It is a huge financial responsibility.
If he can't support his wife,you can already guarantee they will need financial assistance.

Can i use a joint sponsor (form i-864)?

hi there, okay here are some of my questions.
1) i do have an F1-visa but current married to a US citizen, i already got the marriage certificate and all that the next step is to file the paper work, Although i have some confusion.

2) My husband US citizen filed form i-130 for me and g-325a for him
I also filed form g-325a and for i-485

3) I understand we have to submit the affidavit of support, I have been working and make at least $10,000 a year for the past 4 year, and i have been filling tax returns every year.
On the other hand my husband was self employed and don't make a lot of money that if he files the affidavit of support by himself alone it won't be enough and no tax return available.

4) we have a close family friend who is doing well financially and is willing to provide an affidavit of support to us. he will have to submit form i-864.??

5) does this means he qualify as a joint sponsor??? if yes Can i too submit what form for evident that i have income coming?? is it form i-864? and form i-864a??? here is where i have doubt!!
Also do my husband (us citizen) has to submit any of the affidavit of support even though he haven't filled taxes for the past 3 years???

Please any information will help me understand better. Thanks everyone for your help.

Affidavit of support: income requirements???

i need to give an affidavit of support for my husband. i dont work and my dad is my co-sponser right now. my husband works in a company called eli lilly in asia. its branch is also located in united states. so he has a chance of working in the same company when he arrives in usa. i read this info on the uscis website

Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is your spouse, his or her income can be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident.


my question is that does this info means that i can show on the affidavit of support form that my husband will be working at the same company located in usa after arriving here??????? plzzz help i need to know this asap

I-864 affidavit of support, joint sponsor?

Okay. So I've researched and researched but I don't seem to find a direct answer to my question. My joint sponsor lives in another state as I. I've established and figured out that that's fine. My second question is about how to exactly find the percentage of their household by the Poverty Guidelines. I know it's 125% above. My joint sponsor is married. Him and his wife. They file their taxes together. First, how exactly do I find the percentage? They have a household of 2. Just the husband and wife. I know that the poverty guideline is just about $19,700 for a household of 2. I find the 125% percentage of that and that's how much each of them have to make individually or how much they have to make together? Also how many joint sponsors do I need? Am I fine with just this married couple or do I need more? I'm young and confused, sorry.

Does your sister - and her husband! - understand that by cosponsoring your spouse they have unlimited legal & financial liability for your wife? You cannot afford to support her, & if you cannot meet the ridiculously low requirements of Affidavit of Support, you cannot provide for all your own needs, for that matter. They could get stuck with, for example, huge medical bills if she gets sick, pregnant, injured, whatever. So that's the first issue.

Second, see an attorney. Sis has to prove her income, but she & her hubby file jointly. And are you in a community property state or separate property? What impact does that have on her husband's liability as well as hers? You have a lot of issues here, so you had better hire an AILA attorney for some serious advice, as well as filling out the forms. You cannot afford to support your spouse, but now you need attorney fees? You are in so much financial trouble already! Why doesn't your wife sponsor your immigration to her country? You might be better off living there since you have financial problems trying to live in a high-cost high-tax country like the US.

Can I help my husband meet the income for the affidavit of support even if I am not authorized to work in usa?

If you filed a joint income tax return as being married to one another, and if your income continues to come from the same source after you become a Green Card holder, meaning, you will continue working where you are working now, then your income can indeed be counted for Affidavit of Support purposes. Uncle Sam just wants to make sure you wont' become a public charge, and if you are making money already, that's not very likely.

The previous answers in this regard are incorrect. Additionally, "working without authorization" is not being made an issue of to spouses of US citizens at the AoS stage or any time thereafter. The only deal breaker would be if you were guilty of identity theft or claimed to be a US citizen, i.e., on the I-9 form.

Had you asked here which forms to file before sending out the I-130 alone, you'd be done by now. You'll not only file the I-485, but also the I-864, 2 x G325a, I-693, and I-765, all concurrently. Add a copy of the approved I-130 to the package, so that the petitions can be joined. You don't need a lawyer for that.

I was wondering when the joint sponser fill out the I-864 Affidavit of Support form do you sign ever sheet?

It needs to be signed on the last page. The petitioner needs to file and sign an I-864, and the joint sponsor also needs to file a separate one and sign it. If the joint sponsor is married but doesn't earn enough money to sponsor the family on his or her own and needs the spouse's income to make up the difference, then the spouse needs to file an I-864A as a member of his household.

Do i need to fill out a form I864A when i dont have a household co-sponsor?

Make it easier on yourself by getting a job, anything, even part time so you can have some income. Then you should be able to say you will at least pay for his food. Your mother can say she will provide a place to live.

However, the way the instructions read, you should fill out one I-864 form, with the primary immigrant information in item 2, and the spouse in part 3. ("If the spouse and/or children will be traveling with the immigrant, or within six months of the immigrant's entry to the United States and you are sponsoring them, you should list the names and other requested information on the lines provided.") Joint sponsors = if your husband cannot meet the income qualification to sponsor his parents, a joint sponsor who does meet the income qualification can submit the I-864. See "What Is a Joint Sponsor?" on page 3 of the form in the instructions.
