Relax!!! Its not as big a deal as it seems (though I can understand why you would be under the impression that it is).

I spent a few years as an attorney for insurance companies so I know that what you are describing is a fairly common scenario.

Insurance companies are greedy and like to keep as much money as they can. So they will normally try to settle out of court by offering as little money as they can to the other party in the hopes that they will accept a small offer, which sometimes they do.

Otherwise, they just wait till you get a summons. By law, it is required that the summons has to be served on you, although after you receive the summons, the insurer will 'step into your shoes' by what is known as the law of subrogation. Please give a copy of your summons to the insurance company IMMEDIATELY, and then hound them for the next few days to make extra sure that their attorneys enter an 'appearance to defend', otherwise default judgment can be taken against you.

Even though your name is on the summons, the insurer will literally take your place in proceedings, which might still go to and fro for about a year before going to court. They want money from your insurance company, not from you, they would have done their homework and realised that you couldn't pay that amount personally.

Your insurance company will pay all the legal costs. In nine out of ten cases, the matter will be settled out of court by your insurance company before the trial date. In the unlikely event that it does go to court, you will be required to testify, as will any witnesses to the accident. If you win the court case, all is good and well. If you lose, your insurance company will have to pay out.

You might still have a long road ahead as these things take forever to resolve. Just make sure you follow up with your insurers regularly to ensure that everything is on track.

Got in Car crash NO INSURANCE HELP..?

Today my tire popped in freeway car lost control crashed on wall. I didn't hit any other cars or anything. Cops came by and asked if I had insurance I said no they gave me a court order. Would there be a fine? I just bought the car last week. Will this affect my driving record, nd me being able to be a cop? Need hel plz.. Live in CA........ Can I fix it by getting insurance now, or will I have to pay a fine. The ticket says to go to traffic court only, so I am thinking it it is only a fix it ticket. Am I correct and do I have a chance to go get insurance still??

They will caution you, ask you questions and write down your answers. They may record the interview. They will tell you at the beginning that you can have legal advice but that you are not under arrest. At the end of the interview they will either tell you that no further action will be taken or they will issue a summons for you to attend court. Can someone sue me for a car accident if I have insurance?

Absolutely! I just had a conversation w/ my insurance company about this very issue a couple days ago. She can go after your insurance company for the max that your policy allows, but after that she can come after you.

For example: I have coverage of 100K for medical bills for each person injured in the accident, BUT only up to a max of 300K per accident. So, say they had a car load of people, and everyone was hurt. The total that family can get from my insurance company is 300K toward their medical expenses.

After that, I have additional coverage of 10K, which can be used toward medical expenses, after their own health insurance has been exhausted. So if say they pay 20% toward their medical bills, and the health insurance company pays the other 80%, the 20% can be collected from the additional 10K coverage I have. However, after that.... it's all over.... they can then come back on me.

I just raised mine to $500K, given health insurance costs are so high these days, and I'm living in a high risk area. There's nothing you can do about the accident already past, but do make sure that you are WELL insured in the future. As one poster stated: it's a sue happy society we live in. It's never worth taking the chance.

Do make sure to call your insurance company though, because they also informed me that if for any reason I was being sued, THEY would pay for the legal representation. Not sure if all do this, but mine does.
