How Old Do Yoh Have To Be New York Attorney General

You are staff counsel in the Office of the Attorney General of New York. NY has just enacted(passed, to make?

You are staff counsel in the Office of the Attorney General of New York. NY has just enacted(passed, to make into law) a new law that requires all Internet Service Providers serving NY customers to block any access by its NY customers to websites, or other communications over the internet, that sell gambling services or “games of chance” (other than those expressly licensed by New York State’s Bureau of Online Gambling), whether or not such gambling services or games of chance involve the exchange of money. The ACLU and the American Gaming Association have sued to enjoin enforcement of the new law.

Write a memo to the AG regarding the merits or demerits of the law.

THE ATTORNEY GENERAL IN NY ANDREW CUOMO IS CORRUPT?

I like Cuomo, but what you're describing is just terrible. Why not contact your local newspaper and local tv stations yourself? One of them might take up your story. I don't think you should focus on Cuomo, because you don't have evidence. But, you can ask the newspaper or tv station why this case is being pursued with such meanness. Also, if your ex and others are willing to say on the record that they're being followed or bribed, it would only make the case more interesting. Frankly, given what you describe, it sounds like either you're leaving out some key parts of the story or you have a very poor lawyer. If you're telling the truth, I think you might try to find a better lawyer. It's not easy to find a good lawyer, but if you do some searches of for legal news in your area, you might see one or two names that stand out. If you decide to go to the media yourself, keep the story simple. I'd put it something like this: "I sold Cuomo's Asst. Deputy a dog, and the dog sadly died 5 months later. Now he's trying to get $1.5 million from me, and has even hired an investigator. I even have a witness who will tell you that the investigator tried to bribe my exhusband to testify against me." I think that's enough info for a newspaper or tv station to decide if it's a good story. Also, if you have photos of your dogs, including the one that died, bring them. The media loves pictures. Good luck.

What are the implications of the New York Attorney General's Office announcing that the Trump Foundation has to dissolve, under court order?

The Foundation Agreed to dissolve, it’s part of a settlement that was then approved by a judge. It means that Trump no longer has a slush fund and he has no way of being able to give donors a way to get around the campaign donation limits, but it had stopped taking money when the state froze them.It may or may not stop the criminal investigation into the Foundation and how it was used. The settlement itself hasn’t been made public yet from what I can see. That may be in there, we’ll have to wait and see.

Can the NY State Attorney General go after Trump for other tax evasions once his finances are better known?

Absolutely - Trump’s business dealings have been blatantly fraudulent for years, and there is a reason he is being audited by the feds. So, when the IRS and Mueller finish with Trump he won’t have two nickels to rub together and he will likely be prosecuted for dozens of Federal, state and NYC crimes including income tax evasion at all three levels.Trump is definitely close to #1 on the list of the most corrupt human beings in the world and it will come out.

Can President Trump order the Attorney General to shut down the Southern District of New York's investigation?

Theoretically, he can. But it would be unwise. When Nixon tried something similar, his AG and deputy AG resigned rather than shut down the investigation (the ‘saturday night massacre’) and it blew up into a huge scandal that ultimately led to the appointment of a special prosecutor and Nixon’s resignation before he could be impeached. It is conceivable that shutting the investigation down could constitute obstructon of justice. Which would be grounds for impeachment and removal. Whether a sitting president can be prosecuted by the federal government for crimes committed while acting as president is an unanswered question in the courts. It would be best if we never had the occasion to answer that question.Equally, it is not clear whether shutting the investigation down would constitute obstruction under NY State law. And no court has ever addressed whether a state can prosecute a sitting president for crimes committed while in office. Again, this is not a question we want to have the opportunity to answer.

Who should I vote for in NY attorney general primary: Zephyr Teachout or Tish James?

Zephyr Teachout has an extensive career in fighting corruption (she even wrote a book on it called Corruption in America), and is the only progressive candidate not taking corporate/LLC money. If elected she will be independent of both Cuomo (and other Albany figures at that) and corporate interests! Zephyr’s first run for office was the 2014 Democratic primary for Governor, where she challenged Governor Cuomo and criticized his termination of the Moreland (Anti-Corruption) Commission. She certainly didn’t make many friends (especially in Albany) by challenging Cuomo, but she showed an entire state that she isn’t afraid of standing up to those in power even if it’s in her own party! Over the past few years we’ve seen members of both parties go to jail for corruption and/or resign in disgrace (which is the reason we’re having a primary in the first place) in our state. It goes on in both parties, and one is no more righteous than the other. That’s why having an independent Attorney General in Albany is so important. Zephyr will also be a fierce advocate against any corruption in the Trump administration. If you follow the headlines since she’s entered the race you’ll see that a lot of the actions Gov. Cuomo and Attorney General Underwood have taken against the Trump administration were inspired by Zephyr’s platform and statements she’s made on the campaign trail. This proves that Zephyr is the best candidate to fight corruption on the state AND federal level. While Tish James does have an admirable record, I think she has turned her back on where she came from politically. Remember, she wasn’t first elected as a Democrat (which is fine) but as a member of the Working Families Party. Now that she’s running for Attorney General she didn’t even seek the WFP’s nomination for Attorney General despite New York’s ballot fusion laws. The New York Times reported that she chose not to seek the WFP’s nomination at Gov. Cuomo’s discretion. This deeply concerns me as this state greatly needs our top law enforcement official to be independent, even of the Governor.Nonetheless, there’s only one candidate running for Attorney General Whom I trust to be independent and a fighter of corruption wherever they see it and that’s Zephyr Teachout!

Who has more power, Attorney General or Chief Justice?

It depends on what you mean by power.

The justices of the United States Supreme Court are Constitutional officers with life time appointments (I believe it is Article III of the Constitution). The justices are the ultimate arbitors of what does and does not violate the Constitution. However, the Chief Justice is just one of those votes. As Chief Justice he gets to dictate some procedural issue, etc. But his vote does not count more than any of the other eight justices (You could make Scalia Chief Justice on a high court with eight young liberals and the Pro-Choice movement could shut its doors confidant that a woman's right to an abortion is ironclad).

The Supreme Court is further limited in that it can only rule on issues brought before it. (If Roe never sued Wade, then the Supreme Court could never have touched the issue of abortion). Not much of a limitation admittedly, since if it is an important issue there will be a lawsuit.

The Attorney General on the other hand is a Cabinent Officer appointed by the President and approved by the Senate. He can also be fired by the President. He does not make the laws of the United States, but he does enforce them. However, as a member of the Cabinet and the Chief Law Enforcement officer the Attorney General has a great deal of political power. The current Gonzalez mess is a good example.

In the view of congressional Democrats the attorneys fired by the Justice Department lost their jobs because they refused to pursue cases against certain liberal politicians. Assuming that is true you can see the political power of the AG rests with deciding who to prosecute.

An example would be the power distribution between a Traffic Cop and the Traffic Court Judge. The Traffic Cop has the power to decide whether or not to give you a ticket. If he does give you a ticket, then the power rests in the hands of the Traffic Court Judge to determine if you will pay the fine.

Can Trump fire the NY Attorney General that Robert Mueller has now teamed up with?

Perhaps a better question would be ‘Do you think Trump thinks he can, or should be able to fire the NY Attorney General?’Or ‘If Trump could do you think he would fire the NY Attorney General.’Or you could ask the question that should have been answered before the question ‘Can Trump fire the NY Attorney General that Robert Mueller has now teamed up with?’ was asked. And that is ‘Is there anything wrong or inappropriate about the NY Attorney General teaming up with Robert Mueller, regarding the possibility the Trumps campaign colluded with Russia.’
