Fell At Walmart. Legal Advice

Employee fell in walmart? Need your advice?

I was working as a cashier. Another employee placed a box of bags right behind me at the register.I was assisting a customer and backed up to help the customer and fell knees first on the floor. I fell so hard I could not move. After a few minutes of sitting there I could finally move. The customer went to customer service and got help. The employees came & called a manager. She stated he was upset. It took him awhile to come. (10 min)By that time I got up. I felt a knot on my knee..when the manager came he didn't want to file a report. The csm said I should go home if I felt pain. Due to swelling I went home. What should I do?

Walmart forgot to put the lug nuts on my car and my tire fell off resulting n damage should I hire an attorney?

Today I took my car to walmart for an oil change and to have my tires rotated. They took my tire off and forgot to put the lug nuts back on. When they went to move my car my tire fell off and damaged my wheel assembly, fender, and only god knows what else. They had my car towed to a shop for repairs and told me to pay out of pocket for a rental car which is going to cost over $500 and that they would reimburse me once I got my car back. This car is only 6 months old and I still owe $25,000 on it. I am worried that something more may be messed up than what meets the eye and I don't want to be responsible if a problem due to this occurs in a few weeks. So I am wondering if I should hire an attorney to protect myself. Not to mention how much of an inconvenience this is and it has caused me to miss work. Some help please!!!!

I fell down in Wal-Mart, what do I do now?

I slipped on the floor in a local Wal Mart store last week. One of their employees had been mopping and failed to put up one of those "wet floor" signs. I have tried to go to my personal physician, but his office staff tell me my doctor won't see me because of where I fell. Wal Mart will not refer me to a physician either. The Wal Mart representative tells me that I have to take care of all my medical treatment on my own, and that they will reimburse me after all treatrment is completed. I went to the ER and based on the x-rays, the ER doctor feels I may have a buldging disc in my lower back. I was told to follow up with a neurosurgeon. I am starting to get a little scared, I am not a wealthy person and now I can't even use my insurance. I don't really want to sue Wal Mart, but I'm starting to feel like I am being taken advantage of by one of the wealthiest companies in the US.

If I fell in the bathroom at Walmart and there was no wet floor signs, what can I legally do?

You would want to start by filing an incident report with the general manager and seek medical help. They will have an insurance company contact you to go over the rest. Be truthful make sure medical help has given you paper work. If you are looking for pain and suffering or legal action..good luck.

Wal-Mart sealed game case had wrong games in the case. I was accused.?

Tonight I went down to my local Wal-Mart and bought GTA 5 after i paid i walked out to my car opened the sealed case and there were two computer games one casino one and a demolition derby one. The games had scratches and smudges on the back. So without ever leaving the parking lot i walked back in and went to customer service i was told meet an associate at the back counter and they would get me a new game. I waited at the back conter for 20+ minutes until i walked back up to see what was up and they said wait a little longer. So i waited back there another 20+ minutes and until the same lady who sent me back called me up to tell me that they reviewed the security tapes and the game arrived in a sealed container which ment they couldnt do anything i would have to go through the manufacturer and i said no i bought the game from you! You bought the faulty games from the manufacturer i should receive my game and you should have to deal with the manufacturer. After an hour and a half of being there i was told by upper management he would review the tapes himself and call me with a decision. I am 17 so pretty much because of others i just got ripped off $60 and i figure the manufacturer is going to tell me not their problem either. Now i am seen as a thief and have wasted $60 dollars and my night... Fml!

Any body have any advice legal help? I will take this to court if i feel i can prove my self innocent!

My 3 year old daughter fell from shopping cart can i sue walmart?

I'm sorry to hear about your daughter. As far as sueing Walmart over this, your best bet will be to talk to a lawyer. There is too much involved for anyone to guide you on this correctly. You have the seatbelt issue and the available carts that may have had working seat belts. You have to prove she was sitting properly, with in arms reach and watched by you the entire time (mainloy at the time of the fall).
Did you call an ambulance from the store and how did the staff react....did they get a manager to you etc?
Be quick because they may have to get the tapes from that day/time of that area to view (the lawyer).

I would think you should be able to get her medical bills paid....all medical bills for the fall there. Be grateful she is alright and it wasn't anything worse, though it sounds pretty bad with the bumps and bruises.

A thought, get a larger belt to loop through the serat and around her, keep in your car/purse so if there are no seatbelts you have something you can use.

Walmart employee injury?

Did she file a workers comp report? If she didn't she needs to file that immediately. The store should have the paperwork she needs.

If you slip and fall in Walmart, is it their responsibility to pay your rent? Asking for a friend.

No. That’s not how it works. Now, if you can prove Wallmart were at fault, you might be able to claim for losses. So say they had cleaned the floor, used the wrong product and left it slippery. Of someone had spilled oil, they were aware of it but had not cleaned it or left a sign, then they might be.However, if your friend just slipped because they were running, because they were wearing slippy shoes or because they were drunk, then Wallmart is not liable. Same for if the floor was wet, but there was a ‘warning wet floor’ sign which your friend ignored.Next: compensation. What you can claim for is loss of earnings and payment for medical treatment. So if you need an ambulance and had a day off work, you could claim for that. However, you cannot say ‘I want you to pay my rent’ as that has no relation to the effect of the fall.NONE OF THIS IS LEGAL ADVICE. You need to talk to a lawyer specialising in injuries and negligence in your jurisdiction. Many of these cases are settled out of court, as it’s usually cheaper than going to court. However, be aware that Wallmart probably have security cameras, so if there was clearly no blame on Wallmart, you may well end up paying the legal bills yourself.

If you accidentally damage something in a store are you legally required to pay for it?

As with all matter of this nature, the solution is painfully simple if you flip it around and put yourself in the other party’s shoes. You own a small electronics store, a nice store. It’s still young and not very established, but it is on the way to being very profitable. You are the sole employee, owner operator. You’ve got a lot of stock. In your shelved stock is a TV. You paid just over $300 for it and when it sells you’ll make a good profit on it. Along comes the demon spawn of a dimwit and the little brat knocks it off the shelf “accidentally”. The parent is soooo sorry, but you’re still out 300 bucks for a TV you can no longer sell. So, would you rather eat the loss of $300, or would you rather have the demon spawn’s parent cough up the money for the TV the kid broke?Your weekly profit “take” is $2200 on average after expenses. Each week you write yourself a paycheck for 10% of the weekly profit, regardless of what that figure is. If you stand your ground and demand that the lady pay for what her demon spawn broke, your paycheck will be $220. If you let her slide because “accidents happen”, your pay for the week is $190.The choice is yours, choose wisely.
