Green card expired, what to do now?

Okay well i'm am asking all these questions on behalf of my dad. he doesnt speak english well so im helping him with the process to renew his green card. i'm not sure what to do and how the process works. i've been on the main USCIS website for the rules but im still a little confused. here are all the questions i have

-my dad's 10 year permanent residence card expired 7 months ago. we forgot to apply for a renewal so can he get in trouble for this? does it affect his employment at where he works now?

- what is the process to renew his green card? I know we have to fill out a I-90 form but I dont know know if we have to do anything else after that

- what paperwork do we need to submit? if my dad got divorced back in 2004, does that change anything?

-how long will it take for the whole process to take place? im worried because since we're already late in renewing his green card, the longer the process takes, the worse it is

-what reasons can a green card renewal be denied? my dad hasnt commited any crime. but he was in a minor car accident and he has a history of paying bills late. can that cause his renewal to be denied?

- do they have to do a interview at the USCIS office? i heard that they do but im hoping there wont be one because my dad cant speak english well so i would have to come to translate.

I just basically need all the info I can get and the steps to renew the green card and any other useful advice you can give, thank you!

How long does it take to get the green card after winning the dv lottery?

A person whose entry is drawn in the Diversity Visa lottery is required to apply for and obtain an immigrant visa during the US government fiscal year (which runs from October to the following September) for which that lottery was held, which is always the year after the year in which entries were accepted. Thus, if one enters the lottery in October or November of 2017 and has one’s entry drawn as a winner in the May 2018 drawing, that person can attend a consular interview to obtain that visa as soon as October 1, 2018, but no later than September 30, 2019.DV visa processing is fairly quick. Winning entrants will be notified starting in May, giving them five months lead time to get their applications in order and apply for visa interviews. The visa, if approved, will generally be awarded either the day of the interview or a few days thereafter, depending on the workload of the consulate.Note also that State actually picks about two and a half times as many winners as there are available visas, since in State’s experience only about 40% of winners actually apply for and receive immigrant visas. It is in your interest to apply early, since if you wait until later in the year there is a chance that there will not be a visa number available for you because all of them have been used up before your application is processed.

What is the standard cost of an arranged marriage for green card purposes?

Common is $10,000 to $20,000 up front and then $1,000 per month until the thing is done. However, with the law changes of 1997, the immigrant will only receive a "conditional" Green Card valid for 2 years. Before that card is expired, both will have to file for removal of conditions (ROC) via form I-751 which is not as easy as you may think. They'll have to show intermingling of life and finances, including jointly filed income tax returns, joint car title(s), insurances, bank accounts, photos of family gatherings and joint vacations . . . you get the picture. That's a lot to fake, and there's always a chance when one fraudster marries another fraudster just for money, that one fraudster takes advantage of being able to empty the other fraudster's bank account or use their credit card, which also needs to be joint. In short, this requirement has really taken a lot of "marriages for a Green Card" out of the equation. So we're talking $34K to $44K in cost for the foreigner, and the chance that the dead broke US spouse is cleaning them out financially or renegotiates the deal shortly before the Removal of Conditions time is up. Not a smart move anymore. Really.

I am a permanent US resident, but my Green Card expired 30 years ago and I've never renewed it. Can my renewal application be rejected for this?

As long as you’ve stayed in possession of the card, you’re probably OK: the law requires that an alien retain in their possession any “alien registration document” issued to them by immigration officials, which you’ve done if you hung onto your green card. The fact that it’s expired means it’s no longer valid for identification or for entry, but it’s still the most recent “alien registration document” issued to you.I’d definitely suggest that you use a lawyer for the process for renewing the card. It’s unfortunate that you didn’t renew it six months ago, before the Giant Cheeto took over the government; it’s hard to predict how the present administration will decide to deal with people whose behavior is even slightly irregular in areas such as this one. Sadly, one of the major impacts of the new administration is to sow a great deal of uncertainty for resident aliens in the US.

Can you apply for U.S. Citizenship with an expired Green Card?

You haven't said exactly when your card expires or when you're going to apply for naturalization, so see Question 24 on page 17 of the Naturalization Guide, the last sentence:

24. Do I need to get a new Permanent Resident Card (formerly known as an Alien Registration Card) when USCIS issues a new version of the card if I am applying for naturalization?

If you apply for naturalization six months or more before the expiration date on your Permanent Resident Card, you do not have to apply for a new card. However, you may apply for a renewal Permanent Resident Card if you wish by using the Form I-90 (available from the USCIS Forms Line or the USCIS internet site) and paying the appropriate fee.

If you apply for naturalization within six months of the expiration date on your Permanent Resident Card, or don’t apply for naturalization until your card has already expired, you must renew your card.

