How Can I Claim My Maternity Benefits

Do you get to keep your insurance benefits while on maternity leave?

I work for a very small company (the boss, me and another lady), when I take maternity leave will my benefits still be in place or is it up to the employer? What if I need to take an extended leave? Any web sites where I can check this out? I live in Michigan and Im not sure if Im going back to work after the baby is born. Thanks.

If a trans man gave birth would he get all the benefits of maternity leave in the US?

In the US, federal maternity leave benefits are covered under the Family and Medical Leave Act (FMLA.) FMLA allows for 12 weeks of unpaid leave following the birth of a child. This applies to either parent (both of them individually actually.) The law doesn't treat mothers in a different way than it treats fathers. The gender of the parent never comes into play. Trans men, cis women, non-gestational parents, they all get the same benefits. That's at a federal level. There are 50 states that each may (or may not) have laws that pertain to protected leave following the birth of a child. There is no state that requires this leave be paid.There are some individual employers who offer leave benefits above and beyond the federal requirements under FMLA or the state laws to which they may be subject. Whether or not a trans man receives benefits from those employers would depend on the individual employer's policy. That being said, I have a difficult time imagining an employer that has a maternity leave policy not allowing a trans man to take advantage of that policy and failing to grant them access to that leave could potentially be grounds for a sex based anti-discrimination claim. How it would play out in the courts, I don't know... but most of the HR departments I've worked with see that as a potentially nasty legal fight and that the costs of letting the employee take the leave are lower than the costs of fighting it. Again, remember, companies that offer paid maternity leave at all are ahead of the curve in providing employee benefits so they are less likely to have a company culture that would be trans exclusionary. Speaking in generalities though, there are always exceptions.

I'm a former flight attendant who was able to collect unemployment insurance during my pregnancy. There were two stipulations though:
1. My doctor submitted a note stating it was dangerous to my pregnancy to continue to work in my position.
2. She also had to state that a less strenuous job would be okay.

When my airline was unable to produce a temporary sedentary job for me I was eligible for unemployment benefits in the state of PA.

*Note: Had the doctor said that I could not do ANY work, then I would not be eligible for unemployment, but could have tried for disability.

Many fellow flight attendants collected unemployment while pregnant.

Do you/did you get paid maternity leave?

I have been working at the same place for 12 years. I love my job very much and I'm not complaining but I have heard from a couple women that they have gotten 6 weeks of full pay maternity leave. My husband and I have had to work overtime to save up enough money for me to have 6 weeks off. I guess I am just a little jealous of those who get it paid. Do you/did you get paid maternity leave? Do you think that we should get paid maternity leave?

I live in America. I know other countries laws are different so if you live somewhere else what kind of maternity leave do/did you get?

Can both husband and wife claim maternity if both of them work in the same company, i.e., same insurance company and same TPA?

Not sure where you live but in the UK both parents are entitled to leave mothers to maternity and fathers paternity leave. Paternity is only two weeks and pay depends on the company and your contract, maternity leave is a number of weeks and pay is minimum leagal amount for maternity pay but you may get more if in your contract says you do. The father is also now able to take some of the maternity leave in place of the mother but she will lose any claim to that portion of the leave.Claiming the same time in the same company may not be great but in the UK at least there is nothing they can do legally, (illegally they could make life hard for you both)

How long do you get off for maternity leave?

Your employer isn't required to pay you ANY maternity leave (USA.)

The FMLA act requires that if you are employed by them for over 1 year and they have a certain # of employees, they MUST allow you to take up to 12 weeks off. But that is NOT PAID.

THe majority of US employers simply allow you to take sick, vacation, personal, or unpaid leave. If you have maternity leave, its a bonus.

Question about Maternity EI, please HELP????

What you can do is combine three types of EI benefits-if you are eligible.

1) Sickness Benefits-up to 15 weeks
2) Maternity benefits-15 weeks
3) Parental benefits-35 weeks

Those are three different types of "special benefits" altho everyone likes to put them under the title of "maternity leave"

You need to get a doctor's note for the time you want to get off now. (ask him to put a date on there for the full time you are off sick and why so you dont have to go back and get more doctors notes) That is standard for any kind of sick claim. You also need to get your ROE from your employer...make sure they either put that you left for sickness or maternity reasons. (even if you dont think you are coming back...dont put that you quit...holds up your claim while it is adjudicated and your ROE should state that you stopped working due to sickness....rather than "quit") When you do your application online the reason you are stopping working is you are "sick". It will ask about pregnancy in the application.

This may apply to you as well:
You have received sickness benefits before or after your maternity benefits!
You could receive up to a maximum of 65 weeks of combined sickness, maternity and parental benefits instead of the normal combined maximum of 50 weeks. In order to be eligible for the increased number of weeks, the following conditions must be met during your benefit period:
you have not been paid regular or fishing benefits ;
you have been paid sickness, maternity and parental benefits; and you have been paid less than the maximum of 15 weeks of sickness benefits or less than 35 weeks of parental benefits.


So basically...right now you apply for sickness since you cant work. Get your medical notes, ROE etc. (dont wait for your ROE...apply first and then get your ROE because that can take time) Then you switch your claim to maternity. (forms to be filled out) then parental. Depending on how you did your application, it may switch automatically to each of the benefits. Remember to notify EI when the baby is born to start the maternity time.

It can be confusing...call Service Canada at 1-800-206-7218 and hit 0 to talk to a real person if you need help.

Oh...for special benefits you need 600 hours insured work in the last 52 weeks.
