Do Apartment Complexes Ever Decline An Application Request To Move Into An Apartment Over Nothing

After filling out an apartment application, how long does it usually take to call you back?

It takes 2-3 business days to call you back. It just depends on if they do a criminal backround check. Your credit check comes back instantly and if your credit is not good they will usually call you the next day. The criminal backround can take up to 3 days to come back. It also depends on if they have to do a rental verification from a previous apartment complex you rented from. They might have to wait for them to fax the information back. Good luck!

My rent is higher than what the complex is listed for online. Can I dispute this?

My lease is almost up and I am thinking about either staying or leaving...I checked my apartment complex's website and the exact same apartment is listed for lower. Can I negotiate my rent to be reduced?

You can always ask. Just realize that unless you have a very compelling reason, they probably won’t meet your request.Apartment complexes exist to make money. They usually rent to the first people who can pay and have decent credit ratings and references.Plus, they can’t discriminate. This is a law. So you can’t say, don’t put anyone with kids next door because I don’t want them watching me as I sunbathe in the nude on my patio. Because they can’t refuse to rent because of kids.And they won’t discriminate, even when it’s not for something that is legally protected. Smokers aren’t a protected group, so you can say smoking makes you very sick. You can ask them not to put smokers next to you, and you know what they’ll say? “We cannot and will not invade their privacy by asking them whether they smoke or not. We will not refuse to rent to smokers.” (It’s different if you live in a smoke-free complex.)You do have a right to privacy, however, and you can report it if someone invades your privacy. That doesn’t mean looking over at you when you’re on your balcony, but it does mean entering your apartment or going through your mail. Then the person is breaking a law.If you want privacy when you’re on your balcony, you can hang drapes or put up a screen. You can use blinds to cover your windows.I can’t really think how people would invade your privacy when you’re inside your apartment.

My apartment complex shut down the pool for the summer, what can I do?

I live in Las Vegas, its over 110 degrees out here. I just moved into an apartment complex, and last night someone trashed the pool. There were lawn chairs in the pool, beer bottles all over the place, and the drain covers were stolen. Because of this, they're saying they are shutting down the pool for a while, maybe even the entire summer.

As a tenant, am I now paying to use this pool? There are 3 pools here and they are shutting all 3 of them down. Can I have my rent reduced? I am paying a hefty amount every month, I'd like to know how much of that I am paying to use the pool, (is there an average that apartment complexes charge?) that way I can ask them to deduct it for the months in which they won't be running the pools. Who can I contact? Any information would help. Thank you.

Ridiculous House Rules by my apartment complex, is that even legal?

A property owner can make any rule he wants regarding the property he is renting out. Personally, I don't see anything wrong with what your objecting to. Children playing in the hallway can disturb other neighbors - some folks work nights and sleep during the day. Elevators are vehicles for transportation and are not toys. I agree wholeheartedly with that one. Stairways are also for the use of ALL tenants. Others may be physically or visually impaired and having to dodge toy trucks or marbles on a stairway is just plain hazardous to the community as a whole. Why would you want your child to play in a garage where people are going to turn in without being able to see directly over their hoods - say at a child sitting on the floor playing with a toy car? I agree with the courtyard issue too. That's usually where people can stroll or sit and enjoy a garden or do some birdwatching. It is not a playground and was never intended as such.

Yes, it most certainly is legal - and makes perfect sense to me.

Be a good neighbor and sign it, obey it or leave. Not signing it is going to be grounds for your lease not being renewed. Prepare to move.

Can I sublet my apartment if there's nothing forbidding it in my lease?

If you have a job opportunity in another city I do not think what you are wanting to do is to sublet unless of course it is a temporary job and you'll be returning to where you're living now. Subletting means you will be returning to the apartment at a later date. Subletting means you remain responsible for any unpaid rent should things not work out with the person you sublet the apartment to.

What you want to do is Assign [if you're moving to the other city for good]. This means finding a suitable replacement tenant to take over the duration of the lease. Your name is taken off the lease and your replacement tenant's name goes onto the lease. You walk and that is the end of it.

You need to ask your landlord if Assigning is permitted. If it is you are good to go provided you find a suitable tenant. However, remember that the landlord always has the final say as to the suitability of the replacement tenant. You might think you've found a great replacement tenant. Even so, your choice of tenant must pass the scrutiny of the landlord.

I live in an apartment and my neighbors are smoking pot. It smells bad everywhere, the odor goes through the doors. They refuse to stop or consume less, what can I do?

Strange: I’ve talked to many non-smokers who like the scent of burned cannabis, including a Panamanian roommate in college who adamantly refused to let me smoke cigarettes, but was fine with pot. But, apparently you have strange olfactory issues, whatever… Firstly, I’d advise you just treat this as any strong odor, as if your neighbors cooked fish a lot (this is often an issue for neighbors of recent South Asian immigrants), or burned incense. Actually if you found an incense scent that you don’t mind, you might even ask your neighbors to use it. An acceptable solution for everyone.When you bring up the fact that it is marijuana, you’re bringing up emotional issues (if not legal problems) for pot smokers, getting them defensive when they might be sympathetic. Many smokers would be understanding about bad smells, that’s how I would bring it up with landlord/apartment manager or even (God forbid) the police if they get involved somehow. Pretend you don’t know that it’s cannabis, just that it’s just an odor that bothers you. I think this would even work on a Quora search. You may find answers and solutions here that get lost when you make it an issue about cannabis, instead of just a strong odor you dislike. Especially if your neighbor is using cannabis for medical reasons. PS: cannabis is the preferred term for medical use, since it served this purpose for hundreds of years before prohibitionists used the term “marijuana” to capitalize on prevalent racism against Mexicans.

How long can you typically go without paying your apartment rent if you got a 3 days notice to pay the rent or get out?

I assure you that not paying your rent is one of the worst decisions that you can make. Your life will not be the same after an eviction. It can be a very traumatic experience.Every state is going to have slightly different eviction laws but here in Ohio my company has a very large rental portfolio in the Cleveland area and this is how we handle tenants who do not pay rent.Rent is due on the 1st.Rent is late on the 2nd.We call tenants 3x day from the 5th through the 10th.We put up 3 day notices on the 10th.After the 3 day notices we file for eviction. Once we file we will no longer accept rent. At this point the non paying tenant can't pay or get out of the legal ramifications of their actions.We win the court eviction and get a write to regain possession of the property. The eviction remains on your record for life. It will be incredibly hard if not impossible to find another landlord willing to rent to you.We send in the bailiffs (guns drawn) to the home. If you do not open the door they kick it in and forcibly remove any occupants living in the home.Everything that the tenant owns is placed on the curb by a moving crew. They can clear out an entire home in about 2 hours. They are not vary delicate with your possessions. Everything stays on the curb until 5pm. Scrappers and thieves usually come by and steal anything of value. At 5pm we bring a dump truck and load up everything that is left and take it to storage. After 30 days in storage we take it to the dump.After all of the above a non paying tenant can also expect the following to happen.We take you back to court and sue you for back rent, legal costs and damages.We garnish your wages until all debts are paid off.As you can gather from everything above being evicted is a terrible experience that is 100% preventable by you.
