that is not affraid to go for the jugular) and ask him to write a letter to the company indicating that it is a demand for payment of the full value of the car. Additionally, have him write a letter to the insurance company of the person that hit you. Same type of letter -- demand for immediate replacement.

If your insurance company does not want to cough up the full price let them know that you are very internet savvy and will spread the news that they are a lousy company that do not do right by their insureds. The same goes for the insurance company of the person that hit you.

Then really get serious. Have your attorney set in motion an action against the person that hit you freezing all of his assets.
Real Estate, other autos, any personal property and liquid assets, retirement accounts and bank accounts.

If ANYONE WAS HURT!!! Go for the jugular. DO WAIT FOR THE TWO INSURANCE COMPANIES TO DO A PATTY PATTY BEHIND YOUR BACK.

Great answer from Ralph Mitchell.I just want to add that this is a problem many people encounter who have lovingly looked after their car. Low mileage, well maintained, beautiful paintwork. Spotless inside. Probably not a popular car. Older with a low trade-in value.It's best to take the insurance pay out, buy the car as scrap and get it repaired by a little shop round the corner that doesn't have the overheads of a regular concessionary.

The fact that your car has been totaled only affects the need for insurance in the future. Obviously, without a car, you do not need insurance. However, it has absolutely no bearing on the citation you already received for driving without insurance.
