They jokingly nick name these attorneys as Public Pretenders as like I said, they are overworked and under experienced. Generally their function is to plea-bargain your case, and to keep you from asking for a very expensive full blown trial and saving the state tons and tons of money, all the while getting you to plead guilty for a shorter sentence. This form of justice serves many purposes. First and foremost, like I said, the state saves money, the Public Defenders, who are employed by the state get real time/real life experience and the horribly overcrowded justice systems wheels keep on slipping, slipping, slipping- into the future!Anyway, that would be the way!

He is scheduled to go see his parole officer apr 11 so will they hold the warrant until then and when he comes in to report, wham they take him then or are the odds they will send someone out to his residence.

Another question, by me pressing charges for the simple assault that occurred is that an automatic parole violation? Can they also get him for an address violation as well, he was living in another state and paroled in another.

Did I screw up my court appearance for a traffic violation?

You have not screwed anything up; you are just wasting your time. You should have waited until your citation showed up online--that can often take a few weeks. However, your options when you get to court will be the same. You will be able to pay the fine and sign up for traffic school, or continue the matter to a later date to do so.

However, as long as you are going to court, here is a point. You are probably charged with a violation of Veh C 21453, subdivision (a). The scheduled fine for that violation is about $490. However, I and many of my colleagues believe that charge is appropriate only when the driver goes through the intersection against a red light. We believe that turning right against a red light is a violation of Veh C 21453, subdivision (b), and the scheduled fine for that offense is about $240. You may wish to have your case go before a judge, not to say you are not guilty of any offense, but to say that the offense you committed is subject to a lower fine.

BTW, re bail. California has an odd system of handing traffic matters. If you do not want to go to court, then technically what you do is post bail with a clerk, which is in the amount of the fine, and then that bail is forfeited and you are convicted. So all of the fines are listed in a bail schedule. Some judges also misunderstand this, and think that if somebody appears in court before a judge (not a clerk) and asks for a trial, he has to post bail. That is not correct--at that point the person is generally entitled to be released without bail.

The reason the other driver was braking was probably to stop you from tailgating him, which is likely if you were trying to go 80 mph. The car pool lane is not a "no speed limit" zone. If this was nighttime, you should have been AT LEAST six seconds behind him--which is quite a distance at 80 mph.

If you were cited only for speeding, which is a non-correctable infraction, then the scheduled fine for going 16-25 mph over the limit is about $360. Traffic school will add $50, plus the cost of the school, but keep it off your record. In most counties you can complete traffic school online.

However, if it is worth it to you, you could consider going to court to plead guilty, but tell the judge you believe the officer made a 2 mph error, and you were speeding, but at 80 mph. The scheduled fine for going 1-15 mph over the limit is about $235, so you might save about $125.

Note: don't listen to those saying you can find all sorts of information on the citation. California citations do NOT include that information. You should get a courtesy notice in the mail, and you can probable get information on your citation at the superior court website for your county.
