support orders is as follows: CS = K (HN - (H%) (TN))..
(b) (1) The components of the formula are as follows:
(A) CS = child support amount.
(B) K = amount of both parents' income to be allocated for child
support as set forth in paragraph (3).
(C) HN = high earner's net monthly disposable income.
(D) H% = approximate percentage of time that the high earner has
or will have primary physical responsibility for the children
compared to the other parent. In cases in which parents have
different time-sharing arrangements for different children, H% equals
the average of the approximate percentages of time the high earner
parent spends with each child.
(E) TN = total net monthly disposable income of both parties.
(2) To compute net disposable income, see Section 4059.
(3) K (amount of both parents' income allocated for child support)
equals one plus H% (if H% is less than or equal to 50 percent) or
two minus H% (if H% is greater than 50 percent) times the following
fraction:

California Child Support Questions?

First off I was ordered to pay child support of $188 every 2 weeks, That has been being taken out of my paychecks, That was understandable (the first check that was all that was deducted from my net pay.) Then on my second check (2 weeks later) They took out $188, Plus now they take out an extra $18 for dental and $77 for medical benifits. My job has insurance, at that rate. A total of $284 each check now. I make $10 /hr. work 35-40 hours a week and after taxes that will leave me with $800 a month. My rent is $600, Bills $150 and i owe $8,000 on a credit card with a minimun payment of $230 a month. My car ins. Is $50 a month, Thats a Total of $1030 of bills I am required to pay. Im -230 a month to pay my bills, and thats if i dont eat or spend any money on gas or anything else.

Well my other question, If im paying $200 a month on medical insurance for the child, I pay that on top of the ordered child support payments?

Arizona would be the legal jurisdiction, if she (or her current husband) or you decide to prove paternity, otherwise, the legal assumption is that the husband is the legal father (there are a number of scenarios here in which you could be found legally responsible if you are the biological father as determined by a DNA test). Jurisdiction is based upon the UCCJEA - the Uniform Child Custody Jurisdiction And Enforcement Act. The UCCJEA vests "exclusive [and] continuing jurisdiction" for child custody litigation in the courts of the child's "home state," which is defined as the state where the child has lived with a parent for six consecutive months prior to the commencement of the proceeding (or since birth for children younger than six months).

Also, being unemployed will not excuse you from a child support obligation if you are proven to be the child's father. Most states use the concept of "imputed" income or the income which you are capable of earning if you were employed - especially if you are voluntarily unemployed or underemployed. So, your imputed income could be based upon your job history or record of earnings (prior tax returns, etc).

Like every state, Arizona's Child Support Guidelines are available online (link below). If you think there is a serious possibility this child could be yours and you want to understand your rights, you should talk with an Arizona family law attorney and find out the process for proving paternity (or if you want to wait and allow her or the husband to initiate the action). And take it from someone who sees this frequently in our law firm - wrap it up next time and avoid this potential mess in the future.

Child support in California... how much will I pay a month?

I guess you are going to have to quit college and get a job then as your children's right to be properly supported by you trumps your desire to go to school. And that is how the courts will rule if your income isn't sufficient to cover the state's minimum child support levels. At a minimum, I think you would need to pay at least $800 per month and you could be expected to provide health insurance and pay for a portion of the daycare costs too.

Sorry but if you wanted to go to college, you probably shouldn't have had unprotected sex until you were in a position to support any children you make. Good luck and God bless!

Regarding child support and welfare in California?

In January of 2012, my husband received documents from the L.A. Superior Court giving him a date to show up to court because of a past gf of him ordering him to pay child support. (Dramatic I know, we were both in shock...) Anyway, I accompanied him to the court of course. Since he was in a car accident 2 years ago, he broke his arm and has not been able to work since then. He has had major surgeries; his arm no longer functions correctly. So the judge did not order any child support since then. I am assuming that they will meet again around the same time they did this year, next year, and check if there has been any progress in his life (new job, income, etc.) My question is, since we have a daughter ourselves, and since he is still disabled, will my husband have to pay A LOT of child support for that woman's child when I have a child with him as well? Also, we found out that she receives welfare and people have told us that he will have to pay for all of the money she has received as well... even though we have seen her many times withdraw money and waste it with her current boyfriend (no child seen at that moment)... which I believe is absurd!

How is child support determined in California family court?

Its calculated the same for married people or unmarried people in California. It is a formula which uses percentage of parenting time, after-tax income, and some other factors which affect net income. You can use the official state calculator, but I don’t find it to be that user-friendly. Attorneys in California use either Xspouse or Dissomaster to calculate support. I believe you can use one of these programs on a per-use basis (as opposed to buying it). Work related daycare expenses (reasonable) are a mandatory add-on to child support and are included in the calculation.

Either percentage or amount. Please include number of childern it is on and number of mothers it is being paid to. I pay 1,854.00 per month for 2 kids with 2 different mothers.That is 22, 248 a year. I make 36,000 a year before taxes. I also have custody of one other child that I recieve no child support for. Is the amount you pay fair? I say mine isnt. but pay without gripping just trying to find someone worse of then I am.