How can I apply for the Green Card Lottery DV 2020? What do I need to get started?

When the lottery is open you will (if eligible) be able to apply from the Department of State website atElectronic Diversity Visa LotteryLast year the lottery opened in October and closed in November. You will need a passport photo to apply. There are scam websites which charge a fee - however the lottery application through the US Dept of State government site is free - although after winning an applicant would have to pay the usual Consular or USCIS visa processing fee.Note that citizens from many countries (those which had more than 50,000 immigrants to the US last year, ) are NOT eligible - these will usually include Bangladesh, Brazil, Canada, China, Colombia, Dominican Republic, El Salvador, Haiti, India, Mexico, Nigeria, Philippines, UK and Vietnam - although if an applicant from one of those countries has a wife or husband who is a citizen of an eligible country then they will be able to apply using the country of their spouse’s citizenship, instead of the country of their own.

How do expired passports affect U.S. green card holders?

Except for travel by personal boat, personal car, or on foot to Canada and Mexico, you won't be able to leave the USA. When you arrive at the USA at a land port, your green card will be accepted by the border control officer though be prepared to escalate to his supervisor and come prepared with a print out from the CBP web site that says you don't need a passport. At a sea port, the border control officer will illegally insist on a passport. If you find yourself outside the USA with no passport, and want to or need to fly to get back to the USA, technically the airline should be willing to board you to travel to the USA using just your green card. In practice, most airlines are ignorant of the law. In fact, my anecdotal experience is at least 25 percent of USA border control officers in preclearance airports in Canada and other countries with preclearance are ignorant of this law. As for airlines, one time in Edmonton, I talked my way through airline check in with just my green card.one time in Bangalore, I presented just my green card for a journey that connected through Frankfurt. The airline check in employee didn’t ask for my passport and just slid my green card through the reader. This employee was trained. When you decide to become a USA citizen you will be required to present an unexpired passport at your interview. Presumably, there is a process for green card holders who want to naturalize but are unable to get a passport, but I cannot imagine this is a simple process.

How do I win the U.S. green card lottery (DV)? What do I need to know?

The only way to win the green card lottery is to register a complete and accurate entry during the annual entry window (which runs each year from early October to early November, although the exact dates vary from year to year), and then get lucky. It is a wholly random draw and there is nothing you can do to make your entry more likely to be selected. There are, of course, many things you can do that will prevent you from winning. These include registering for the lottery more than once in the same year, and making any false statements in your registration (including things such as failing to include a spouse or any children, misrepresenting your nation of birth, or misrepresenting whether you meet the basic qualifications). And, obviously, if you enter the lottery but you are not born in (or otherwise chargeable to) an eligible country, you will not be selected. You can only enter the Diversity Lottery during the annual window in the fall, typically about one month starting on or about October 1. It is literally impossible to make an entry at any other time not during the annual window. Anyone who offers to submit an entry for you at some other time is likely scamming you, as is anybody who offers to enter you into the lottery for a fee or who offers to “improve your chances” in exchange for a fee. Entering the lottery is free; anyone who charges you a fee is doing so only for their own benefit.

Marriage Green Card Interview Questions and Documents?

You don't need a lawyer unless you have a complicated case in my opinion. Just try to fill out all the forms as best you can. Write down all the questions that you couldn't answer on a separate sheet of paper and then call the USCIS free hotline and asks them what you need to do for each one. They will also help you figure out exactly which forms you need to fill out. My wife and I ended up calling them like 3 times and they were always able to answer each question without any problems. My wife got her Green Card 6 months after filing without a lawyer, so the USCIS hotline people obviously knew what they were talking about. I don't think its necessary to spend $1500-2000 for an immigration lawyer when you've got a free hotline that can answer all of your questions accurately (unless you guys can afford it and want to go that route).

Documents we provided:
Marriage Certificate
My (US Citizen) Birth Certificate (make sure it is a certified copy)
Joint Bank Account Statement
Joint Tax Return
Latest water bill with both our names on it
Wife's Canadian Passport and Birth Certificate
(try to bring more documents like a mortgage/lease with both your names, car payments/car insurance that has both your names, additional utilities bills with both your names, etc).

During the interview we were really only asked about how we met each other, how long we were together before we got engaged/married, how big our wedding was (number of people that attended, etc), and then she asked a little bit about where each of us came from (city we were born in, where we grew up, etc). The lady then looked over the documents that we provided (we didn't bring any wedding photos). Our interview lasted about 15 minutes total before she sent us on our way. If they need any additional documents from you, they give you 3 months from the time of the interview to gather it and then you just mail it in (no need to go back for a second interview). I actually didn't have a certified copy of my Birth Certificate or our Tax Return, so we had to send them in afterwards.
