How Do I Request An Increase In Child Support

Can custodial parents get an increase in child support if the non-custodial parent wins the lottery or gets a raise at work or otherwise ends up with more money?

Yes, the custodial parent just has to file a child support modification and take the non-custodial parent back to court. You request the documents from your local family court or by calling the child support hotline.

Child support increase from the Army

You should have a court order that tells you how much you have to pay. If it says you have to pay x amount of your pay then you need to go to finance and up the amount. Normally you are court ordered to pay a fixed amount by the court regardless of pay increases. If she wants more money she has to take you back to court and ask for it and if she wins you have to pay. She can't find out anything about your pay specifically or legally unless you tell her yourself. The Army and DFAS are far to busy to keep up with the millions of ex's and baby's momma's to tell them anything or send them any letters. If you want to send more money for your child you will need to take care of that all by yourself by changing the allotment amount if that is how you pay her. Hope this helps.

How do you fight child support increase ?

My x-wife is trying to raise my child support, but is allowing my 17 year old daughter to get married to her 20 year old live in boyfriend. It appears she wants to raise the child support right before they get married.

I'm completly upset by what my x-wife is wanting to do, and my daughter will not speak to me because I disaprove of every thing her mother is letting do. I have not had any communication with my daughter for several months ( by her choice ) .

What can I do to stop, or atleast delay the increase in child support ?

Note: I'm current on my child support, I'm not a dead beat dad. I just do not want to pay out more money to support for the terrible decisions of my x-wife.

How can my ex increase my child support because she lost her job? I already pay $600 a month for 1 child.

How can my ex increase my child support because she lost her job? I already pay $600 a month for 1 child.SHE can’t increase your child support for any reason. Your child support obligation is set by Court order. Only a judge can adjust the amount, and then, only if something changes in YOUR circumstances - if you get a new job making more (or less) money, for instance. Then whichever one of you would benefit the most would file a petition in Court asking for a change in the amount.

How much is child support increased if the father receives a large inheritance in the state of Nebraska?

A parent may seek to modify the amount of child support because of a change in circumstances. The parent has to show this change is sufficient to require a modification of child support. If a parent's income level greatly increases, this increase will have a direct bearing on increasing the support payments. Therefore, for example, if you receive a salary increase, the other parent may attempt to modify the payments.A court may determine that a parent's post-divorce inheritance is relevant to modification considerations. The court must determine how much of the inheritance to consider for modification. Some courts may consider the entire amount and increase the support payments greatly. Other courts may only consider the income that's generated by the inheritance and not the inheritance itself. Therefore, a court may not consider a house you inherited in its modification determination. However, if you collect rent on the house, the court will consider the rent as an increase in income. For a court to increase support payments, the parent asking for the increase usually must show a need for the greater amount. A court may determine that the parent isn't entitled to share in the other parent's inheritance if it exceeds their standard of living when they were married. However, the court may grant the increase in support payments if the initial support determination didn't provide the marital standard of living because of a lack of income at that time.

"Dear Mr. XXXX:

Per the court order dated September 13, 2006, under complaint 7:

“Pursuant to Ark. Child Support - Increased without me knowing?

Hello. A few months ago my ex filed to have DCSS review child support. I turned in everything I was supposed to and about 2 months later, I received a letter stating that the child support amount would not be changed because it would not change by 20% or $50. This really didn't make sense to me since I made considerably less than I did when they originally made the support order, but I was fine with it. I should probably mention as soon as DCSS opened the case to review my child support order, I received letters from the county showing I was up to date on my support and then received letter from the State stating that I was now behind on my payments. I went to the county and they assured me that my payments are up to date, and that there is was a discrepancy between the county and the state systems because of some change they were doing between the two. They said they sent the state a notice to correct their system. I asked them about the letter I received stating that there was no change in the support amount and they said that it was correct, there was no change.

Now, I arrived at work the other day and received a paper from my employer stating that my child support amount has increased and gave me the new amount that was being taken out. I work for a government agency and called the pay master and they said they had nothing to do with it. I'm now waiting on a response from the county. Is it possible for the state or county or whoever is handling this to increase my child support without me knowing? Or having the opportunity to dispute it? I'm not sure how this is all happening? If anyone has any thoughts or suggestions, I would really appreciate it.

Thanks.

If i win the lottery does my husband has to increase his child support to his ex?

Child support will only change if his ex requests a new/revised order from the court. You are not required to notify the court of any changes unless it specifically says to do so in the child support order. In some states, your income and your assets (including lottery winnings) will be considered when calculating child support as you and your husband reside in the same home (so it's family income which he has access to), are an equal partnership, etc. You can look up child support guidelines online for your state or ask for help at the info desk at the library to find out the laws for your area.

Do child support payments increase over time in the US? Why?

Every state is required by Federal law to come up with a "guideline" formula to use to calculate child support. Some states have a very simple formula (based solely on a percentage of income, etc). Other states have a more complex formula (in California, we use what is essentially modified tax software to determine what child support is going to be). Every state is free to change the formulas they use, as long as they implement some sort of formula. Child support generally does not increase (not sure if your question is asking if an individual payor's support increases over time, or child support in general increases). In California, the amount can change every year simply because the tax laws change every year, which affects the net incomes for the parties. Child support will usually be increased if the payor makes more money, and/or the payor's parenting time decreases (this is not true of every state).
