I Have A Question About Unemployment And Getting Fired For Filing A Claim

How do I answer my Unemployment claims questionnaire?

I was let go two days ago because my boss just didnt feel like i was a good fit. He said that i did all the right things but that they will go a different direction. So since ive been there for a little over 6 months i am now filling out a claim. My question is that when i chose the discharge/let go option in the form it is now asking me to fill out a questionnaire as to why i was fired. I wasnt technically fired. I didnt do anything wrong other than they felt my performance wasnt up to par. I had only missed one day of work also. So why do I have to fill out this questionnaire? Has my employer already contacted unemployment and said i was fired? Also should I choose the laid off option or stick with the discharge/let go. I know in NY that these are the only two options that you can collect with. Being fired would not give me any benefits. Please answer asap....i need this filled out yesterday

Refuse fingerprint scan, can I claim unemployment?

I guess maybe I'm a bit paranoid, but I don't like "big brother" having my records on file for eternity. I consider it a matter of personal privacy. They have done a background check, they have copies of my drivers license / social security card, and now they want to store my fingerprints in their database. I don't want to be pricked, I don't want my DNA stored somewhere, and the same goes with my fingerprints. Just seems like an invasion of my privacy. Might be "stupid" but sometimes there are things that people want to make a stand on.

If I have two jobs and get fired from one, can I file for unemployment?

depends on two things, why you were fired and how much $$ you make. if you make more from either job that pays more than you would collect on unemployment then you can't collect. let's say your unemployment benefit would be $400 a week and you make $450 then you can't collect, but let's say you make $350 a week then you could collect the $50 difference. i know because this same thing happened to me and i collected and it's perfectly legal. if you were fired for something serious, theft, drugs or something like that you can't collect.

yes!! if you are laid-off, fired, you are unemployed!!! if you have worked over 6 months in the last year you can get unemployment for 6 months!! the only time you CAN'T get it is if you QUIT any job!! because you will be turning down a chance to work!!

as others have answered you MOST likely will not be eligible BUT if you are fired and it is only the overtime that is an issue there is a slim, VERY slim, chance for you to be eligible.........
if your school schedule interferes with a normal 40 hour week then you definitely won't be eligible.
you can and should file if you are terminated and the state will determine if you are eligible based on ALL the relevant facts in your case.

and yes you do happen to work in a "right-to-work" state but that is irrelevant.......
right-to-work has to do with union representation and NOT being a member of a union and still having the right to work........
Georgia does follow the "at-will" employment doctrine which is relevant to this issue.

Like most things. It depends. In the US if you resigned because you had good reasons it is possible to resign and claim unemployment.  Example your employer switches your hours to another shift and you cannot get childcare (or is cost prohibitive).  You may be able to claim unemployment however you will likely be asked to prove the situation. If you believe you were forced out or needed to leave your job for medical or other reasons you should seek legal assistance to see if you should file/likelihood of success.  But the quick answer is if you don't like your job and quit you are not likely going to be able to claim unemployment.

Of course you can file, but your employer can fight the claim if they feel your termination was a result of misconduct. If they (your employer) fight your claim for umemployment, you can request a hearing which requires them to cite their charges (or suspicions).

If you think you can beat it (i.e. they have little evidence or you were falsely accused), make sure your request that hearing. Don't stop when he get those "denial" papers.

The hearing is usually pretty informal. I'm not sure a judge even presides, usually it's a few members of the unemployment board.

The hearing is usually scheudled two to three weeks after the DENIAL comes through. In the meantime, work with the unemployment office and continue lookling for work. Gather ALL the evidence you can that supports your case.

You can't walk in their spouting off about how you feel screwed. Your employer has a paper trail, you need to have one, too. If there' a co-worker who helps your case, ask them to appear. If they can't, have them write down their testimony and make sure it's notarized (any bank will notarize their affidavit.... they'll need to show ID and it might cost $5.00).

Your employer will use any data they can to deny your claim.... anticipate their complaints so you aren't taken off-guard at the hearing.

Good Luck. Dont let the man get you down. Many employers deny unemployment claims simply because they doubt you'll follow through and request a hearing.

If you're guilty, look for another job. If you're innocent, follow the advice above.
