Possession of weed first offense in MICHIGAN?

You can plea bargain it down to use of Marijuana generally on 1st offence punishable by up to 90 days in jail. Keep in mind before you panic (up to). Typically its just a fine. If the possesion charge sticks you can get (Up to) 1 year in jail. Typically 1st offence possession is given a slap on the wrist and you lose your licence for 90 days maybe a few months probation at most, unless you are homeless then you are gonna get whacked with about 30 days in jail no fines and no probation and no generally speaking they pack it all into one charge the parafenilia will be dropped.

MIP in Michigan. First Offense. Issued by the DNR. HELP!?

I am a 19 year old Michigan native and received a MIP for drinking in a state park by a DNR officer. This is my first ticket of any kind.I blew a .109 BAC. I want to know what I should expect going to court. I intend on pleading guilty, unless anyone has good reason why I shouldn't. However I live in Westland and attend college at U of M Ann Arbor. School is about to start soon, I was also wondering if i get assigned AA classes or whatever do i have to serve them in the city where i got the ticket, or could I do it in Ann Arbor? How much in fines am I looking at? I would imagine I would have to do an alcohol test, and is that the same as a drug test? I do smoke weed occasionally and wonder if there will be consequences for that or not. We were all very compliant with the officer, no one ran or made a fool of themselves. Any info would be very much appreciated!

Misdemeanor marijuana possession and punishment?

I was charged with misdemeanor marijuana and paraphernalia possession today. I live in middle Tennessee. I'm 19. This is my first offense I'm a little over whelmed by the severity of it all.

My court date will be in Dec. Here are my questions.

Will this show up on my record and be found by future employers? If so, how much will it effect my ability to get a job and for how long does it stay on my record?

Is there a chance of getting off with just a warning? It was less than a gram of marijuana. Dismissal? Anything?

Anyone with some experience in this situation, your answers will be greatly appreciated.

Okay, this is how it works for most of the U.S.

If you have an ounce of marijuana, that's possession of marijuana; exceed an ounce of marijuana and that's possession with intent to distribute (they will screw you on the intent to distribute). Ten pounds or more and that becomes trafficking marijuana.

Usually an ounce is from 3-12 months depending on your record and your attorney or a $1,000 fine. Over an ounce and you could be looking at 10 years. Ten pounds or more and thats about 20 years with a mandatory fine of $100,000; with a minimum jail term sentence of 5 years.

I would think that the laws are very similar throughout the U.S, so I believe this would apply to Penn.

Will I get time in jail for a first offense misdemeanor?

You might.  The likelihood is these charges were filed by detectives following an investigation.   I would imagine that they believe there was some threatening or harassing behavior involved.   If there is a domestic dispute, previous domestic violence issues or restraining orders issued in relation to the Complaining witness, that presents additional problems.  If that's the case, the state is going to want some assurance, at minimum, that the complaining witness will be not be further threatened.   If there is some doubt about this, they may definitely ask for jail time.You really need to speak with an attorney prior to any conversations with the Police or Prosecutors.  You have to hire an attorney.  If you have no money, contact the Legal Aid Society or Public Defender in city in which you were charged.

According to my book on Marijuana Law, by Richard Glen Boire, cultivation of any amount in Michigan is punishable by 0-4 years and a $2000 fine. Atlthough, Michigan allows for the conditional release or alternative/diversion sentencing of first-time possession offenders. In general this means that an individual can be put on probation instead of on trial. Upon successful completion of the program, the individual is spared any of the stated penalties and accompanying criminal record.

On a personal note; I was convicted of cultivation in the state of Louisiana 2 years ago. My g/f was arrested with me and she was offered a diversion program. I didn't qualify for the diversion. Instead I was offered a plea bargin, of 7 years suspended, 5 years probation, 1 year of house arrest, and $1500 fine. The sentencing guidelines in Louisiana are very harsh, 5-30 years hard labor, is what I was facing if I would have gone to trial. I had seven plants, which the police valued at $10,000 a plant. I'm now a convicted felon, but I was told that I can get it exspounged once my probation is over. Making an adult a felon for taking a hit of marijuana rather than smoking a Marlboro is irrational. The fact of the matter is that millions of people enjoy using psychoactive drugs such as nicotine, alcohol, caffine, and marijuana. The government should not be in the busuness of telling adults what they can or cannot put in their mouths, or declaring, under threat of imprisonment, loss of property and heavy fines, that it's okay to operate your mind with the benefit of one plant but not another. What goes on inside any person's body and mind ought to be nobody's business but that person's, so long as they do not harm others.
