yes, I ****** up. I know. Me and two friends were smoking weed in my car. We barely had any. We smoked about half a gram. We were in a public park after dark and somebody called the cops on us. The cops came and arrested me for DUI even though I wasn't driving. They took me to a DUI center to give blood. What is going to happen to me? I had no weed on me when the cops came. All they found was rolling papers

**Edit - Do not drink and drive or get high and drive (not even for fun or to experience it). There's always a chance of getting pulled over by the coppers, and death/injury is everywhere. My uncle's car got hit by a drunk chic. Chic lost her license, and was sued for 20,000$ in damages along with car repairs, as well as therapy for my uncle's back.

Also, I was stupid enough to be in a car with someone who was high as a kite. Nothing ever happened, but man, I tell you... WORST driving experience of my entire life. The guy drove like a maniac. It's funny, I was just thinking about this event the other day.

If the car is on your property and keys are not in the ignition it shouldn’t be a problem.If you’re in a parking lot smoking in your car, thats still public consumption, and if you have the keys in the ignition (even if the car is turned off) you can be charged with DUI.

It might possibly be legal, but to make a convincing case that you had no intent to drive it the keys probably shouldn’t be on your person or in the car, and you should probably be sitting in the back. Otherwise you could be charged with “intent to operate while impaired” or something similar. If you have a bunch of weed, and really give the arresting officer a hard time they can make your life difficult no matter what your local laws say. It is still FEDERALLY illegal, so all they need to do is drop a word in the right ear and you’re screwed.

Me and my friends were smoking weed in my car in a neighborhood and somebody called the cops on us. All 3 of us have our medical cards and we were planning on getting out of the car and walking to my friends house after we were done smoking, because we can't smoke in his house, we were literally right down the street from the house. The cops came up to the car and were threatening charging me with a DUI, the officer was completely biased against Marijuana saying that he had 3 knee surgeries and he doesn't smoke (like I care). He ended up giving all of us littering tickets because my friends emptied out tobacco onto the street, I didn't throw anything out but the officer said he didn't believe me. The cops exact words were, "either I give the driver a DUI or I give all 3 of you littering tickets." Also, he asked me if there was any other weed in the car, there was none, but again, he said he didn't believe me. I don't understand what that has to do with anything because the medical card allows possession up to 8 oz. At the moment of this, I had no idea how to react because I've never been in this type of situation. My question is, is smoking in a parked car legal? I don't understand how that can bring a DUI charge, I'd appreciate any constructive answer to this. My record is clean and I understand I don't look like an angel here but I don't want to pay a $1,000 littering ticket for something I didn't even do. Thanks in advance.

All answers seem to pick up on the “ keys in possession, then you are deemed likely to drive “ aspect of the matter.But a further word on this, in the UK, you may find yourself waking in the morning, or later in the day if it is during the day, you get tested, still technically drunk.We have many who have been caught out, thinking because they had a sleep, they can drive off in the morning,only to be pulled and tested and found under the influence,because their alcoholic intake hours earlier was enough to keep them under many hours later.One of my erstwhile neighbours was a motorway cop, he told me they often found people ,’resting' in motorway service car parks. If they thought the person was under the influence, they would come back a couple of hours later and maybe arrest them. Anyone genuinely ‘resting' and not just trying to sleep it off, would be ok, but drunks would get done.Where it may seem they are not drunk as such, the way the law works is to measure the blood alcohol level. Not the apparent capability to drive.

There are states in the US with Actual Physical Control (of a motor vehicle) statutes that are separate from a Driving Under the Influence or Driving While Intoxicated statute and some where it is combined, so the answer is maybe.For APC when I was on patrol, we needed the person to have the ability to operate the vehicle like having the key, the vehicle being operational and being in the driver's seat. If someone was sleeping off drink in their back seat with the engine off, we charged them with nothing.I have not lived or worked in a state that has ignored federal drug laws to pretend marijuana is legal, so the person could be charged either with possession, possession with intent to distribute (depending on the amount snd the way it's packaged because the smoking a drug in plain sight in a public place would provide probable cause for a search or in a state with APC smoking drugs in the driver's seat might lead to that charge if the person had the key and the vehicle was operational.You would need to look up the laws for your own state. There may be something in a statute or case law that specifies public versus private for driving offenses.

I got a dui pulled over for smoking weed?

the other day i was pulled over for going through a yellow light tht turned red before i got through. cops smelled weed on my breath blah blah blah i said i had nothing in my car and after a while i admited i did they finally searched it and found my pipe scale and grinder and less than a half a gram of weed. i live in pa and am 19 years old what am i looking at how screwed am i? costs jail time liscence suspension community service? should i get a lawyer? i am not sure of all the charges yet only know that i have a dui
