Is it legal to upcycle brand name clothing and resell it?

I've seen many people selling upcycled shorts online, ebay, etsy, other online stores. And they are selling brand name clothing (denim jeans): levi's, gap, tommy hilfiger, etc. All vintage items, which they are then cutting into shorts and ripping and studding and such. They're not putting their name on the shorts and saying that they are there's, but they are listing the brand name of the shorts (as it seems you should so people know what they're buying, it would seem wrong not to). I was going to start doing this until someone mentioned to me that it is illegal to resell brand name clothing.

Is it illegal to do this for my clothing designs?

I own an online store and have for a few months now, and i have a lot of designs ive come up with myself that sell, but i came across of really cool harem style sweat pants that a lot of people are liking all over the world. Am I allowed to create the harem sweat pants but put a different design on them? The sweats are made from someone in Houston, its not a huge brand or anything. The design I want to do on them is completely different from theirs... I feel like i'm stealing but at the same time i feel like im not because Harem pants have been around for AGES, it's not like they created the style of pants, they just used different material and sewed their detailing (zippers) on the legs.

So.. am I considerably allowed to do that? Or is it wrong? Both their company, and my company are currently being trade marked.

Can you resell and put your own logo on a product from Alibaba without getting sued if there are already other companies branding/selling that same product? I see many companies sell the exact same product but by a different logo/brand name.

I agree with all the other answers. I just want to add that you most definitely want to check with the manufacturer. The product may be patented and the manufacturer could have produced it originally for the patent holder (they would know who the company was and they can provide direction).I was in a similar situation this past month. I almost added a component to a product I’m launching that had a big price reduction over other options. I talked to the manufacturer and they told me someone had a patent on it. They shared their contact information and, right now, I’m in conversations to rent the patent.If I had used that component without approaching the patent holding company, my revenue for the whole product could have been at risk! (glad I dodged that bullet). In short, most definitely check the legal status. You don’t want to have to give all your hard work away because of overlooking this. You have 2 main options when doing this. Option 1: Get your own product manufacturedOption 2: Get a pre-made product custom labeled with your company's name Option 1 When taking  this route you should be familiar with the different types of manufacturing processes you will encounter. You can’t just contact a manufacture and say this is what I need now make it. You have to have some idea of what machines will be needed and what they are capable of. Otherwise, what you could be asking for may be impossible or too expensive to be rational. Manufactures can spot these types of people from a mile away and will sometime avoid them entirely, because dealing with inexperience importers is not worth the hassle for them. The 3 main types are:CNC - Slow and costly but very precise and durable.DIECAST - High initial investment with low per unit cost after. Lest durable not as precise.Laser Cutting - Fast precise and cheap. Almost anything up to an inch thick can be cut.Note: This method is the more costly of the two.Option 2 This route is the easiest and the most cost effective for a new/small business. To do this you will only need a company name and logo for the manufacture to put on the product and packaging. In most cases the products you will be putting your logo on will be things that aren’t exclusive to your own business. Anyone will be able to do the same and most likely already are. Competition is not bad unless the market is completely saturated. If a market is competitive but not saturated it means there is room for someone else to make a profit. However, in order to make that profit you are going to have to stand out from the rest.The best way to do this is by selling an emotion rather than the product. People are emotional beings and want to buy things that are aligned with their values and beliefs. Don’t just sell the features of your product; sell the values that created it.For example, rather than saying “We use the best materials around” say “Quality is important to us; You may even say we are perfectionists. No

A lot of companies already do this. Most such producers can even be contracted to do the decorating for you. You'd be surprised at how often your "choices" are produced at the same plant and are just sold under multiple labels. Nearly every brand of Aspirin for instance is made at one chemical company. Tube socks, thread, etc... are already bought from subcontractors.

There is nothing illegal about buying product, branding it with your own brand and reselling it.

What is illegal is selling it as someone else's brand.
