What will happen is if they decide to test the baby, although it isn't routine to do so, they can say anything made them suspicious so they did, because legally they have to have a reason to test. Ex: baby shows withdrawal symptoms, mother comes in high, that kind of thing, then they test you and baby.
If it's in either of your systems then they call CPS and report it, from there a social worker will come into the hospital to talk to you, if it wasn't in your system and it's been a long time back since you smoked then sometimes they are lienient and will let you keep your baby however you have to go to drug workshops, have random social worker visits and drug test and if you fail, the infant is removed from your custody, it's very important to be honest with them.

If it's in your system at the time of birth- then they take the baby, the social worker gets there, talks to you, and in most cases they put the child in foster care and charge you with chemical endangerment of a child.
Then if you beat those charges, which almost never happens, you have to go fight for custody of your child, a judge might choose to strip you of your parental rights.
A family member can go to court and request the infant be placed with them instead of foster care, and usually judges go with that option as long as the person is suitable with suitable living conditions and a job.

She would be taken to the hospital for an evaluation, police would probably get involved, the child would go into the custody of the state pending a search for family. Once family is found (with Good police work, and social services family-finding software and database), assuming the family that is found is not the family that caused the child’s current state, the family would go through a background check. If the family comes forward that had a direct hand in the child's current state, or were the last ones with her before she was found, they will be investigated for abuse or neglect.

First let me say this. In CA the court likes to see renifucation as quickly as possible hopefully in 6 months. CPS involved the renifucation period could be as long as 18 months or even longer. Every case is different. The first thing you need to understand is that your child is not in your custody anymore. Wouldn't it be better to get them back quickly, than to have them put into the system. The first thing and the most important thing is know your rights because you are the adult and no one is going to explain them to you. Do this if you have children. The first thing to remember is your children belong to you. Do not be fooled when CPS comes knocking at your and wants to come in, just to ask you a few questions. Do not think that if you cooperate and give them the truth, they won't take your children. CPS is a corrupt organization this is a money maker for the states, your elected officials know this. Until this organization changes or the senators reorganize or delete CPS you will always have them think it is their right to do what they want. Sue them in federal court. It takes money to sue people, there are not enough lawyers who take these cases. Find a lawyer who does class action lawsuits, they will win for you. There is one going on in Phoenix AZ now. Why? Because Phoenix AZ, has removed children from there homes more than any other city or state in the USA. Google why did CPS remove 5,000 children illegally from their homes in Riverside County, CA also San Bernardino County. Or Why the appealete court justices did not give immunity to CPS social workers, by breaking the due process of the law. I do not live in Louisiana, but I am sure someone can provide you the answer to your question but it's a 50/50 chance if you want to believe them. Talk to a lawyer first. No.What complicates this issue is enforcement. If a parent has visitation, and a 16-year old refuses to go, it isn’t the same thing as a 6-year old refusing to go. A 16-year old is capable of running away, physically resisting, etc. So, if the parent being deprived visitation files a motion for order to show cause, the judge is hesitant to enforce the order being violated. One of the defenses to being held in contempt is that you are not violating the order intentionally, i.e. the violation is happening because of events out of your control.

I'm 18 yrs old and my 13yr old cousin (Harley) just had a baby(Melissa).In which I am the godmother of. The baby was born on the 10th of Feb and she is a premie. Well the home (trailer) that Harley and Melissa live in is horriable it's almost impossiable to live in. 5 people in a 2 bedroom. To make a long story short. Harley is being neglected(spelled wrong). Her gardian refuses to help. Moving out at 17, with one parents concent--?

I have my dads concent but he lives 4 hrs away, and he has half coustity of me. I'll be 17 in august. Moms movnig into a different house, but i'm more then welcome to stay at the house i'm in which will be safe, ( step dad ). I'm trying to figure this out, If i move out at 17, and come back here in a safe enviornment, then can she make me come back or not?
