What exactly is workers compensation?

Workers compensation should cover your medical expenses and a certain percentage of your salary only IF your doctor determines you cannot go back to work. Realistically, most physicians try to get you back to work as SOON as possible...even if on light duty because all the evidence shows that those who do NOT return to work in a timely manner have very poor outcomes. Yet, for some, it is necessary that they remain at home.

If you are supposed to stay at home, you can only collect worker's compensation after a predetermined time....this may vary by state, but is one week where I live. In otherwords, you have to be off at least this amount of time before you can collect anything. Also, your compensation check is usually much less than your actual salary...60% in my state. It depends on the nature of your injury and opinion of the physician.

Workmans comp has NO right to force you to do anything and they DO NOT tell you what and when
to do, I SUGGEST YOU GET A LAWYER!

I have been on comp for more years then I care to admit!! and I am sick to death of people getting screwed!- seriously!

1. you were legitimately HURT on the job and you are entitled to treatment for the rest of your life... They cannot dictate what you receive and not receive- The insurance company IS responsible. Your Physician CAN override WC DR

If you cannot handle that therapy or your JOB, they MUST provide and offer retraining and that is what they are trying to get out of.

Your exact 'fear' is why people dont stand up to these people and it isnt right!
I dont know what state you are in, but
1. The WC dr- is NOT responsible for your treatment and if you cannot do that therapy, they cannot force you- NOR can they say that you are non-compliant- You have to live with the pain NOT THEM!

Here is what you can do too.. EVERY STATE HAS A BLUE BOOK
Call Your STATE WC office and tell them you want a copy of the WC LAW (they may charge you like 5-10.00) but it is WORTH it to know what your rights are
OK YES in 1991 when I woke up from surgery and knew at that point, i would NEVER return to my job and be stuck in the hospital for rehab... I purchased this book and I stayed on top of the law and they did not push me around
YES - I realize times have changed, but if they start TELLING you and FORCING you to do other things, and you are in obvious pain, and not well enough to handle the job... GET A LAWYER- do not stress yourself out over this stuff!

So, I would be calling my Dr and then calling comp and telling them that you are NOT going for that therapy, because you cannot do the job anymore! You don't belong in a warehouse hurting You can go to school ... Get ahold of Voc Rehab for your state
IF he wants you in Therapy, why didnt they offer POOL therapy, that would be easier and make more sense...

Anyone experience Workmans Comp. madness?

i was a driver for fed ex, i hurt my knee 5/28/05(fell down the stairs) cut my knee open, went to er. after my job..had staples put in, seen fed ex doctor that next week, then a new doc (i chose) had having arthroscopic surgery, having osteo-arthritis now.. im still under doctor care. no lawyer would take my case (laws have changed and lawyers take big cases)
i worked part time and was given 90 days to heal, then got displaced, then terminated after another 90 days. fed ex did NOT help me find another job while i was displaced, had a sit down job and gave it to someone else. they realized they didn't help me with the job searching process (sit down jobs) in my area while i was "displaced" and then they rehired me again for another 90 days. i just had surgery in september 05, was terminated dec 2, rehired jan 15 then re fired april 15. i had to take fed ex to the labor board becuase they held my check 20 days the first time they fired me. anyone experience workmans comp b.s.?

Do I have to serve jury duty if I'm disabled?

Depending on where you are, I believe there is a section on the form,, where you can state you have a disability, and do specify the nature of your disability, and include a letter from your doctor stating you are unable to do jury duty due to the nature of your condition. This might be enough to excuse you on a permanent basis.

The other thing is there a phone number on the form, for inquires? If they do you could ring up and explain the situation, and they will tell you what you need to do, and what to put on the form.

You may still be required to attend on the nominated date, but as one of the other answerer's has said, they will give you an opportunity to state your reason for not being able to sit, it also will be a good idea to have a letter from your doctor stating that you have Bipolar and anxiety which you can give to the clerk of courts, who will show the judge.


My husband is a insulin dependent diabetic and a friend has bipolar and anxiety problems too and both have been permanently excused for jury duty. But they had to have letter form their doctor to support them.

