Did I Break My Informal Probation

If you're on informal probation, do you still have a probation officer?

Informal probation ( also known as summary probation) is usually granted to first time offenders of non violent crimes. Basically, it means you do not report to any probation officer. For the specified time period of your probation, you will be "watched" ( by arrest reports) to see that you are not arrested again for any other charges.

Unless your case is out of the ordinary, and you can read your paperwork that was given to you, when you complete your summary probation, the record is expunged automatically.

If your probation is under the "normal" guidelines, the Judge is not going to grant an early release. This is a test to see if you made a single mistake or you are starting a career in breaking the law.

Don't be surprised if your motion comes back denied ( it will be a postcard in the mail stating motion was denied). But by all means, check to see that your case will be expunged when completed. Keep your nose clean. A second arrest/conviction removes ALL possibilities of having an expungement.

MIP infraction while on informal probation for a DUI?

okay so i recently me and some friends received MIP infractions not misdemeanors and I'm kind of freaking out since I'm informal probation for a DUI.

But one of my friends dads is a Lawyer and she asked him and explained him my situation and asked what would happen and he said that it doesn't effect the probation because there different circumstances and i wasn't driving so its not a repeat offender. And he said as long as i pay the ticket and do the classes I'm good unless its court ordered and that never happens.

does anyone have experience with this or agree? i mean he is a lawyer and deals with this stuff all the time but I've been reading things online and a lot of people say other wise.

The term "informal probation" is not a legal term (though lawyers use it, too), so I am not really sure of your situation. I suspect that you were a juvenile at the time you engaged in the driving offense, and you were placed on probation without an adjudication of the charges (a big break, since conviction of that 2-point offense can have a major effect upon your license and insurance). If I am right, then the result of being convicted of a new offense would probably be that your informal probation would be terminated and the charge would go to trial.

If you are on informal ADULT probation (following a plea or finding of guilt), then if you are convicted of the new offense you are subject to anything up to the maximum punishment for reckless driving, which is 90 days in jail.

Note that if you were just tagging along with your friends, and did not know they were going to steal and did not participate in the thefts, you are not guilty of the offense. This is a misdemeanor charge and you will need an attorney. If you cannot afford an attorney one will be appointed for you by the court.

I'm on informal Probation but can i still smoke Marijuana?

I've been on informal probation for 4 1/2 months now for having a knife, some airsoft guns, and a paintball gun in my car on school campus so i just wondering if i could still smoke weed? i smoked the first 2 months but now i have a meeting with my PO in 2 weeks. i also got suspended about 2 months ago for people smoking in my car on campus but i was the only one without weed on me and they couldnt prove i smoked. is it likely for them to drug test me at this next meeting or is it safe to continue smoking?

Is there a problem for someone in formal probation to hang out with someone in informal probation?

Probably not.

Unless your terms of probation (be it summary or formal) explicitly tells you not to associate with a person or group, then you have not violated te terms and the court can do nothing.

There are a few exceptions. If you are a gang member then the terms of probation could tell you not to associate with other identified members. If you were convicted of domestic violence or some other type of similar crime involving violence, the court will often issue a stay-away order.

Best way to tell is get the minute order from the day your were sentenced. Unless the court told you, then there is no problem.

Can civil infractions violate the terms of informal probation?

I am a medical marijuana patient who just received an infraction of marijuana although the cop didnt take the time to verify my card and i am on informal prbation and my doctor knew that before prescribing medicine to me. The other infrction was 640 b misuse of a fare
