You can be fired for refusing to take the drug test and you can be fired for getting a positive test result.

So, instead of firing you or going the testing route and firing you, they're giving you an option to leave with a "clean" record.

If you work in an at-will state, you can be fired for anything as long as you're not fired for being a member of a federally protected class.
That means you can be fired because the manager doesn't like people taller than he is but you can't be fired because you're handicapped.

Look at your company policy. If it stipulates drug free and you pop positive, then you have violated a condition of employment. Note that I am not referring at all to the legality of the action. You may have smoked pot legally where you were at, but before you went there, you had an agreement with your employer and you have made a choice to take a chance that if you are drug tested upon return, you will have to suffer the consequences of those actions. One other note,,,,,,a simple urine test will show activity in the last 28 days. If your employer is using the more expensive hair analysis test, it will show any activity over the last 12 months. There is no such law as possession by ingestion; you cannot be charged for having marijuana in your system.

I don't understand why he (I'm guessing it's really you, it always is when someone says, it's a "friend" regarding drug use) would have to go for a drug test. Is this required by his employer ?
