Falsely accused of drug seeking?

That's terrible. And yes it does happen. The problem is that ERs do get a lot of narcotics-seeking patients, people who go from one ER to another with complaints trying to get 10 pain pills, and like anyone in the position of playing referee, the hospital will make some bad calls. They made one here, and you should contact that hospital's Quality Management office. The name of the department can vary depending on the hospital. Call the hospital operator and ask for Quality Management, and if you get a puzzled response, say you want to talk to the office in the hospital responsible for patient quality-of-care issues. You may get bounced around, but eventually you will end up in the right place. Get the spelling of a name of an individual responsible in that department and write a letter and include photocopies of test results and the ER report from the other hospital. You have a right to ask for copies of your records from the hospital that misdiagnosed you, and you have the right to note a correction in their records. (Note that they can't delete their erroneous label of drug-seeking, much as you might like them to, because that looks like a cover-up to regulators. They have to leave the error in your record with a correction.) They should follow up and respond in writing. If you're still not getting anywhere, ask for the hospital's patient care ombudsman. Quality Management people are not there to sweep issues under the rug but to make hospital personnel follow correct procedures so that future patients get better care. The hospital can lose their accreditation if they don't.

By the way, the above advice assumes you are in the USA. We do get people posting questions from other countries, and those posts aren't always labeled that way here. If you are in another country, your rights and the procedures hospitals must follow in investigating and correcting errors in medical records may vary. I only know how it works in the US.

I was falsely accused of rape?

I'm 17 and about two weeks ago, this girl and I had sex at one of my friend's party. We had both been drinking and one thing lead to another. The next day she hit me up, asking why after having sex with her, I didn't call. I told her that I thought it was just a one night stand. She freaked out and began this heated argument with me. I tried to avoid her in school, and just yesterday, I realized that my friends were also acting distant from me. I asked my close friend what was up, and he told me that the girl was telling everyone that I raped her at the party. I thought he was joking at first, but when I got home, the cops were there and they were asking me all sorts of questions. What happened between us wasn't rape. I'm so scared right now. I don't know what I'll do if the cops believe her. Even if I am found not guilty, I've seen on other cases that the guy is usually labeled as a sex offender. I feel like my life has been ruined. Not even my own parents are looking at me the same. I looked on my facebook and there were a bunch of people calling me a rapist on my page. I really don't know what to do right now. Someone please help.

Is there anything I can do, I was falsely accused of being drunk at work?

I was then forced to take a drug and alcohol test, which both came back negative. This was embarrassing and I am worried that I will have lost respect from my co-workers. While I was gone taking the test the situation was being discussed with other employees including employees that directly report to me. I was suspended until the director of human resources comes back to work, even though I had the test results and they were negative. Any advice?

All. Of. The. Time.My stories different though I'm pretty open about the fact I was a heroin addict. I also let doctors know they played a huge part in my addiction giving an 11 year old Oxycontin.So I'm pretty sure it's in my file somewhere so I constantly get judged.The worst time this happened I was having a real medical emergency.So one regular day I'm doing what I always do and then all of a sudden I get the worst pain in my life in my head. I collapsed in pain. It was like lightning striking the center of my brain but only every other second it went with the beat of my heart. Luckily I had a room mate at the time I was able to tell him to call 911.Soon as the EMT's arrived they were treating me like garbage. They thought I was going thru opiate withdrawal!!!!! Mind you I'm in so much pain I can't really think, talk, or even function. So I couldn't really explain what was going on but I was saying it felt like an aneurysm not that I know what one's like.I was not dope sick I had 6 days worth of methadone there with me those guys treated me like I was drug seeking when I was really suffering thru a psuedoaneurysm. It could've been more serious and I could've died just because they thought I was after pills.

I was falsely accused of being under the influence at work. Drug test came back negative. What now?

Human esources showed up out of no were at my job to talk to me about my tardies. I already had an arrangement to speak to one of the bosses about it. Then they sent me out and called me back in to the office and told me they believed I was under the influence. I looked at them puzzled and said no I'm on adderall that is it. They asked me to take a drug test, it came back positive for the adderall, but i sent my prescription info in to the drug testing place. They put I was negative for everything on my form and sent it to Human Resources. They called me in a meeting and told me that I wasn't under the influence and if I hadn't taken my adderall that day. I told them no I did not take it that day. They said that maybe i looked a little off becasue I was not taking it. One of them even adviced me to take it regularlyso maybe I wouldn't act that way. I got offended and told them that I will only follow what my Doctor adviced and he said if I didn't take it there was no problem I would just have a harder time focusing. I asked them if that's why I was drug tested and they immediately said no. They later mentioned that they had seen a picture on my facebook of a pill, and I told them oh but that's not real. I asked them again if that is why I was drug tested. They then said no, but they wanted to make sure I was clear and they were happy I was. I want to complain. Help please. I cannot explain to them how an adderall patient should behave.

