This happened to me. If you do not receive a form from your employer, you can file an IRS substitute W-2 form on your own, using the information from your records.

The form is called Form 4852: Substitute for Form W-2, Wage and Tax Statement, or Form 1099-R, Distributions From Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance Contracts, etc.

Then the IRS will take it from there.

What are the consequences of not sending out employees' W-2's by January 31st?

You should receive a Form W-2, Wage and Tax Statement, from each of your employers for use in preparing your federal tax return. Employers have until January 31, 2007 to furnish a record of 2006 earnings statement either electronically or in paper form. Allow two weeks for 2006 earning statements mailed from employers via United States Postal Service (USPS).

If you do not receive your Form W-2, contact your employer to inquire if and when the W-2 was mailed. If it was mailed, it may have been returned to your employer because of an incorrect or incomplete address. After contacting your employer, allow a reasonable amount of time for your employer to resend or to issue the W-2.

If you still do not receive your W-2 by February 14th, contact the IRS for assistance at 800-829-1040. When you call, have the following information:

If you misplaced your W-2, contact your employer. Your employer can replace the lost form with a “reissued statement.” Be aware that your employer is allowed to charge you a fee for providing you with a new W-2.

You still must file your tax return on time even if you do not receive your Form W-2. If you do not receive the missing information in time to file, you may file you may use Form 4852, Substitute for Form W-2, Wage and Tax Statement. Attach Form 4852 to the return, estimating income and withholding taxes as accurately as possible. There may be a delay in any refund due while the information is verified.

Can an employer refuse to give you a copy of your W2 form?

Your employer is required to mail or otherwise deliver to you the required number of copies (two, three, or four, depending on where you live and work) of Form W-2 not later than January 31 of each year in which you had wage income from that employer, unless you have previously consented to receive such forms electronically and have not withdrawn that consent. What is an employer's obligation in providing W-2 forms to former employees?

Let me make this simple. By law your employer is to send the w-2 upon request. If he refuses call department of labor. Regardless of your opinions, this is the correct course of action. It is the resposability of the EMPLOYER to send a w-2 when requested. Cost is NOT a valid excuse as an email is an acceptable version of the form. The second website listed confirms this is correct. The site does not use the same harsh language I do, but it is true. The employer must send it again even if it came back undeliverable. Again, an employer must send you a w-2 any time you request it within reason.

1. Ask for it to be emailed via email so you have the request I'm writing
2. Call department of labor, they will take this very seriously.
3. Contact the IRS and tell them of the issue. This usually results in the form being faxed directly to them and you can request it from them.

I have had to do this before when I moved cross country. An employer cannot force you to come to him or pay for the delivery of a form that he is required by law to give to you.
