Self-Defense: If you fight with someone who attacked you first, how do you prove that you have a justifiable reason to attack back?
You can only "prove" it by evidence such as videotape. The more eyewitnesses you have the better, in a case sans tape.A lot of people use the excuse that "he started it" when in reality they baited the person to make the first move so they could feel "justified" in inflicting violence on someone.This is why ego contests usually start with "chest bumping", name calling, and other enticements to tempt someone into being the "aggressor".Half the time this is simple word games. There was no true self defense at play. A state like Colorado even has a "mutual combat rule" where you are allowed to fight another, which seems rational, if not outdated for our day and age.In a true self defense situation you are allowed to strike back. But you need to end your assault the moment your attacker is no longer of threat to you. You can't say, "well, he touched me, and I don't allow ANYBODY to put their hands on me, so we threw down!"Sure, that will justify it to yourself, but it's not right to provoke someone simply to have an excuse for kicking their ass.If it's true self defense, for example a strong armed robbery or random street violence, then strike back, strike hard, and worry about your personal safety first and the law second. But as soon as it's over, look to clean up your mess (getting witnesses on your side) as soon as possible. Tell the police you were a "victim", and try to be the first one to call and talk to the police if at all possible You are not going to look very "victim-like" if you have a bloody body lying at your feet, so be careful to paint the proper picture of the incident to the police. Speak with an attorney as soon as you can too, obviously, and be careful how much explanation you give the police. Just make sure you are labeled as victim and complainant.
I am being sued by a credit card company for about $2,200 but can't afford to pay them. What should I do?
Call the company and negotiate the payment. They would rather work with you than have their lawyer to go to court for just $2,200. Make payment arrangement with them. I knew someone who was in exactly your situation. She made payment arrangement and has been paying them back on time. They left her alone after that.
Can you sue someone on social security disability and make them pay?
Social Security benefits are normally considered judgment proof. Which means they can not be garnished (taken) You can still sue them but if the person who owes you money only receives income from social security then you can not collect from them. The lawsuit will remain on record however and if social security benefits stop and/or there is another source of income. You can return to court and then request wage garnishment.
Can a collections agency sue me if I am making payments towards my debt?
Long story short, I have been through several hardships and I have an $11,000 credit card bill. They sent it to collections, and now the collections agent is threatening to sue. My question is, can they go forward with a lawsuit if I am willing to pay? I have expressed my desire to make things right and pay back the debt I owe. I know I have to be held responsible for my actions...I'm not trying to get away with anything here. The problem is, they are demanding almost $3000 in order to stop persuing the case against me. I don't have that kind of money and I have no way to get it. I am willing to make small payments ($100 or so) from now on. I can even put this in writing for them if they want. I tried to look this up online - some places say they can't touch me as long as I am making some kind of payment. Other places say they can do whatever they want if I don't pay the whole $3000. Can anyone help?
What happens when you get sued by a creditor? What do you do if you have no money???
My husband and I have been receiving rude phone calls from PDM ( Professional Debt Mediators) regarding non-payment of $800-ish to a past apartment complex. We broke lease with this apartment complex due to the unsafe environment (drugs,stabbings, etc.), gave proper notification of early termination of the lease in wirting, and cleaned the apartment before leaving. I do not deny that we do owe them the rent for the month we left, however, we simply do not have the money to give to them. We barely make ends meet now. So, PDM is threatening to take us to court if we do not pay. What is going to happen if we are sued? I mean, how can they make us pay for something when I have documentation showing just how extremely poor we are??? Will we go to jail? I have a one year old and cannot afford for myself or my husband to be in jail. If someone could tell me what to do, that would be great! Thank you for your time.
