I Have An Unemployment Hearing Coming Up And Am Very Nervous About It. I Was Fired Do To Excessive

What are the consequences of losing an Unemployment Hearing?

I am going to be having an unemployment phone hearing regarding whether or not my employer fired me under just cause or not. It is only a week or so away and I need to prepare for this case. I would like to know what are some of the consequences of losing this case. Will I have to pay back the money that I have withdrawn from my unemployment insurance? Is there possible jail time? what is really at stake here? if I do have to pay it back, would they garnish my wages, repossess my assets, or let me pay in installments? anyone with experience with this, that could answer seriously would help.

What Do I Need to Prepare for My Unemployment Hearing?

I had my unemployment claim disputed by my previous employer. I am just not sure what the judge is going to expect from me. I am going to have at least one reference from a former supervisor at the company. I am not sure if there is anything else I should try to prepare or bring for the hearing. By the way this is a phone appeal hearing in Arizona, a "right to work state".

Can i get unemployment if i was fired for attendance in Indiana?

I have three children with genetic disorders that need home care off and on.. There is nothing that determines when or where these issues occur. Many times I have to take them to the Dr. but most of the time I am home with any one of them dealing with their Ehlers-Danlos Syndrome. I filed FMLA last March and this past year has been horrible for them.. I've missed MAJOR amounts of work to where I am over my FMLA time. I've taken what they call "Occurrences" which are points against attendance and this last week I went over both of them totally. I am afraid that when I return to work Monday I will have been "Boxed". I have sat with HR and talked with them about the FMLA time left and signed a note stating I know I was at the end of that time.. But what else can you do when you have little ones that need you.
So...due to the many occasions especially this last week me being absent to stay home with my youngest and not needing a Doctor's care (Waste of money) I did what I always have and took care of him.. So I worry that not having Doctor's PROOF for this incident will hinder my case, should I need one. What are my chances of getting Unemployment? I have all of the paperwork from Doctor's and still my FMLA copies where everything is explained to my employers..and I have spoken with them specifically about the issue.
My standings as an employee has been good I've only received a Written warning about Attendance (same issue) but all else is good. Good Quality work and I've been there nearly 5 years.
So.... What are my chances? Please help! I'm so stressed about this whole thing and I've not even told my husband. I wanted to wait until I knew more about what I was dealing with.
Thank you,
Scared Stiff

I need help with unemployment appeal?

I would be more than happy to assist you with you unemployment appeal. I have represented many individuals such as yourself across the US in the appeals process.

Most state's Unemployment Offices recognize my credentials to represent a claimant in their state. I would need to know what state you were employed in to determine whether my credentials are accepted in your state.

You should not be nervous, most employers do appeal Unemployment Insurance Benefits that are awarded to previous employees. The employers do not want to depleate the money they have paid into Unemployment, so they appeal as many cases as they can, if they feel they may have even the slimest chance of winning the appeal. However, the majority of the cases that I have handled the employee is awarded UI Benefits. I do not charge for these services only out-of-pocket expenses. I do not need to travel in order to represent you either during the appeal process, so that would not be an expense to you.

If you would like to discuss the matter further, please feel free to email me. You may email me even if you do not wish to be represented by me, just to get clarification on how the appeals process works and what to expect. In addition, you want to make sure you are prepared for the first appeal hearing so that your employer does not win the appeal in which turn you must appeal the decision and wait even longer to collect benefits that you are most likely qualified to collect if they were awarded to you in the first place.

I look forward to hearing from you.

Best wishes.

How can I successfully appeal my denied unemployment benefits?

I apologize that this is so long winded, but here goes...

I worked for a realtor as her assistant for nearly two years. In November, I was let go. My former boss said the reason was that she needed someone who could work full time immediately, and someone who had plans to make real estate their career. The reason I was not working full time was that I was in college (just graduated last weekend), but she hired me knowing I was in college, and also under the pretense that she did not need a full time assistant. In fact, I tried to increase my hours several times, but she never allowed me to work more than 25 hours per week.

I applied for unemployment the day after I was terminated. I was scheduled to have a fact-finding interview with the unemployment office so I could tell them exactly why I was let go. I told them exactly what my boss told me: she needed someone full time, but couldn't wait a month for me to graduate so that I'd be available full time, and she wanted someone who planned to make real estate their career. The unemployment agent put me on hold to verify this with my employer. When she got back on the phone with me she informed me that "he" said I was fired for "not doing my job." Turns out my former employer's husband was in the office and he was the one who picked up the phone and took it upon himself to outright lie about the situation. I even got the unemployment agent to call back and ask specifically for my boss. She did, and the husband answered again, claimed he could answer any questions regarding my employment, and that I was fired for not doing my job. Mind you, I never, ever worked for this man. His wife was my employer.

Long story short, I was denied benefits. I'm literally flat broke, and though I've been applying to jobs all over town, I've yet to get an interview. It seems to me I have a pretty solid case for appealing this decision, but I just don't know how to go about it. Has anyone ever been in this situation? Any advice would be much appreciated.

How can I fight an unemployment decision where my former employer lied?

I live in the state of California in the county of Riverside. I was laid off in November of 2009. I filed for unemployment and was granted unemployment benefits. Fast forward to May of 2010 and my former employer appealed my benefits. They lied and said I got fired when I was laid off. Now I'm upset because unemployment has sent me a notice of overpayment and they want me to pay back what I received in benefits! They said I with held information because I supposedly lied about being fired. How can I fight this? I have no way to prove I was laid off. I was laid off over the phone while I was at home with my husband. Any suggestions or help is appreciated. Thank you.
