I have a child support civil case with the Attorney General in Texas. The father of my child is avoiding being served. He has lived in 3 residences in the past year and the constable can’t track him down. I have his current address and gave the attorney general his new address. I tried calling the court and searching civil cases online. I feel so helpless. I don’t understand why they can’t locate him. I have been served and I was told to attend the court date even if he isn’t served. What will happen if he doesn’t get served by our court date? Are you sure she has to serve him papers only as way to notify him of the court action? A relative of mine had the same problem and she was able to run a legal notice in the newspaper of his last known address for a certain amount of time. At the end of the required time he and no one else notified the court they contested the action so divorce was granted with all the terms she requested.

Go to you local library and see if they have subscription websites to look people up. Ancestry has a U.S. Public Records Database as well as some state indexes of birth, marriage and death.

In this case, the court may give you permission to serve the summons by either:

putting an advert in a newspaper, or
displaying a notice in the court building.
If you're advertising in a newspaper, you'll have to pay for the advert yourself. You'll also have to hand a copy of the newspaper to the court and formally lodge it as evidence.

If you're displaying a notice in the court building, you'll have to fill in a form 9 notice. You can get this from the sheriff clerk's office too.

It would be best to call the courthouse (you can find the jury room number on the summons or online at the court's website), and tell them that you're moving permanently to Europe in two weeks. You will be dismissed.

You don't say when your date of jury service is, but if it's before you're scheduled, you'll have to tell the judge -- that is, if you're actually called in.

You will be dismissed if the case interferes with your flight time.

As for the future, you can tell the clerk that you're moving permanently to Europe, and perhaps they'll try to take you out of the contact list... although those are usually based on tax rolls, voter rolls and DMV records.

I wouldn't sweat it. It shouldn't be too hard to deal with it.
