It was my first time doing anything like that and I know i am very stupid for that!!! Do I need a lawyer? Should I just go there and plead guilty without a lawyer? What does that even mean plead guilty? Can I get this out of my record? I don't want to hire as lawyer because I have no money.

Please help what should I do

Caught shoplifting from Walmart?

Around the end of June 2010 or so, a friend of mine was caught shoplifting from a local Walmart. She is 17, and she was stealing a few makeup products, such as eyelinear and blush. She believes that the total cost of the items she was attempting to steal was around $40.00 or so. As she was exiting the store, the Loss Prevention guy confronted her, and guided her torwards his office. The cops were there, but only to take her to the station to be picked up by her parents, for they could not reach the store at that time. The police did not press charges, or do anything similar, etc. The Loss Prevention man simply took down her address, phone number, name, etc. (not SSN or anything major) and said that the store was not pressing charges, but that she would be receiving a notice/fine in the mail in the sum of $150.00 to be payed to Walmart through the firm that was to issue the fine or "civil restitution?" NOTE: This event occured in the state of New Jersey, if that helps :)

Anyway, my friend just received said letter in the mail yesterday, but her parents do not want to pay it. They plan to have her write a letter back to the firm demanding evdience, circumstances, etc. basically, working the flawed system we have in our country. What happens if she does this, or does not pay the fine? Also, will this be on her record forever, until she is 18, or neitehr of the above? Will this affect her chances into getting into a good college, because she is a smart, great girl who just made a mistake she will never make again. Can she find a part-time job with this on her slate? Any additional information you can provide will be very much appreciated :)

I'm 19 and got caught shoplifting from Wal-Mart?

Hey guys. Ok, so, I'm 19 years old, and I got caught shoplifting a few DVD's from Wal-Mart. I know that is the the STUPIDEST thing I could have ever ever done, and I regret it more than anything, because in doing so, I betrayed the trust of my family and fiancee. I didn't even steal the DVD's because I wanted them, I honestly think I did it because I got (as much as I hate to admit it), addicted to the thrill of it. Now, mind you, this is the first time I have ever shoplifted, and it's my first offense EVER. All in all, the DVD's I took added up to around $80. I got caught right away, and they brought me into the security room and started interrogating me, saying "You're going to jail, you know that right?". Also, my mom was at the store this whole time. She had no clue where I was. Anyways, they called the cop and he came and cuffed me, pretty much said the whole deal. "You have the right to remain silent, etc etc etc". He then left the room, and they said he's either going to give me a court date, or take me to jail for the weekend. I was crying so hard and [raying to God for mercy. He eventually un-cuffed me and gave me a court date, because it was my first time ever. Now, what happens then? Could I still end up going to jail? Like, what's the best and the worst I can expect from court? Thanks everyone!!!

Got caught shoplifting at sears?

Hello Jenny. Unfortunately you may be limited in which companies you could work for going forward. Sears in one of many company's that uses USIS which is a theft check database. When someone is caught shoplifting or commits employee theft the persons name is submitted to USIS which maintains a database of offenders. During the hiring process candidates names are run against the database for matches. It will cause a "not recommend" status for employment. You could then dispute the findings, but they will follow up with the retailer to verify. Note: Not all companies use USIS, but it is a common practice in most retailers, supermarkets and small style specialty stores. They currently have over 2,000 companies that participate in USIS.

What are the chances of being prosecuted for shoplifting at macy's in ohio?

Ok so about two weeks ago a friend and myself were caught shoplifting at macy's in ohio...I know it was stupid and obviously i got what was coming to me from that stupid impulsive decision..but idk how the systems work and any advice would be great.

