Question regarding condo lease - what can be done about this mess?

YOU may have two different cases here;
the one below and --a "meeting of the minds."
I was not there. It seems as though what you expected and
what you got are not close to the same. Maybe you
are 'pickier" than the LL expected.
-read the following and then, at the bottom i have
2 additional options for you

Maintenance Issues with the landlord
a; Needs must be put into writing to make
them “official.”
B; the Landlord needs to be given 30 days
unless they are emergency needs like water
or ac/or heat or roof falling in/window/door out.
C; if the LL does not perform the repairs-
after 30 days, [non emergency ones]
call 3 licensed contractors who perform this
type of work. Hire one of them. Make sure
you are happy with their work. Pay them
when they are finished and get a receipt
which shows what they did.
D; when rent is next due, pay it MINUS
the amount paid for repairs].
E; send a copy of the paid invoice.
F; if the landlord complains about non payment
of rent [or insufficient rent], and sues you,
go to court and show the judge your paid
receipts. If you win [in 99% of all cases, the
tenant wins these cases], you get your filing
fees back and 3x what you pay in rent
for DAMAGES in a RETALIATION eviction.
G; IF this is not a regular repair, but one that
makes the unit uninhabitable–that is
called a “constructive eviction” and it permits
the tenant to call the landlord and inform him
that you are leaving, having been thusly
evicted by the condition of the unit.

HE must return unearned rent [the rent
for that day and all the rest of the month]
to you no later than 15 days.

if there is no agreement upon what you 'signed up for'
you can sue for breach of contract. Very hard to prove but
it is there.

lastly, you can seek quietly, a replacement tenant where by
you become the landlord for that person till your lease
expires--it is called a "sandwich tenancy" because that
person is sandwiched inbetween you and the landlord.

My apartment roof is leaking, can I just break my lease?

I think you may be able to charge the landlord for any damage to your property assuming you didn't cause the leak yourself. The landlord should be able to turn it into his insurance but I may be wrong and it may only be covered if you have renters insurance? Hard to say since the structure is covered by the landlords insurance I would think the damage to your stuff would be covered. I also think you may be able to get out of the lease if you document well and can prove most of this. I would talk to the landlord as because of the circumstances he may be willing to work out a deal with you. Water stains alone are unlikely to get you out of a lease but they are evidence of leaks. The way you might be able to get out of the lease is because of the two major leaks on seperate dates assuming there was some significant time inbetween. The landlord would likely be responsible for your hotel stay...but if the landlord can find evidence of sabotage then you are on the hook for ALL OF THE ABOVE.

I'd say you have a 30% chance of getting out of your lease if you leave and go to court. You probably have a better chance of talking to the landlord and saying your unhappy with your property being damaged and your inconvenience but would just put it all behind you if the landlord agreed IN WRITING to allow you to give 30 days notice and your deposit back or something along those lines. It's probably easier to get repairs done without a tenant inside as well. But it's michigan and the economy is bad so who knows...

AC in apartment not cooling?

I live on the 3rd floor of an apartment complex with tenants occupying the 2nd & 1st units below me. My patio faces the sun, so I get the full brunt of the sun during the hottest parts of the day. My blinds stay closed and I even have blackouts. Currently, here in Texas it's averaging about 90 degrees in May - so it's only going to get worse. My thermostat is currently set to 67 but it never reaches that temperature before it freezes. I sweat, even with fans, until it thaws out. I have it set that low because I literally sweat sitting in my apartment otherwise, plus heat rises. Because it never reaches the set temperature of 67, the unit constantly runs increasing electric costs. Friends and family have commented on how hot it is inside my apartment. I use a 90 day filter but change it every month anyway. One time the thermostat read 80 degrees inside the unit and when they sent maintenance out it was a bad capacitor. The time before that, there was no freon in the unit. I've been in this unit for 8 years and have had AC issues every year except the first two. I placed a work order Friday, guy came at 11am and said nothing was wrong with the unit. I get home from work at 6pm that same evening and the thermostat is reading 78 (95 degrees outside). I can forget about using my oven when it's like this. Are my expectations too high with the temps being as hot as they are outside? Or should I continue to lodge complaints with my complex?

I'm in Petaluma, CA, (http://maps.google.com/?q=Petalu...)and it felt like rocking waves here.  I'm a light sleeper, so it woke me up right away, but I had to call my husband's name to get him to get up.  It lasted a good 30-45 seconds.  The house creaked a little, and the hanging lamps in the bathroom bonked together a bit.  My sister in law lives in Vallejo, much closer to the epicenter, and she says it was very short and felt like a violent jolt there.  It's interesting how distance and the composition of the ground changes the way things shake. I've lived in the Bay Area all of my life.  Earthquakes always feel a little bit creepy to me.Nothing broke or fell.  The cat's water bowl sloshed into her food dish, causing unbelievable feline outrage, but that's about it.
