Difference between crminal justice and administration of justice?

Criminal justice is the system of practices, and organizations, used by national and local governments, directed at maintaining social control, deter and controlling crime, and sanctioning those who violate laws with criminal penalties.


Administration of Justice is The primary agencies charged with the responsibilities of administering criminal justice, which are primarily law enforcement (police and prosecutors), courts, defense attorneys and local jails and prisons which administer the procedures for arrest, charging, adjudication and punishment of those found guilty. When processing the accused through the criminal justice system, government must keep within the framework of laws that protect individual rights. The pursuit of criminal justice is, like all forms of "justice," "fairness" or "process," essentially the pursuit of an ideal. Throughout history, criminal justice has taken on many different forms which often reflect the cultural mores of society.

Is the criminal justice system racist?

Argue against these two submissions:

1. The courts/police are not racist. They give ethnic minorities harsher sentences (for committing the same crimes as white people) because ethnic minority members are more likely to be unremorseful, disrespectful, and hostile to the court system (perhaps because they perceive it is racist). The judges are therefore justified in believing these members of ethnic minorities are more likely to re-offend than white people, and are therefore justified in giving them harsher sentences on average.

2. Stereotypes/prejudices of ethnic minorities as being more "criminal" exist for a reason. Ethnic minorities are statistically more likely to commit violent crimes and are statistically more likely to re-offend than white people. Stereotypes are okay for a court to use in deciding how to sentence a member of an ethnic minority, because the liklihood of re-offending is a very important consideration for a judge in deciding a sentence for a criminal offender.

I was arguing with a friend today about whether the criminal justice system is racist [because ethnic minorities are more likely to be convicted, and are more likely to receive a harsher sentence, than a white person for a similar crime].

I believe the justice system is racist, my friend argued that it wasn't [using the two arguments I've outlined above]. I found it hard to tear down her arguments. Can you help me with this?? Thanks!

Do you mean historically or legally?Historically, while we do not have the centuries of British precedent, we had (at the beginning) adopted some of the ideas and concepts from British law and incorporated them into our own. Legally, the US justice system is based upon the US Constitution, and requires no legal basis from the UK.

What are some of the biggest differences and similarities between the US and British justice/legal systems?

The queen has many abilities although she rarely exercises them and they are usually delegated to ministers and parliament.These include the ability to give consent to or to deny bills from being passed and this is very similar to the president's veto ability. She can also order parliament to convene and she has the ability to get rid of ministers and to appoint them. The queen also happens to be the only person in either system who is immune from prosecution of any kind. She also has the ability to commission or remove the commission of all officers in her armed forces which are also technically controlled by her and she can seize any ship to help the realm. The only other power I have seen which she shares with the president are the Royal and presidential pardon respectively. Other than the Queen who can streamline the entire process if she chose, I don't think there is much of a difference.

Why is the justice system in Canada so broken and unfair?

Corruption is everywhere so Canada isn’t except to it. However, compared to other countries where you’re incarcerated while waiting for trial isn’t bad. In Canada people are arrested and they are free next day without posting a fine.

Have no idea how this is done.The total prison population is less than 70,000 compared to millions in the US.It is rare to hear of a French cop being killed or in turn opening up with massive gunfire.If a cop is killed it was by a Spanish or Corsican or Muslim terrorist, not a bank robber.There are no high speed chases by cops as depicted in Ronin or The Transporter. The French Riviera is not the LA freeway.A French courtroom is not part of reality TV. They have no Nancy Grace.