Here's exactly what happened. My friend and I made it out of the store and we were probably about 100ft away from the store when the LP guy came out and stopped us. Btw we're both 18..anyways, the guy told us that they weren't gonna do anything to us all they wanted was to get their items back and if we came back with them right then they wouldn't get the police involved or anything. He made it a point about four times that all they wanted was to get their merchandise back. So I handed him my bag that had the stuff I took in it and followed him back into Macy's. We got back to the LP room and he started telling me about the civil demand of $200. So at this point I'm thinking ok well you lied to me bc you said you just wanted your sh** back..but anyways I carefully read all of the papers that he wanted me to sign and ended up making a payment for part of the $200 civil demand. Then after all that he goes 'Macy's does prosecute 100%'. On the papers he gave me copies of it says "Macy's intends to prosecute this...etc"

I feel like the key word is *intends* and the decision is up to them if they want to actually pursue the case. What I don't understand is why he told us they weren't gonna do anything to us or get anyone involved but then says they prosecute 100%. Do you think that statement has any impact on if they'll actually pursue it?? Also the only papers they showed me or gave me copies of were for civil demand ONLY, no information on anything legal besides specific to Macy's store. The total merchandise value was $54 and he told me it was good that we fully cooperated.
Sorry for the novel I just wanted to include all information possible the first time around.

Caught shoplifting at Kohls but got away?

Hi, a close friend of mine stole approx. $110 worth of merchandise from Kohl's. As they were walking out and got into his car, loss prevention came out and tapped on his window with his loss prevention badge (maybe to scare him into thinking it was a cop idk?) . instead of getting out and talking to LP and giving the merchandise back and getting caught red handed, he then proceeded to back out and leave the parking lot. my question is, since the he didn't really use force to leave and loss prevention never found the actual merchandise on them, would a warrant still be issued for the suspects arrest? ohhh and btw he stole a few pairs of jeans by walking into the fitting room, so its not like the CCTV cameras really have hard evidence of him stealing the merchandise blatantly. A day has passed now and they have not called his house or came to his house. Naturally i would have suspected that they would just get his license plate and track him down but the fact that he wasn't caught with the merchandise on him is what makes me wonder?

I'm 18 and I was caught shoplifting at Kohl's. No police were involved. What next?

I'm 18 years old and i live in Texas. I was caught shoplifting at Kohl's. The item was $24.95 (without taxes). I showed remorse and immediately felt terrible for the mistake (this was my first offense ever). The Loss Prevention lady was sort of nice... She didn't call the police, although she threatened about three times. She stopped me right before I walked out of the door. I signed two papers, out of fear and rush to leave; one admitting to the crime and another agreeing never to enter the store again. She said I should expect a fine up to $400. I have been doing some research and I figured out that the fine is called a Civil Demand letter in which the store is entitled to send, to pay for the damages of the item and recovery. She took back the item, took my picture, got all my information, and took a picture of my driver's license.
Questions:
1. How long until the letter arrives?
2. About how much will the fine be?
3. What exactly will the letter say?
4. Does the letter require me to go to court?
5. Will the offense be on my record, and if so, can it "fall" off?
6. What will be enclosed in the letter? (pictures of the item, item description, reason why I'm receiving the letter, details of the incident, court date... etc)
7. If the fine is an outrageous amount, like over $200, do I have the right to fight against it?

What should I do if I am wrongly accused of shoplifting? How do I conduct myself when I cooperate with security staff to prove my innocence without embarrassment?

This has happened to me, and the resulting settlement paid for most of my car.Stay calm. Get a good look at whomever is accusing you. If they want you to go some place private, decline. You want everything on camera.Do not admit to anything. If they want to pat you down insist on a police officer. They can hold you, they don't have the right to put hands on you.Odds are they have this on camera. If they do, review this with the officer and have him put in writing and sign what he sees. If they don't have it on camera then they really have no reason to hold you. “I thought I saw” is not grounds for detention. If you're shown to not have committed any crime on camera or the officer finds nothing on your person then leave with the officer. Immediately. Get the name of any employee you dealt with.If anything happens at this point it's on the establishment.Keep in mind that security personnel don't exactly have good training in most cases. Some barely have a high school degree. From my experience they've normally tried to be cops but failed.

What will happen if I don't pay the civil demand from Kohl's?

I got caught shoplifting approx. $150 worth of merchandise from Kohl's a couple of weeks ago. I was arrested and bailed out. I had court a couple days later. My final court date where they actually sentence me is in a couple weeks. I just recently got a letter in the mail from Kohl's stating they wanted me to give them $200. The letter didn't come secial or anything and my address was actually not even fully correct, so it didn't seem really THAT serious. Is it? What could happen if I don't pay it? Please help, I'm nervouse about everything. I don't even know what my charges 'll be yet either. I'm 19 and live in OH. This is my first offfence.
