Dmv Hearing What To Do To Be Prepared

DMV DUI hearing. Police report says I was breath tested at .085 15 minutes before I was pulled over. Can I win?

You are fighting an uphill struggle and even with the inaccuracies on the reports the hearing officer will lean towards the officers testimony. You need a lawyer and should try to make payment arrangements with one to handle your case. You stated that you fear they will have your blood results but if they do and you had not consumed sufficient to cause the reading the officer stated then it should clear you and nothing to fear.}{

What is the process for a DMV hearing in North Carolina?

I have a scheduled hearing in North Carolina to have my licence reinstated. I would like to know what to expect. What type of questions will the officer ask my wittnesses and myself? I want to be prepared so any information would be helpful. THanks.

Can I take the driving test at the DMV with a warrant?

What you have is a capias, or warrant for failure to appear. If you show up at the DMV they will arrest you. The best thing you can do is go to the court and turn yourself in. You will be given a court date for a "show cause" hearing giving you a chance to explain why you missed court in the first place.
Ultimately it will be up to the Judge to determine the disposition.

What does SEC/VIOL mean on my DMV driving Record and what do they mean???

what does SEC/VIOL mean on my DMV driving Record, I know they pertain to the violation that I received, however, i am not sure what they are or were, because it was several years ago.

Can someone please tell me what each one means, I would really appreciate it.

1st one states: 22350VC/405095VC

2nd one states: 22350 VC

3rd one states: 22349A VC / 40508A VC

I am a resident of California, and if you know a number or know what they mean, please inform.

Thank you very much.

Is the driving test hard to pass?

What state? and not necessarily. I have heard of times where the instructor will actually ask you to do something you're not supposed to do to see if you do it. I think that type of instructor is kind of rare though. Whatever you do, make sure you stay on or just under the speed limit, always come to a COMPLETE stop and look both ways twice!

How big is a traffic court and how long does a reckless driving (speed) case last?

The trial will be quick but how long you wait for that trial can vary greatly. When I was in practice, they typically ran the represented people through first and while a traffic appearance normally didn't run more than 30 minutes counting wait time, occasionally in some courts you could be there for hours. Law of your state will be different but I think as a general proposition unless you have some incredibly great defense you need to set realistic expectations.  Remember in many places you have to come twice. First time all do is plead. If you enter a not guilt and can't get it ironed out you will have to come back for trial. Likely outcomes.1. Go to trial, at this point officer and city attorney or prosecutor are mad at you for bogging things down. Get convicted without any break. Occasionally you find a judge grumpy that you bogged things down and didn't try to work it out.2. Get convicted but judge takes pity and finds you guilty of a lower offense.3. Prosecutor or officer wants rid of it and knocks it down if you will plead to something lower.4. Officer doesn't show. Well depending on where you are that can mean a dismissal but it is just as likely someone will speak up and say "Officer Smith is on vacation and out of state" or "Officer Smith is working a call on the street" or the judge will instruct the prosecutor to find out why the officer isn't there and let him know in a few days and it gets postponed (and you get to come back a third time).5. You do have a good defense and present it will and are found not guilty. Generally speaking, you don't want a reckless. Insurance companies hate a reckless and ding you pretty hard. Ideally you want some sort of probation or civil penalty or diversion so you don't have anything reported. If the officer wrote it as a reckless, it may well be the best you can get is a lower level of speeding or a careless driving.

Will my pink slip be revoked ?

Hey, So i sold my truck today to someone who lives pretty far from me in California. The truck is in my dads name however when i met up with the buyer today to make the transaction i noticed my dad forgot to sign on two spots. I went ahead and signed those two spots with my name. Now i am afraid that when the new owner goes to the California DMV they won't accept it becuase it has my dads signature and mine and the two don't look anything alike. should i be worried ? or can i just tell the buyer to add my name to the "Second Owner" section. Thank You.
