What do you do when someone files a false police report on you?

First, just because someone contacts the police, doesn’t mean a report will be filed. If a report is made, it also doesn’t mean that an arrest will follow. If when talking to the reporting party it is determined that a crime has occurred, or it would be reasonable to believe that a crime as occurred, and that it’s not a civil matter, that report will get filed.If it’s a civil matter, the party is informed of that, and if it’s just un Either the officer or a detective, depending on the size and policies of the department involved, will follow up and perform additional investigation, which will likely involve talking to you. This is rather rare, and generally involves very serious allegations, rape, kidnapping, etc., things that have caused huge community disruption and/or cost to municipalities or states in terms of manpower for searches, etc. Beyond that, you could potentially have a civil case for harassment, but those are difficult and expensive to prevail.

We have contacted the atty., he says he is 'working on' contact the judge who ordered this decree in October of last year; in the 9 months we've lived here, we've never seen him playing outside with friedns (during the school year, the schedule was for him to walk directly to my house after school and catch the bus from our home when time to leave. She works 6 AM- 2 PM, meaning the child either has to go to her sis's the nite before, or be dropped off at 5 AM (he's told us in the past it's both). I suggested he could stay with me until she comes home from work (giving me more time), or we resume the week to week we've used for 3 yrs.

So, I caught a person we know on camera going through my cabinets when we were not home. We used to keep a vacation fund piggy bank up in the cabinet, but moved it after it was robbed a few months ago. Other misc things and cash from other locations have gone missing since then as well. So we set up a hidden camera, and found out the thief was one of our "friends." We have all his information, address, full name, etc. We have the pictures which are not of the best clarity but clearly he can be identified. He has stolen at least $1,500 from us in cash alone.

So, we will file a police report today.

What happens next? Anything? Or do we have to take it to civil court or only file an insurance claim?
Will the police come to out house to finger print? Do we have to testify in court? Will it even get that far?

I ask since we were robbed 10 years ago. Someone broke a window and took our computer, TV, digital camera, Stereo, and a paintball gun. The police came, took a report, and nothing happened, ever. We had clear hand prints on the glass. They said they would work on it, but when I called months later they laughed at me, said it was a small crime and likely someone we knew, and that they were not going to do anything. With the camera shot and known person in this case, I am hoping it won't be the same...

Anyone been through the process and have any insight or information as to what to expect? Are we on our own? With the video and known residence, is there more of a chance of seeing something done?

Filing a false police report is a criminal act, not a civil tort. You can sue for such things as slander and defamation of character. However, you need to understand that you are going to have to show, in court, evidence that you have been damaged. What has it cost you? Were you fired from your job, or did someone decide not to hire you because of this action? Did it create legal expenses for your court defense? Has it damaged your reputation within the community - and if so, how? What exactly did it cost you?
You cannot sue just because it angered or annoyed you - you have to be able to show damages.

Can I file a police report without signing it or giving them my license?

Yes, you can make an anonymous report to the police. People do it all the time. The problem is that your anonymous report has little or no evidentiary value. If you identify yourself and sign a complaint, then the police can take action based upon that complaint. If you don't, then they probably can't. For example: Imagine you visit a person's house and see that the person possesses some kind of contraband - machine guns, a meth lab, child porn, etc. If you sign a complaint, and you are a credible person, and the information is very recent (not days or weeks old), then a police officer can get a search warrant based upon your statement. You may even be able to remain anonymous to the court for the search warrant process, with the police officer essentially swearing to the judge that a confidential source has provided the information. However, the police will have to have your real identity in a confidential file in order to do this, and if the case goes to trial they will be required to give your identity to the defense team. On the other hand, if you make your complaint completely anonymously then about all the police can do is keep an eye on the suspect - maybe to the extent of knocking on his door and asking him for permission to look around, which he will likely refuse. For any case involving a living victim or witness, that person likely will be the star witness if there is a trial - not the police officer who merely took the statement and did the court paperwork. To be that star witness, the complainant needs to be identified. In short, an anonymous report is nothing more than a "tip" which an officer may or may not look into depending upon whether he has time and how interesting the tip is. He won't have very much legal authority to take any actions based upon an anonymous tip.

How would i file a motion with the court system, for early termination of probation?

Good for You!! Have your probation officer write a report to the Court recommending your early release from probation. If you are working, and have a steady work history, have your boss write a letter also. If you are going to school, trade, college, high school, etc., submit any reports you have showing attendance and grades. Letters from your teachers should help. If you are renting an appartment in your name, show receipts that show you pay on time. If you have done community service volunteer work, get the supervisor to write a letter. Whatever you have done that is positive, bring it with you to the Judge. Go to the Clerk of the Court and ask for a hearing to be set, or ask your probation officer to get it set for you. Then bring copies of everything you have ALREADY SUBMITTED to the Court with you (Reason being, the judge likes to be able to review your case before he sees you.) Best wishes. If he says "not Yet" thats o.k just go back and do more service work for free or whatever the probation officer thinks the Judge wants. Oh, by the way if it was alcohol or drug related, be sure you have completed any counseling program that was recommended.

What do I do when someone threatens to file a fake police report against me?

Well my advice is that you do nothing for the time being. The business of setting the machinery of the law in motion against anyone has to be done solely on the grounds of justice. Nobody is allowed to waste the time of a court of law by filing a “fake police report” or law suit. If anyone files a report or law suit against you on any grounds other than seeking the ends of justice, that would amount to Malicious Prosecution, which itself is a legal wrong that results when an action is brought against someone malafide (in bad faith). In my opinion, the case of someone who “threatens to have filed a fake police report” against you would seem like an instance of maliciously setting the machinery of the law against someone since it was based on a “fake police report”. That is certainly an abuse of judicial process since the complainant knew very well that the whole complaint was a fabrication. You can launch a counter law suit against the false complainant but you have to wait till the police he claimed to have filed the fake report with actually contact you or press charges against you. That is when you should consult with a lawyer.
