Can I break my lease if there are mice in my apartment building?

Yes.  All residential tenants have an implied warrantee of “habitability” included with their lease. Furthermore, most states have rental and/or sanitation or health codes which require the removal of “vermin” in a leased residential apartment or home. Generally speaking, the presence of mice in a leased dwelling unit is a violation of the lease on the part of the landlord. If the landlord fails to cure the violation condition after due notice and due process is given, then the lease can be terminated (broken) by the tenant without penalty. Moreover, the landlord may then be subject to damages and other penalties in a civil action for its failure to perform under the lease agreement, and/or an administrative action for violation of rental or health/sanitation laws. However, as a practical matter, vermin conditions in multifamily buildings are generally not serious problems and are considered “manageable” with exterminations, traps, and other common methods of removal. Thus, only if the condition rises to the level of an “infestation” would the premises be considered uninhabitable and/or a violation of health or sanitation laws.  Occasional encounters with mice in an apartment is generally not a problem and certainly not a basis to break a lease, but the constant presence of mice (and their droppings) present unacceptable health risks, especially in dwellings where children are present, and would indeed constitute a basis to break a lease (again assuming the landlord has been given due notice and reasonable opportunity to address the problem).

After watching a neighbor go through this situation I can tell you just what will happen. First you’ll receive a few phone calls saying you’re late or behind on payments. They’ll ask you to return the item(s) or say they can/will send someone to retrieve them. Depending on how handled that, or more likely ignored their phone calls, they’ll send a crew.Assuming you don’t allow them in to take the item(s), they’ll likely leave and report back to their superior who will then make a few last attempts to contact you before threatening to sue. Please understand, this isn’t a threat that will fall short, assuming you’ve agreed to rent more than $1,500, assume that they will follow through. And any lawyer you find to take the case will tell you that you’re best to settle out of court and return the item as well as now pay the additional fees you’ve accrued from dragging this out. In other words, because you signed a contract, it’s safe to assume it’s a legally binding contract and you’ve gone against the terms of the contract.In the situation with my neighbor, the cops were called because she and the retrieval crew caused a bit of ruckus and a neighbor called the cops. When the cops did come, they quickly understood the situation and quickly said that the situation was a civil matter and that they wouldn’t get involved. Though they did say if the situation continued to bother neighbors, they would arrest those involved for disturbing the peace. My neighbor refused to let the men into her home, the men didn’t want to cause any more trouble and left. A few weeks later the neighbor received a noticed that was she was being sued for breach of contract. According to her, she went to 4 different lawyers and all 4 told her to settle out of court and either return the item or pay the remaining amount of the item, as well as prepare to pay the legal fees and so on because the odds of winning the case were very very low.So can they call the police? Sure, but the police won’t do anything for a civil matter. But Rent-A-Center will sue for the remaining amount/item and additional fees you’ve now racked up.

How do I remove myself from my mother's lease legally?

I am currently 19 years old, going on 20.

My mom is overbearing, overprotective, etc. Even to this day, she doesn't care about the law and will still try to make decisions for me even though she doesn't have the legal right to do so. And now she is considering moving to California, and she's forcing me to go with her. I don't get a say in the matter, even though what she's doing is illegal. Currently, I am in a lease under her name in an apartment complex. Is there a way to remove myself from it WITHOUT her permission? I just want to move out and live on my own for once.

Renting to Section 8 tenants?

Once you interview tenants, check credit, etc. who is responsible for paying the first month rent and security deposit, the tenant or Section 8 agency? How long does it take for the inspector to come in an approve/dissaprove the unit? Who is responsible for the rent in the meantime? Does the inspector inspects the entire house or only the unit?

My Apartment Was Robbed Because Maintenance left my door unlocked!!!!!?

I came home to find a notice on my counter saying that maintenance entered the apartment to fix things. i never received a warning that they were coming. My door was unlocked and someone stole my flat screen tv, Xbox, Computer labtop,dvd player, and the saddest part my twin's baby stroller!!!!My neighborhood isn't the greatest but I am doubting that a resident did these things. Why would anyone try to enter a home if they don't know who's there I am completely clueless and upset. I filed a police report and I'm wondering if my things can be replaced. Can I break my lease because of this I don't feel safe and I want to get out of there ? thanks. Do you think it may have been maintenance ? One time a maintenance worker entered my apartment and folded my clothes and sofa bed and cleaned up (this was out of line and that man had a crush on me i turned him down several times) he is an older man but idk if he has hostility because i don't like him...
