I Hit A Fence With No Insurance The Day After I Bought My Car

I got side swept by a car and now the other insurance won't pay!?

We were both going in the same direction side-by-side. I was on the left lane and he was on the right lane in a two lane road. The traffic was heavy at that time of the day. All of a sudden, he takes me by surprise when he moves over to my lane and side sweeps me on my passenger side, causing damages to my car. Only a small scratch to his. I tried to get the police to come but I guess we were not a priority because there was no injuries. So, no police report and no witnesses that considered to stop by to make my life easier. His story was that he was trying to avoid another car coming to his lane when he moved to mine, just like that. He basically pinned me to my side. Knowing he was at fault, the other driver even offered to pay for the damages which was way less than the real estimate which I got it later the next day. At first he didn't want his insurance being involved for the fear of it going up after the accident. So, he was willing to pay out of pocket for the damages but after hearing the estimate, he started to change and become shady. He even started to hint and change his story saying that I was now at fault and I should be paying for his damages instead. Long story short, that low-life ended up lying to his insurance and they found me at fault. So, I plan to file arbitrary through my insurance but I learned that it could take up to many many months. So, basically at this point its my words against his. The only person who knows the real truth is myself and the lying driver who caused the accident.I feel like I didn't have to go through this when I am innocent, and the other person is clearly trying to get away with it by lying and cheating. Has anyone been through similar situation? How long did it take before you got justice?

P.s-I am not getting it repaired right now because I have a high deductible. It's not fair that I have to drive around with the damaged look.

When do I buy car insurance?

I'm looking into buying a used car, straight out of pocket at full price from a dealership. After researching for some time, I couldn't find an exact answer for my question. I never have had auto insurance nor have I ever owned a car. I found out everything I need about how to go about purchasing it and what I need to look into. I tried getting quotes on insurance but they all so far have required facts about a purchased car. I even read that dealers require you to have insurance before taking the car home. My conclusion so far has been to buy insurance at the same time I purchase my vehicle- But then again, how exactly am I to get quotes before hand to know who I'm insuring myself under, and without spending extra hours at the dealership in mid sale?

Fun fact: I'm an adult, so no teen-driving answers please and thanks!

I hit a fence with my car will my insurance rates go up if I make a calim?

Maybe. If you hit the fence and not the deer the repairs would be covered under collision. Hitting a deer is covered under comprehensive. Comprehensive claims are not surcharge-able.
My Insurance company does not surcharge on a collision claim unless they pay out $1,000. or more on a single claim and even if they pay out more, they don't always assess a surcharge. If you pay out of pocket, will the repairs cost more than a surcharge? That is what you need to be asking. Surcharges are often very small anyway. People worry WAY too much about them.

The decision to use insurance or not should NEVER be made based on the fear of a rate increase. That would be just plain foolish

When you have insurance, you should use it. If you still need answers, talk to your agent.

What is the penalty for driving without insurance in California?

Caught in a random check. Drivers caught operating a vehicle without valid insurance will be fined anywhere from $100 to $200 for a first offense, and between $200 and $500 for a second offense. Additionally, your vehicle may be impounded and towed away, in which case you will not be able to get it back until you obtain insurance and pay all towing and storage fees. Get into an accident. In California, your license will be suspended, possibly for up to four years. Bear in mind that this can happen whether or not you are at fault for the accident. You may be able to get your license reinstated after one year if you obtain valid insurance, provide proof of it to the DMV and pay a reissuance fee. You will also be required to obtain an SR-22 Proof of Financial Responsibility certificate and carry an additional high-cost SR-22 insurance policy on top of your regular one. Your vehicle may be impounded and towed from the scene. If that happens, you will be required to pay towing and storage fees before your vehicle is returned to you. Civil costs for an accident without insurance. If you are the party at fault, then you are responsible for the cost of all resulting damage. And that means everything: damage to all vehicles involved; and all medical costs for injuries to yourself, the other driver and any third-parties. This includes damage to other public and private property such as street signs and lights, bus stop fixtures, store fronts, etc. California requires all drivers to carry uninsured motorist coverage. Uninsured motorist coverage means that if the other driver in your accident has it, his insurance company will compensate him for his losses even if the accident is your fault.Don't think that you are safe because of it. In fact, if you have assets, the other driver’s insurance company is likely to sue you to recover their costs. For e.g. suppose you get into an accident that is your fault resulting in tens of thousands of dollars in damage. If you have no vehicle insurance, but own a home with $100,000 in equity, the other party’s insurance company is likely to sue you to recover the thousands it paid out to their client. And you may lose your home.

Can I have my mom title my car in her name for cheaper insurance?

Do you realize that if you are in an at fault accident and injure people the damages could run into hundreds of thousands of dollars? and who would be held responsible?

That would be the registered owner. What does your mother get out of having that risk over her head?

No way to treat your mother so YOU can save some $$$.

If I witness another car hit somebody's fence, and then drive away, what should I do? Is this a hit and run? Is this a reportable offense?

You have a property damage crash hit-and-run. You definitely need to report this. The individual owning the fence would need that information for insurance purposes. Provide your best description of the vehicle, plate if you can, time of day, and anything else about the incident you can recall. It’s also possible that the vehicle may have been stolen or driven without authorization. Not entirely plausible, but possible. If the operator/owner of the vehicle can be identified, the insurance company of the property owner can go after that of the owner/operator.

What does it feel like to be in a high-speed car crash? Did you hit a car, or were you hit by another car? Did you drive into a stationary object?

I was driving back from college for Thanksgiving break when I was involved in my serious wreck. It had rained the night before but the roads were not really wet anymore. I was on a highway and as I started to switch lanes I hydroplaned due to a small space between the concrete of the lanes (idk how it was big enough to even make me hydroplane). So one second I was going 75 MPH and the next thing I know I am sideways on the road. I look out my driver-side window and see that I am headed straight for a telephone pole. I quickly thought “Okay, this can only end two ways: (1) I will die from this impact or (2) I will be paralyzed from it.” I took a deep breath and said something that my friends and I would say in high school when trouble was a major possible outcome. So I outloud and calmly said “well I hope this works out.” Luckily my tires were on the shoulder, which was grass, and it was wet enough to allow my car to slide down enough to where I missed the pole by inches. Right after watching my car barely clear the pole I let out some air as relaxation then all of the sudden…my car flipped 4 times and slammed into a concrete drainage ditch. I remember seeing everything too. From the windshield braking, dirt flying around, to all my stuff getting tossed about. Upon impact I got out of the car feeling just fine and with only a surface scrape smaller than the size of a dime on a knuckle. The police and emergency crews were telling me I needed to sit down since I had to have broken something and was just in shock so I could not feel it. However, I didn’t get hurt at all (outside of the surface scrap). They said that the fact that I was so calm and chill during it saved my life as they had never seen anyone walk away much less uninjured from a wreck like that in the 25+ years they had been doing their jobs.
