Failure To Yield Accident / Wreck Need Help

Brand new car involved in accident, please help?

You say that you were sure the way was clear but quite obviously it wasn't. Any vehicle in travelled portion of the roadway has right of way and since you were entering the travelled portion of the roadway you were responsible to yield to ALL traffic which you did not. You are at fault here. your insurer might assess some liability to the other driver if there is evidence that the other driver's actions contributed to the accident. Otherwise it's all on you. I doubt if the damage is beyond cosmetic if all the other driver suffered was a minor dent.

Ticket: failure to yield to emergency vehicle. Am I screwed?

Well I just received a failure to yeild to emergency vehicle citation while driving. Speed limit was 30 MPH, I was going about 33. There were 3 lanes, the middle being a divider lane and a wreck had occured in the lane I was in. About 4-5 police cars were blocking off the lane and pedestrian cars were going around the scene of the accident by using the divider lane, as the police wanted. So I went around the cars, like the others, slowed down to about 20, like the others...and an officer flashed me with his flashlight, stepped in front of me about half way through the scene of the accident (20 feet out of 50 feet total or so). I am wondering if he has the right to give me a $115 ticket. I slowed down, although he had decided to pull me over before I had even reached the cop cars. I was in NO WAY going over 20 MPH, I would guess the cars in front of me(100 ft) were going about 30 MPH. Utah Law says: (2) The operator of a vehicle, upon approaching a stationary authorized emergency vehicle
that is displaying alternately flashing red, red and white, or red and blue lights, shall:
(a) reduce the speed of the vehicle;
(b) provide as much space as practical to the stationary authorized emergency vehicle; and

I did not fail to do any of those, so should I fight the ticket. I know I probably have no chance whatsoever, but I am just wondering if I have any basis whatsoever to fight this. Opinions?

Im 16 and i got in a car accident?

Oops! Man up you wrecked your car and lost you license man it happens you are not the only one out there to ever crash and have the same thing happen. I did it too, got my license 3 days later backed into a parked car, didn't loose my license but my insurance went up and I got an inattentive driving ticket, About 9 months later I totaled my truck and did about 4 grand worth of damage to the old Lincoln I hit, Got another ticket and rates went up again I was paying about 1,000 bucks every 6 months for an old 79 chevy pickup liability only can you say (insane)!

I got through it though and those are the only two wrecks I have had that were my fault since then.

You can still get around you have friends, two feet, or a bike, and if you want to go see your girlfriend well get to walking or pedaling it will show her that you are willing to do whatever it takes to be with her it may actually earn you bonus points! Think about that.

A friend of mine crashed into a car which had failed to yield right of way at a 2-way stop. The cop who arrived after the incident wrote in the accident report that my friend was going over the speed limit. How could he have determined that?

My friend was not speeding at all even by a small amount. But I know a many people here will probably not want to trust that statement so I am not going to even argue the case. Driving so fast that the car just appears out of nowhere (at the intersection) is certainly out of the question.Therefore I am concentrating on the question that possibly can be answered, which is what can the cop use to claim that my friend was speeding. My friend did not get a citation for speeding. The other driver did get a citation for not yielding right of way, from the same officer who wrote the report.But, beyond that the officer seems to go out of his way to make the other driver seem innocent, noting specifically that the driver was not distracted and that he had stopped at the stop sign before starting to cross. The officer was not even there during the accident. Whereas, for my friend the officer does make a point to mention(without noting any evidence or reason) that he was speeding. So it sounds fishy to me.My friend was going down the hill and this intersection is in middle of downhill which must be at least 20 degrees steep if not more, so even with driving under the speed limit and braking, the cars did move (maybe 6–7 ft) in the direction my friend was driving in and some in the other drivers direction too.

You did NOT have the right-of-way. The woman failed to YIELD the right-of-way to you. Safety is 90% attitude. If you have the attitude that you HAVE the right-of-way you *will* be involved in more collisions. Until and unless the right-of-way is actively yielded to you, you do not have it.

You are driving with a protective steel cage around you. I ride a motorcycle, I am 63, if I crash I will most likely die. I cannot allow anyone to hit me. Hence I never assume I have the right-of-way. So far I have successfully dodged everyone who has failed to yield the right-of-way to me.

Was the accident my fault? I was making Left Turn.?

I was in a left turn lane on a 4 lane highway(no light) I sat in the left turn lane and waited for about 4 cars to go by and The way was clear and safe for me to go on with my turn (I saw no oncoming traffic or headlights). During my turn I got distracted by lights shining in my car and I looked out my passenger window(by this time my passenger door was in the right lane of oncoming traffic) I saw headlights about 15-20ft away from me I took my foot of the gas(did not hit break) and then I punched my gas to get across the road and I went into the entrance of where I was going. (I had completed my turn) I thought cool I didn't get hit then all of a sudden I got hit in the entrance of where I was going. The other driver said I turned in front of him and he hit me in the highway,but that wasn't true after the wreck was over my car was up in the middle of the entrance of where I was going and his truck was on the side of the highway next to the entrance of where he hit me in. I told the police that he didn't have his headlights on and that I didn't see him coming,but they told me that it was my fault because I failed to yield on my turn. The damage to my car was the passenger front fender,front tire was bent outward,passenger front door was smashed,both tires were flat and pulled off the rim.scratches were half way across the back passenger door, my rear bumper was completely off the car all the way round and the under carriage was damaged as well. The other driver told his INS claims agent that he was only going 20 MPH and that I turned in front of him and he crashed into me,on the highway he told my INS claims agent that I did complete my turn and he did hit me in the entrance of where I was going and that his headlights were automatic. Right now my claims agent is saying he is probably 70% at fault and me 30%. i'm not sure how that works. But I know for a fact I did not see him coming and that I got hit after I completed my turn. what do you all think? I live in Missouri I for got to say that the damage on the other drivers vehicle was his passenger side light,fender,and front passenger side grill,,front passenger side tire.
