How long of a jail sentence will someone get if they are caught with 1 gram of Meth?
I know someone who got arrested for possession of 1 gram of Meth on September 8, 2016. This person has already been in jail now over a month. I am just wondering how long he will be there.

um depends on what charges.....how many previous offenses and where...... generally he will get the 2 months counted as time served so will b 22 months...can get up to 40 prct off for good behavior depending on charge.... if it was violent act will have to serve 80 prct in most places these days....

I don't know what is considered a long prison sentence but I will tell you my story... In 1992 I was arrested and charged with (1) possession of a precursor chemical with intent to manufacture methamphetamine (2) use of a firearm in the commission of a drug crime (3) ex felon in possession of a firearm (4) possession of methamphetamine with intent to distribute... After about a year in custody I plead guilty to charges 1 and 2.. My sentence was 15 years.. I was 25 years old.. My release date was 6/6/2006.. I filed a few appeals that were shot down by the courts.. Filed another and after around 7 years of fighting back and forth my appeal was heard by the ninth district court of appeals in San Francisco (where the federal prosecutor stood in front of the three judge panel and lied about my case) the Court ruled in my favor and ordered my original sentencing judge to vacate my 5 year sentence on the gun.. Anyway I ended up doing almost 10 years.. I got out on July 7th 2001 (my moms birthday).. Grabbed a lunch pail and went to work.. Been married to a beautiful woman since 2003.. Four beautiful kids.. And love my life.. I forgot to tell you what it was like.. It sucked!! But u know what the human mind is made to adapt.. People say to me I would commit suicide if I had a sentence like that.. I tell them no you wouldn't.. I think I saw one person kill them selves during my sentence and he should have been a patient somewhere instead of in prison.. So thats a little piece of my thoughts on long prison terms
How much time of a 24 month prison sentence will he serve?
254 days will be spent in prison. 24 months is the total criminal sentence. The "sentence" includes probation/parole. "Time served" is only time actually in prison. So if the sentence is something like "24 months, with 254 days to serve" then that means 254 days in prison followed by 476 days on probation. Probation is time on your sentence that was set up by the judge beforehand to be spent out of prison but under sentence. Parole is when you are actually released from prison early. Of course, unfortunately, many states give 2 for 1 credit. Meaning you get credit for 2 days in prison for every 1 day actually spent in prison. This is just done to reduce prison overcrowding, which actually serves only to increase prison overcrowding by putting criminals back on the streets to committ more crimes..... Unfortunately, unlike Sue, I've been in court a LOT more than 16 times. Probably more like 4 or 500 times. And since the majority of the people I end up arresting as a burglary detective are already on probation a LOT of those appearances are in probation revocation hearings. The judge usually lays it out something like this, "24 months with 254 days to serve and the remainder spent on probation". At least that's how they do it in my state. Probation is nothing more than part of a sentence spent spent on probation in lieu of in prison. Whether this is completely in place of prison time, or after the prison time is irrelevant, it's still probation. Parole IS when someone is released early. If he gets out early due to "good behavior" or whatever else that IS parole.(period) Apparently though you're saying he was sentenced to 24 months to serve and has done 254 days of it and you're asking when he might get out? There's no requirement that he get 2 for 1 credit or any of that. In my state he would probably only do 12 months if he was sentenced to 24. But this varies. It's best to just plan on the entire 24 months.

In MO, for example, you will do from 15–85% before parole eligibility. Jail time served may also count towards the front (time in prison) rather than off the back (time on parole). Some states also offer “treatment” (say, from 84 days and up to a year that once completed you’re out the gate) .In states with parole, your time on prison grounds will also depend on the TYPE of offense (drug, non-violent, violent, sex offense), whether your offense is parole eligible, the CLASS of offense (what degree or what class, i.e. A-D felonies, A being most serious), your behavior while incarcerated (yes, conduct violations DO matter, as does being productive with classes, work, etc in prison), and your “salient factor” (risk and recidivism) score.Two people with identical charges and sentences and pre-prison jail time credits, arriving at the same prison on the same day can have WILDLY different lengths of their prison stay. Read your state’s parole eligibility info; it should be online. Missouri DOC’s website is Missouri Department of Corrections …I believe they have most of that info posted up there.And of course some states don’t offer parole at all. its up to the judge. you may beable to do jail time instead of paying, but for $1000 you'll probably have to do at least a couple months. it depends on the state/county and the judge.

Each state has a fluctuating release rate. For example, Tennessee's overcrowding has inmates serving only 30% of their sentences before they are eligible for release. This is in addition to the “good behavior time”. So an imposed sentence of 10 years can be reduced to around 20 months, minus time served while waiting for trial. However, certain infractions committed while incarcerated can cause an inmate to lose “good behavior time” or actually add time to their sentence. If inmates are released early it is most always with the stipulation that the remaining imposed sentence is served on probation. Inmates often chose to “flatten” their time, or avoid probation, by not receiving the overcrowding rate reduction.