A Coworker Falsely Accused Me of Having a Drug Problem In Front of the Whole Office! How Do I Handle this?

I work in an office with an open cubicle layout. Yesterday I had a bag of those little Mike and Ike shaped licorice candies on my desk. One of my coworkers walks by me and very loudly says "Oh, I didn't realize that was candy! Those looked like tranquilizers to me!" He made a reference to the legal medications I take and said he wouldn't be surprised if I did use drugs based on how frail I look.

The truth is I'm Bipolar and have mild seizures. The medications I take are on a 4 dose per day schedule, so I end up taking them at my desk. I look a little sickly at times due to kidney problems caused by a mood stabilizer I used to take. I'm 21 but my face looks a little worn from stress and the effects of medications. My boss and coworkers are aware of all of this.

This incident was VERY embarassing. If this was some type of joke it wasn't very funny. I kind of played it down, but it still made me uncomfortable. How do I approach this guy and tell him how I felt?

Wrongly accused of drug-seeking in er...?

I've had terrible kidney issues for a year now. I've passed 4 stones and 9 months ago I was hospitalized for a kidney infection. Well I've been goong to the er a lot for flank pain. I went to one er about a week or so ago and was accused of drug seeking even though I had blood and wbc's in my urine. They sent me out with nothong and a diagnosis of side pain and drug seeking behavior. Well I spiked a fever and went to another er where they finally diagnosed me with another kidney infection. I was almost hospitalized and if it doesn't go away I will be. Should I contact the hospital that accused me of drug seeking and inform them that their dictors missed it and falsely accused me? Has this ever happened ti anyone else?

I have no insurance yet so I haven't been able to see a specialist...

Can a doctor be accused of slander for falsely accusing patient of drug and alcohol addiction?

However, HIPAA does not creat a private right of action so your only remedy would be to report this potential violation to your state attorney generaL, the Federal Office of Civil Rights, or the state medical licensing board. Whether they would take any action is hard to predict.TLDR: a slander claim will succeed only if the statement was false, defamatory, communicated to a third party and caused harm.

What should I do if someone falsely accuses me of theft?

I am a jeweler and I was going to a very rich client's house to handstring her very expensive pearls. She knew I had a shop at home to solder and metalwork and several times she asked me to take silver pieces home to work on. Once she asked me to take two turquoise rings home to turn into earrings. I didn't have the time because I was working on something else for her so I told her I would pick them up later. She put them away in a box with some beads and I saw her do this.Later she asked for the rings and I told her I didn't have them. Then she accused my husband of taking them. Then she accused me, but she would not listen to me when I tried to explain where the rings were because she had put the away in a different box than usual. So I finally got angry and said, “okay, you say I'm a thief then I'm a thief and I stole your rings.”We had been good friends. I knew one day she would find them which she did. Then she had to apologize to me, but I just couldn't trust her anymore and I never worked for her again. It ruined our friendship. Next time, people should do more listening instead of accusing.

My neighbors keep calling the police on me and falsely accusing me of criminal acts. I am afraid to go outside of my house. What do I do?

I have a neighbor that is fixated on my husband. She seemed a little off, but once she found out about his time in prison she developed a full blown obsession. She wrote the association board for our community a complaint about him slamming doors and watching her when she was outside. This was nonsense but they still had to address it with us. She wrote subsequent letters to the board stating he has a key to her car, and gains entry to turn on her radio...that he lets air out of her tires...that he's getting in her home and releasing ants...and he's poisoning the food in her refrigerator. We'd see police at her door, but they never stopped by to talk to us. One day last fall, my husband was riding his bike. This neighbor pulled her car in front of him and slammed on her brakes, causing him to fall off his bike. Her behavior was now endangering him so we went to the police to file a report. The police were helpful, and knew our neighbor well. Apparently she'd filed lots of police reports about my husband and a few other men from the neighborhood. The police recognized she has mental health issues and never pursued her later complaints. So what can you do? Try to have your cell phone ready to record if you think your neighbor will confront you. Keep a cool head, there's nothing wrong with not engaging in an argument. Don't be afraid to talk to the police to see what your options are if you're being harassed. You don't want to end up on the wrong side of this problem.UPDATE: my local police department reached out to the neighbour's daughter, the daughter called my husband to apologize and let him know she will be intervening in a medically supervised care program for her mother. She made sure he has her contact info should we have any problems. I give her all the credit in the world, she was wonderful and it's great that she wants to be involved in her care! Here's hoping my neighbor gets back on track.