Edit; It is true many diabetics can do jury duty, with out problem.
And know disrespect to Justmeinthisworld, my husband's diabetes IS VERY well controlled, but for some reason his sugar levels drop dramatically (very rarely do they go high, unless he is ill), he eats when he should, does not skip meals & eats balanced meals, does regular blood sugars 4x daily, with his insulin, exercises regularly and tries to maintain a healthy weight.

He can go for months with no problems, then for some reason his sugar levels drops, his specialist said to us he wishes other diabetics were as scrupulous with medication and meals etc. He has what is called labile diabetes which the specialist said is kind of unfair as it refers to the patient is not being consistent in their management, and he knows this is not the case, even our dietitian has backed us up, when I gave her a food diary of what he was eating & drinking. I just had to mention this, as it has been incredibly frustrating, when doctors & others assume he/we are doing the wrong thing, and it is very scary to see a loved laying on ground unconscious, with very little warning. And its because of this he has been excused from ever doing jury duty.

Would you make your company aware if you saw that they accidentally added an extra two zeros onto one of your weekly paychecks, or keep it a secret?

I was a store manager with a growing chain of convenience stores. I was shot point blank in my right hand with a .44 magnum hollow point bullet, while disarming a suicidal, intoxicated man. It happened on a Saturday evening, in my pasture, of all places.I lost part of my hand, and my ring finger. I returned to work at 6 am Monday morning and worked for 5 weeks. One day, the division manager (who did not appreciate my sense of humor, as I have Wisenheimer disease) came to my store. He said I needed to go on short term disability, and assured me my store would be waiting for me. Two days later, he gave my store to the interim manager.After 5 months, 3 surgeries, and a lot of physical therapy, I returned to work. Owing to the fact that I am righthanded, and the substantial nerve damage in my hand and wrist, I was unsure of my ability to fulfill manager’s role (lots of physical, as well mental work.) I decided to step down to assistant instead of asking for another store.My pay was set at the position's ceiling. When I received my paycheck, it was more than I was entitled to. Payroll had taken my manager salary, and divided it by my hours.I called my area manager, and he contacted them, and had it corrected.I eventually stepped back up to store manager, and was quite successful.Ironically, the company restructured, and the division manager went to work at the bank. Every time I did any banking, and he was working the drive-thru, he would make rude remarks, call me Lefty, and point out my hand to any other tellers there.One day, I sent my assistant to pick up my change order. Old dm had prepared it. When I counted it, there was an extra $500.I immediately called the bank, and sent my assistant back with the “free" money.After that, old dm would suck up to me and call me his “best friend", because he had had no idea to whom he had given the stray money. It was more annoying than the previous rudeness.

I hate my Job but i can't quit, help.?

Hey Guys,
just need some advice on how to deal with this. I've been working at this call center for 1yr now and i absolutely hate it, this job has made me so miserable to the point that I’m feeling depressed, every time i get ready for work my stomach hurts, my heart beats fast and my whole body becomes very intense, on top of that my face started breaking out as well. I can't quit my job at the moment because i need the money to survive, i have no savings, no family nothing to fall back on but myself. I've tried thinking positive thoughts and focus on the positive side of things but it's hard when you spend most of your days doing the one thing that makes you unhappy. A little bit about my job: i work at a call center, the pay is incredibly good, the customers are extremely rude and management doesn't care. I've been told to not take it personal when a customer is yelling at you calls you names and or threatens you, just read the script you are suppose to read. every time i hear a call come in my whole body shakes and i start to sweat, every time i go into work i feel like a piece of me is dying. It seems like I’m always calling out of work sick, this job has taken a toll on my mental and now physical health as well, I know I have to leave for my own sake, i am in the process of looking for another job but nothing has came through yet, at this point i am willing to take a pay cut just to get out of that place, the past couple of months have been especially harder, I’ve been so down that i end up making an appointment to see a therapist to help me deal with this issue. As silly as a sounds my passion is makeup, i believe in heart that's what i'm meant to do and i'm very good at it as well, i live in very small town with no opportunities so my plans are to move out of state and give this dream a real shot but i don't know how to go about it seeing that i have no savings and nothing to fall back on. I’m feeling so alone and lost and I don’t know who to reach out to, any advice you have for me will be greatly appreciated.
