Counsel Me In This Situation.

Can someone of the same rank as me counsel me?

Okay, here is the situation. Our NCO was on recovery for staff duty so another person same rank as me was in charge of the office. We butt heads all the time, my nco knows this. This other person is now trying to write me up for not listening to orders (he doesn't talk to me because we do NOT like each other), for following orders of someone else (our Motor sergeant who is a SSG), and for spending to much time with another person in our office.

Here's the kicker, after talking to my ACTUAL NCO the situation was pretty much killed and 'resolved'. This other person went over our NCO and went straight to the PSG.

My question is does he have the grounds to stand on to be able to do this? Do you know where in FM 6-22 does it talk about counseling situations like this?

Can a specialist counsel another specialist?

Yes if one person has positional authority over the other person you bet they can. AND if one of those Specialist is senior to the other, meaning one person has been in 3 years while the other has been in 5 years. Also, it is better to get fixed by one of your own than having one of the bigger dogs do it. The military is all about seniority. It doesn't come up too often within the same paygrade but it will happen from time to time where the months or years difference in seniority come into play in the workplace or in the barracks..

It is unadvisable for anyone to actually get formal legal advise online. I would say that the last sentence in your question tells a tell of incompetence on the part of the public defender. Your relative took a plea bargain without understanding the importance of what the act of that agreement was and now changes his mind. How can he change his mind now after realizing what he had done while not understanding what he is actually deciding. In other words, what is it that he understood and literally made a decision on his legal situation. In any event, he has to find legal council that will take the case on the merits, without knowing the intimate details of that, no attorney is going to lay claims to it or obligate themselves to argue it. NO ONE should EVER put their legal stuff online, as a few words miscontrued or misdirected can be fatal legally. I don't pretend to be an attorney, so It's easy for me to slap a novice opinion on it. If you are forced by monetary exclusions for reasonable defense, you should complain about it too, if that be the/part of your relatives situation. Confessions are always situational,it's the explanation thats the crux of understanding and resultant level of guilt...

Can I counsel myself?

I know it sounds extremely stressful if i come up with heavy-psychological terms, so lets do it the normal way.You need to follow a 5 step guide which might help you, if not counsel but at least make you feel less disappointed and discouraged. 1. What exactly is the mental problem? Is it something related to work/family/love and you feel entangled in a loop and are unable to come out of it? * If yes, then relax, we all have these issues and mental stress at times, you just need to find the reason of your disturbed psyche.2. Is it a mental problem or an illness ? * If its a mental problem, you need to identify the root of it and start talking to some close ones whom you think would listen to you and help and vent out your emotions.If its an illness ( if you are unable to work, you have hallucinations,disturbed sleep,discouraged attitude,extreme mood swings,withdrawal symptoms), then just run straight to a psychologist or a counselling therapist and smile :), you will just be fine. 3. Distraction is a bliss at times, try to make yourself busy with things you enjoy. We often feel disheartened and gloomy when we are alone or the mind is still. So find out THAT ONE thing which you love doing, and stick onto it for a while. 4. If you are someone who is more of an introvert, just keep calm and talk to people who are very close to you, if not that, write all what you feel and share it with a friend, search for some motivational quotes on" positive attitude/new life/faith" and stick them on the walls around you. Don't just read them, try to comprehend the true essence behind it. 5. If it still does not work, try yoga or meditation. It will be difficult to change routine all of a sudden, but these are believed to have supreme healing power. Go out and give your body a stretch, look at the nature, feel the birds chirping, notice people around you.. soon you will realize that our pain is often very small in this big world. Can a city atty. take a case on someone who was arrested by a city officer, on a driving offense?

A city attorney took my case 3 days after being appointed, he never disclosed his positon, he charged a 4000.00 retainer fee, during my hearing for rescendsion of supension, a city police officer was ask to take the stand, i tried to recover some of my retainer to hire another atty, he said no money returned, and then withdrew from my case and kept the money after i questioned his position. I was offered a public defender, but he is also the public defender, i ended up taking a plea bargain, without representation, and he kept the money.

Have you experienced positive effects from counseling?

I have major depression and anxiety, so my case is more difficult to treat than many others. I have to say that counseling had some limited success for me. However, I also did a lot of "self'-help" things. For depression, exercise was a powerful antidepressant for me. Also, I practice relaxation techniques like meditation. Plus I am on two psychiatric meds.

In many cases, research suggests counseling will help when there is a really supportive, positive relationship between client and counselor. This seems to matter more than what kind of therapy is used.

In more difficult cases, research shows that counseling plus psychiatric meds is generally more effective than meds alone or counseling alone. I hope this helps.

Meaning of order to withdraw as counsel of record & meaning of Motion to withdraw with client consent?

Hi, I need to know the meaning of the above on two question? I recently saw that on my divorce case online which I am currently in other country and my husband filed for divorce in US sometime in April this year. The results on my case came out as this :

Can a lawyer argue a case in Indian family court without submitting a vaqalat? Please specify exceptions if any.

Section 13 of Family Courts Act, 1984 places an embargo on any lawyer from appearing before Family Court. Any party has to file an application wherein he has to assign reasons to specify as to why he seeks legal assistance to lawyer.Unless the Family Judge is satisfied that the party is not educated enough, he is not allowed to seek a lawyer as no lawyer can appear in a Family Court as of right.
