Can my boyfriend get arrested for missing a court date twice? (Illinois)?

He has been going to court dates for a misdemeanor. The first time he missed court they put out a warrant for his arrest, but he turned himself in and the judge squashed the warrant then rescheduled another court date but alot of people were telling him that if it happens again he's going to go to jail. He just realized he missed his court date again because he thought it was on the 28th, now realized it was the 21st.

1.) Is their a chance he can be arrested when he turns himself in?
2.) Would he have to spend a few days in jail or could he pay the bail money right away at the court?
3.) His dad is feeding him crap that the judge will arrest him with no bail, can that happen?

Keep in mind, this is his first time ever getting in trouble. He has no record at all and was 20 when he got arrested for fighting (which was why he was going to court).

I Missed My Court Date... Today?

I was pulled over with a suspended license. Now the cop gave me a huge break by only giving me a ticket with no fine and let me go. I obviously went to go set the court date and it was for today. I was supposed to be there at 8:30 but I overslept and didn't get there until 10:30. I waited in line for like an hour only for her to tell me had I have gone directly to the court room I could have made it. She told me there isn't anything else I can do.

Now is it possible to get this rescheduled some how? She said a warrant would be out in five days. If turning myself in is the only way, I will but what will the whole process be like and will it still be possible to walk off with a misdemeanor?

The most important thing is at the end of the day I only care about how this will effect me when I try to get in the Navy.

I missed my court today. My free attorney person called me and said well they put out a warrant for your arrest please come in as soon as you can so you can take care of this.? If I go to court they're going to arrest me if I don't have the money to pay the fine for my bench warrant ? this is in the state of Cailfornia

Too simple,
GO see the Court clerk TODAY and reschedule the date. Although a Bench warrant has been issued, the courts will work with someone who walks in rather than then having to come find you.
If your name is spelled wrong and the date is wrong of your birth that would be enough to give me an excuse for not showing up....Was it me or wasn't it...

What happens when you miss your court date?

They will put a warrant out for your arrest. You best go in and let them know why you missed the court date before they catch you on the streets. If they do that it looks like you're trying to avoid them and your penalty will be harsh.

I missed a court date in FL, and have been issued a bench warrant. Advice?

I have been a cop in Florida for 25 years, and here is what is happening:

You were nailed for DWLS, with knowledge, FSS 322.34 and Altered Temp Tag, FSS 320..131 OR 320.061... All of the above charges are criminal, misdemeanor charges.

Now that you have failed to go to court, you will have a warrant out for Failure To Appear. The warrant will be and has been listed in the FCIC (Florida Crime Information Center) data base. Any cop in the state that were to run your name, DL number or even any tag or VIN to a vehilce you own would find the warrant 'hit' in the results. You are then immediatly arrested and taken to jail.

You only have a few choices.

First, go turn yourself in to your local Sheriff's Office jail or to any police officer you see on the street. This will get you taken in, booked and you will go to court the next morning to appear before a judge. He can then require you to post bond, or release you with no bond and set you another court date. If bond is set or left at $500.00 than you need $50.00 and you pay that to a Bail Bond firm and they will bail you out.

Or.... You can hire an attorney to arrange for you to be turned in and booked. They can work to get your bond reduced or released with out bond.... But its going to be expensive.

Either way.... Any warrant in Florida requires you to be booked intoa local county jail. There is no way out of it.

They will not mail you a copy. They will most likely send your local Sheriff's Department Warrant Deputies out to find you. This warrant will not expire or go away until it is resolved, or 'served' as it is called.

This is your only correct answer by Florida law.

What happens when you miss your court date?

Look on your ticket (if you still have it). There are two types of traffic tickets police generally issue; they are either for civil or criminal violations. On your ticket the policeman will have checked either 'civil' or 'criminal'. A civil violation is generally for minor traffic offenses such as running a red light, failure to yield - etc. A criminal violation is for more serious offenses such as a DUI, driving with a suspended license - etc. More than likely your ticket is a civil violation. With a civil violation ticket, if you don't show up for court, they will issue a default judgement against you, and will suspend your license if you don't pay it. They won't issue a warrant for your arrest for these type of tickets. If the policeman did check criminal rather than civil, they will issue a warrant for your arrest if you don't show up for court.

Contact the courts and explain the situation. It is in your best interest to pay the fines and get this resolved as soon as possible. After you pay your ticket, contact the DMV and see what steps you need to take to get your license back (if applicable). You don't want to get pulled over with a suspended license.... that will get you in a lot of trouble!

If I fail to appear at court while out on bond and have a probation violation for misdemeanor probation, when will I be searched for at home and work?

Who posted your bond? I'm sure they expect you to show up for court. If you don't , that person won't get their money back.Anyway to answer your question it's usually a surprise when the police or bondsman come to get you. Why don't you want to go to court so you can get all your legal issues taken care of? Being on the look out for the cops all the time gets old real fast. And if they have to come get you, they're gonna let you know how it inconvenienced them. So it's going to make things a little rougher on you. Do yourself a favor and go to court. Its just a misdemeanor violation. It won't be that bad. And there's nothing worse than unexpectedly going to jail. Even if you have to go for a few days as a result of your violation, you know when it will be and can prepare for it. But if they come get you, you won't be prepared and that makes things a lot worse than they would have been if you would have just did the right thing. Quit being your own worst enemy, man up and go to court.

If you bail someone from jail, can they still be sentenced for the crime?

Bailing someone out of jail does not adjudicate the charges. He still has to face the charges. It’s no different than someone who is ROR’d out.Whem someone is bailed or ROR’d out, they make a promise to appear.Often people pay 10% of the bail to a bail bonds company. The bail bond company pays 100% of the bail, and keeps the 10% bond. If the accused “bails” on the appearance, the company loses the full amount. The company can go after him for that full amount.Say the bail is $20,000. You pay 10%: $2000 to the bail company. They pay $20,000 to the court. When you appear in court, nothing happens. Once you are sentenced, and either remanded to custody OR released on probation, the bail company gets their $20,000 back. If, however, at any point between getting bail and being sentenced and remanded into custody or released on probation, you say “screw this!” and no show for court, 3 things will happen. 1. The bail company loses $20,000. 2. They can go after you for that, and can even send bounty hunters after you. 3. In spite of everything the bail company is doing, the court can issue a bench warrant for you for failing to appear at court. So, “skipping bail” as they call it, can REALLY cost you.
