How to stop a wage garnishment on child support?

I owe back child support and my employer has been served on me a wage garnishment that will make it impossible for me to live. I don't dispute that I owe back support, but the amount they have is not correct....This case has travelled thru 4 states, initially started in Arkansas in 1986, then Oh, Ky, and I live in West Virginia. No one has the any info on how that amount came about. I have made several phone calls to various county clerks to find out this info, but always to be referred to another state with the same reply..... appreciate any quick responses this on how this can be stopped until the amount can be settled and adjusted to what should be correct. If I need a lawyer for this, what kind of attorney should I contact to handle this?.....Thanks

Indeed.  There are actually very few things that can prevent a U.S. citizen from getting a passport, but owing over 2.5k on back child support is one of the most common.  And without a U.S. passport, it will be difficult for you (presumably a U.S. citizen) to travel or immigrate anywhere.The child support collection process is automated to the extent that a passport will be denied to a non-custodial parent in arrears, without any additional paperwork.  In other words, nobody lifts a finger and the ban shows up in the system as soon as one crosses the 2.5k USD threshold.In my experience, most non-custodial parents who find themselves in this situation are able to get out of dodge by either contacting and negotiating directly with the custodial parent (not always feasible or advisable), or by providing evidence for an amendment to the original court order of support (usually based on a material change of circumstances).  Thanks for the A2A, User-11978101981914353371.

My answer is strictly one of personal knowledge and experience where I know people/have known people with such warrants issued against them. Nothing herein is in any way meant, or to be construed as, legal advice.]With that in mind; the practical answer here is - NO. In general one state is not authorized to “pick you up” for a bench warrant (child support is technically enforced, in most jurisdictions, as a contempt of court warrant) issued in another state. In fact, most jurisdictions/counties, will not “pick you up” for a coc warrant issued in a different county, even in the same state.HOWEVER, although one jurisdiction will likely not go looking for you to satisfy the warrant-issuing county’s desire to incarcerate you; IF you are stopped, the officer runs your ID, and that warrant appears; many counties/states WILL hold you until it is determined whether the issuing jurisdiction will come to extradite you. IF this happens the arresting county/state will usually hold you on as fugitive from justice.So, although they won’t usually go looking for you; you’ll be constantly trying to go the rest of your life without ever encountering a police officer; NOT an easy task; especially when the issuing jurisdiction WILL revoke your drivers license (making it impossible for you to get a license ANYWHERE ELSE IN THE WORLD); and will garnish your wages (forcing you to seek employment under the table as those garnishments are nationwide).My personal, non-legal advice; do yourself a favor and just deal with this now. You are ruining your life trying to avoid paying child support and/or pulling a couple months just because you got behind. Your kids NEED you in their lives. IF you run from this piddly situation with the courts you will NOT be there for them, EVER. It’s simply not worth it to run, on any level.

How much child support should he be paying?

Being a father you has to pay Child Support you are being very far about this. Hats off to both of you for talking this out and being growing up about it. State of Arkansas goes off what that non-custodial parent brings home each weeks, the State of Minnesota goes by your gross pay. Now my children live in Arkansas and I live in Minnesota, so I have to pay what Arkansas is set up for, but because of my wages I only have to pay half of the court order. But there are times I pay more then what the court order is. I care more about my children the a stupid court order. If you two can set over coffee and work out an agreement that is great, but if you can't then a court order might be the next step. suggest $100.00 to $300.00 a month as a start working point and both of work out a agreement that way.

Jail time for owing child support?

What are your feelings on some states that give jail time to fathers (or non-custodial parents) who are behind on thier child support payments? So they lose thier licenses, homes, jobs, and relationship w/thier children? Mind you, Not all parents who are behind on thier thier child support are dirty, thoughtless b*stards...Perhaps they have valid reasons for not being current. Meanwhile, the greedy jerk who is responsible for having them put in jail has also created a broken family situation in the first place. Is this an intelligent way of aiding children?? Will Arkansas arrest you for a Louisiana child support warrant?

To be completely honest it really depends on the officer and what side of bed he woke up on.If they all went by the book then yes they absolutely could arrest you for any kind of warrant.If I were a cop I wouldn’t arrest someone just because they couldnt pay their child support. I’ve always thought how are they gonna pay if there locked up.More serious charges like theft, sex crimes, murder, etc. yeah they definitely would be arrested.

Can child support garnish your 401k if you owe back pay?

Yes absolutely. A lawyer can use a Qualified Domestic Relations Order to turn all or part of your 401k into child support. Now, if you are already subject to Income Withholding, and child support and arrearages are coming out of your paycheck, then you are already paying for the arrearages.But depending on how far behind you are, and whether or not your ex has the funds to hire an attorney, be aware that it's possible. So if it will take you 20 years to catch up on arrearages paying a portion slowly through your paycheck, but you have a nice fat 401k that would cover it all right now, I would definitely go after it if I was your ex's lawyer.

How do I fix owed back child support?

I owe back child support and want to start paying it back now that I am a lot more stable now in life and trying to put my life together for the better. I don't know who to contact and am afraid of the consequences but I know I need to start fixing this now. I don't have much money, hence posting the question here, but really do mean well. There is little to nothing you, as an individual, can do. State and local child support authorities are supposed to report the most egregious offenders to the feds. So you have to start with your local child support office. If there is already a child support order in place, and the other parent is in arrears by 86k, as you say, it is most likely that the local office had already reported him.But, you see, in order for the feds to do anything, such as arrest him, garnish wages and /or garnish tax returns, they have to find him first. There are, unfortunately, many people who would rather live “off the grid, “ work for cash, and not file tax returns just to avoid paying child support. So you might get the impression that nothing is being done, when, in fact, he simply hasn't been found and there's nothing to tell you yet.With that kind of money at stake, I would absolutely hire an attorney. Attorneys have certain abilities (such as being able to subpoena records) that civilians simply don't have. It's very possible that a decent attorney can find out important information that can aid state and federal authorities in tracking him down.
