I Have Gotten A Misdemeanor

Can I get a job with a misdemeanor?

I got a temporary job, but now they want me permanent, and now I have to do another application with a background check.... I have a misdemeanor its for something minor like shoplifting (which was Petty Theft). Someone please give me more information!

One misdemeanor dui and I can't get a job?

I kind of disagree with the other answers, my husband has a dui on his record he went to jail because of it. he hasn't been able to find work for two years, I'm not kidding. he tried everything, mcdonalds to janitorial, cashier work anything that would bring in a income. he worked at home for purple heart doing phone calls for people to donate clothes but that only paid at the most 12 dollars. not 12 an hour but 12 per paycheck. it is because of the way it is set up. he only got paid per picked up order. anyway he is still looking for work, right now he is taking the H&R income tax classes hopeing that they will hire him or help him to find work afterwards even if its only seasonal. the other answerer are wrong, employees are doing background checks on everyone now days since 9/11 attacks and they seem to be going back about ten years. they do credit and crimminal checks now. I feel like you do that my husband is not wanted working in society. but don't give up. just remember they also look at your work history, if you have a history of moveing from job to job or have large gaps between jobs then thats considered a poor work history and yeah my husband has a poor work history unfortunetly but not all due to his fault. if you choose to do work at home via the internet becareful some are scams and some actually are good. go tho GMC ( good morning america) website. they did and continue to do a special section on how to find stay at home jobs on the internet, they tell you which one is profittable and which to stay away from. I'm sorry so many people are critcizing you on this board instead of helping you like they are suppose to. remember too that thier has been a lot of lay offs especially in the state that I live in and since you started driving you can go further out side your area. once you have a job then start looking for a better job, they say it is easier to get a job once you have one, go to a job bank if you have one in your area or social services office in your area they help people get back to work also. and whatever you do don't give up, try not to get depressed because this can be very depressing especially if you have a family to support, keep the faith, and I will keep you in my prayers. god bless!

and to answer your question a restricted commercial i think some people call it a limit commercial, but its a commercial license without a instrument rating. im in aerial application but some other jobs for it are like pipeline patrol and flying skydivers and that kinda thing when your operating during day VFR conditions

Does a misdemeanor go away? How long does it take?

How long do you have to list it might be a better question. They don't go away. After a certain period of time they are simply not relevant. A misdemeanor a year ago is certainly more ‘serious' than that exact same misdemeanor ten years ago.How long does it need to keep being brought up? That depends on a particular job and its requirements and how the question is asked. But it's always there unless dismissed or expunged or pardoned if someone wants to dig that far and deep into the past.

Can I get a passport if I have a bench warrant for a misdemeanor?

in the past i would have said it did not matter at all, but now it depends on the alleged offense and if it was serious enough for that local authority to report it to the federal government. let’s say that it is for double parking and then you contested the ticket and failed to show up at court for that offense. that would not stop the process. however, if you do have a bench warrant and you get a passport it could very well be interpreted as flight to avoid prosecution, and that is a felony. i recommend you take care of the warrant first so when you do apply for that passport there is no reason at all to cause you to further build on that minor alleged offense. i cannot say with certainty that a passport would or would not be denied because of your current legal troubles, as a rule state, county, city or villages legal problems are not listed on a federal data-base. if and when you do take care of the bench warrant, do not take a plea. if you take a plea, you are most likely to be given probation. while on probation any thing you do that violates the terms is a felony. and they put you in jail/prison for those. so what started as a legal problem of several hundred us dollar, then becomes 5 years in lock-up and a felony record witch bars you from many things, like buying a firearm legally.

I got a class C misdemeanor in Texas and the theft was less than $10. I haven't been to court yet, can I get this expunged?

If you've never been arrested before, you can speak with the prosecutor on your court date and most likely get PTI. At the end of your PTI program, assuming you follow all the steps, it will be expunged. It costs a little bit of money, but in the long run it really isn't that expensive.

When does multiple misdemeanors make a felony? Does it have to do w/ ticket cost, severity of the crime, criminal record, etc?

Multiple misdemeanors do not necessarily make a felony. I say necessarily because I don't know every states statutes. Some statutes have first offense is a misdemeanor while subsequent offenses would be a felony. It takes multiple DWI before one starts being charged at the felony level but it isn't simply because one received 3 DWI that the third is a felony. You could have gotten all three in a three week time period and they'd all three still be misdemeanors. Most felony DWI statutes require prior convictions. So without prior convictions, in states requiring such, every DWI one receives would be charged as their first until they start pleading or being found guilty of them. Other cases, like stealing or passing bad checks require a certain financial amount before a misdemeanor becomes a felony. Stealing over 500 is a felony in some jurisdictions with stealing less than 500 is a misdemeanor. No matter how many times you've been arrested for stealing less than 500 it will be a misdemeanor until you steal something with a value greater than 500.00. In some jurisdictions 3 prior harassment charges, convictions, can result in felony stalking charge on one's fourth arrest. It's a different charge with different elements, such as three prior harassment convictions.

Can you become a police officer if you have a misdemeanor on your record?

Maybe. It depends on what the misdemeanor is, how recent it was, and the circumstances of the incident. If the offense is for domestic violence or some sex offense, you're done. Don't even try. If it's for a violent offense, such as assault and/or battery, you will need around ten years (this varies) of very clean living between the offense and your application. You will need to show that you realized your mistake and have the ability to conduct an honorable, law-abiding life. If the offense is a "moral turpitude" crime, such as shoplifting or embezzlement, you may be disqualified. This is a "maybe" situation, and while one agency might accept you, another one wouldn't. Once again, you'll need to show you can lead a law-abiding life for a good stretch of time. A DUI can be disqualifying for ten years or more. Complete abstinence from alcohol is recommended. An offense like minor in possession of alcohol won't be overlooked, but it's not as damaging as some of the others I mentioned. In every case, the agency doing your background investigation will do their best to get the original report of the offense, and to interview anyone connected with it. If there were any extenuating or aggravating circumstances about the matter, you want to be the one to tell your background investigator about it. If they find out on their own that the situation was more screwed up than you described it to be, you're probably going to get disqualified. Those stretches of clean living between your offense and your application need to be exemplary in every way. No arrests, no tickets, good work history, all bills paid, etc. If you have a conviction on your record, the bar is going to set higher for you.

I got a 12500 (a) VC unlicensed driver misdemeanor ticket in California, what should I do in court?

I was driving on freeway and I was speeding to 80mph (that's what the officer has recorded). I was stopped and I didn't have a valid CA license.

I am becoming a US citizen through an asylum case and the judge couldn't allow me to get a license until my case is resolved. I wasn't able to provide a valid license to the California Highway Patrol. I do however have an old expired Arizona license (which I didn't have with me while I was pulled over). The car is registered and insured in my brother's name.

I was given a ticket for speeding and have to go to court for the misdemeanor charge of unlicensed driver. My court date is 1 month from now. I just found out that I will soon become eligible to get my CA drivers license within like 2 months. So, if I can delay my court, I will have a valid CA driver license to present to the judge but the issue date will be after my ticket was given. I have noticed that the police officer didn't write the correct info on the ticket slip, like my date of birth, height, weight, age, are all incorrect.

I have never been pulled over by an officer. What do you recommend I should do? Do I need to hire an attorney? I don't want to have a misdemeanor on my records (I have a clean record). I did lie to the officer initially regarding my license and said I have one but left it at home, but then I said the truth as he couldn't get my record from computer. Any suggestions to resolve this case is appreciated.
