I Have Been Dismissed From My Job After 15 Years For Gross Misconduct. I Had Gone Over My Break

Can someone get another job if they quit or got fired?

Absolutely. One of the things that people don't often talk about (or if there's a book or site, I haven't seen it) is the emotional toll of working. Getting fired can cause reactions similar to a breakup, a family fight, or other situations where you feel bad. I know that comparing a job to a family or romantic relationship seems silly, but I think that pretending that you have no feelings about a job (or people who you work with for 40+ hours per week) is silly. You feel bad about thinking that this company didn't work out. You feel sad that you made a bad choice. You might be feeling anxious that you have a black mark on your record. You feel confused and bewildered about what to say to prospective employers. So this question strikes me as an emotional one-you're panicked, or down, or any number of feelings. All of the answers here are right-logically you're going to find another job and work again, and you should take the next logical steps to get yourself more work. However, I think sometimes acknowledging the emotions, and labeling them as feelings can allow you to recognize them for what they are. It's not that feelings have no place in a job search, but you do want to separate how you're feeling from the reality of the situation. You will get another job, will it be work? Absolutely, but it's not impossible. I've seen some crazy job searching situations where people ended up getting jobs, despite circumstances that can be worse than being fired (including once, a guy who had a stream of passive income and didn't do anything for 10 years-he let all of his skills go lax). It's work (hence why there are so many questions, answers and guidance surrounding job searching on quora) but you'll get through this period.

Unemployment Question in regards to losing job over driver license?

Contrary to what another person said, it's not true that you can't get unemployment insurance for being fired. In fact, it increases your chances for eligibility.
If you quit your job, you are not eligible unless you were forced to quit due to a hostile workplace environment, such as harassment, etc.
If you are laid off, you automatically qualify.
If you are fired, you are eligible unless you were fired for gross negligence or willful misconduct.
That last part might be what gives you a problem. I presume that your license was suspended due to moving violations, infractions, or a driving related conviction. Violations of the law are generally regarded as willful misconduct.
However, you did not commit the willful misconduct at work. In other words, you didn't break the law at work and get fired for it. You broke the law outside of work, lost your license, and then got fired for it. This puts you smack dab in th middle of a gray area. If you apply for unemployment you will probably be provisionally approved. If the employer disputes it, however, you will likely have your final claim denied. It doesn't cost anything to apply, however, so give it a shot. You have nothing to lose.

I got banned from working at Walmart a few years ago. Can I still fight it?

Here's what happened. back in I believe 2010 or 2011 I worked at a Wal-mart. I got fired when another employee told a supervisor I was in the break room for 40 minutes (which I was not!). They had no proof other than this persons word on the matter. Upon termination they told me I could fight it with our district manager, which I did. He decided to believe the supervisor and kept my termination and told me that I would be eligible for re-hire in 3 months. I decided that if a supervisor didn't like me I wasn't going to reapply (if ever) to that Wal-mart, so I didn't. A year later I moved to a different area that was in the process of a mass hiring for the super center they were building and went to apply, and they said I wasn't allowed and to contact my old district manager to find out why. When I did He proceeded to tell me that my type of termination was changed (without telling me) and that I was permanently banned from ever working at a Wal-mart, and that I should of fought my termination when it happened. Which I did!

Does anyone know if I could still get a hold of corporate and get it revoked so I can work at a Wal-mart again?

How long after someone is fired can they be rehired at the same place?

That depends on the company and the reason for being fired. Companies may have explicit policies for re-hiring terminated employees or it may be a subjective process. Either way there’s no guarantee that an employer will take an employee back after any amount of time has passed. If the reason for termination was due to downsizing or layoff then a former employee might have a decent chance of getting rehired when the company is in better financial shape. However, the timeline for that is unpredictable. In fact the company may never get back on its feet.If the employee was fired for performance reasons then I’d expect the employee would have to demonstrate how they’ve changed since being terminated. Was there some personal situation that has since been remedied? Has the employee received additional training or education? Have they demonstrated a strong record of employment at another company? A company is less likely to rehire a poor performer than someone they had to let go because of downsizing. Still, if the employee has demonstrated some form of progress they might take them back. How long it would take to get rehired would depend largely on how long it takes the employee to demonstrate a significant change in circumstances. If the termination occurred due to criminal activity, an ethical lapse or because of intentional actions that brought serious harm to the company then the most likely answer is “never.”

Will a termination show in my background check?

I was fired about 2 years ago from a job for "gross misconduct" - breaking a company policy. I fought the termination & filed for unemployment due to the wrongful termination and was approved (was not aware of the policy that I violated and felt I should have been written up prior to termination; unemployment agency agreed).

I'm looking for a job now and am worried about my background check. I recently had an interview at a company and was given a job offer pending the outcome of my background check and drug testing. I'm worried what will show on my background check.

Does anyone know if my termination shows up? They're both large corporations and I believe they both use Choicepoint for background checks. I was under the impression that the background check is criminal only, but now I'm not so sure.

I'm not worried about them calling my previous employer because I put down my previous supervisor's cellphone number who knows the story and would give me a good reference.

Apartment has tons of problems, what should I do?

The steps that needed to be taken ( and to be done with any rental ) are to note the problems that are considered health or safety hazards / issues, make a written list, then send a copy of the list - certified mail, signature required - to the landlord AND the building owner / or leasing company........all of this must be done in writing, as just speaking to someone does no good at all. Things like excessive tenants are not your concern. The issue with the bath window could have been solved with a cheap bath curtain and/or leave the window open after a shower w/o you being in there. The LL or owner may try to get you to pay for repairs, etc after you move - to prevent this, make a list of anything that even looks like it is in need of repair; then a day before you are completely moved, have the LL make a walk thru the unit - give him/her the list and have him/her note all needed items so that you two can come to an agreement before you move - this will save lots of headache and $$$
