If You Set-up A Charity Or Trust Then Is There Any Way The Courts Can Find-out You

Can I give away all my money to charity before getting divorced?

My wife and I decided today that we would file for divorce and she wants about 40% of all my money. Since we have been married for about 6 years and none of us had any money prior to the marriage, I'm sure the judge will grant her request. We have no debt, 1 kid, no house, no car notes, etc. But I've saved about $20,000 over the past 3 years. To avoid giving her thousands of dollars in a lump sum, I'd rather just give it all to charity and start over again. Is this illegal? Of course, I'd still be paying child support regardless.

What happens f I dont finish my community service hours?

Sometimes they sentence you to say 6 months in jail, with 6 months suspended if you follow certain criteria, like your community service. Worst case is they just make you finish the original sentence.

Is there any way for you to get 18 hours done by friday? Thats 6 hours, Tue, Wed and Thu - I think the effort on your part will be worth avoiding more punishment.

How do i scare someone into DOING their court ordered community service hours?

Someone close to me was accused and charged with a misdemenor(sp?) in december of 2007...anywho, the judge ordered her to 50 hours of community service which she need to complete and go to court for in about a week and a half from now around May 20ish...she has only done 9 hours so far and is hesitant to complete her hours because she hated the one day helping out at the vfw...how can i scare her so that she gets them done? i need some legal terms or examples of what happens for her not complying with the judges orders...

your input is appreciated!!!
wish more people took the law seriously!!!

Can i pay off a ticket fine instead of doing community service? please help?

so basicly the court gave me the chance to pay off a fee of 150 but i didnt want to pay it due to me not working right now so i just told them can i do community service instead (my friend told me that if i do community service you just go 2 hours and they put that you went for more but i thought he was telling the truth thats why i decided to do community service but today i found out that he was lying) so i have to do 40 hours of service that means i would be making about a dollar an hour and i think thats ridiculous so i went again to court today to see if i could pay it but the judge said no you have to do the hours i also asked him if i can go to traffic school and he denied it. I think its really unfair come on a dollar the hour thats bs and i also have to pay 90 dollars to be able to do the service, is there anything else i can do?

Probate Court???

I can share my own experience with you from IL, but I don't think you want to know the answer. My father died almost 8 years ago, leaving a small Estate worth about $45,000.00. The Probate Act is supposed to protect Executors like myself from harassment and frivolous litigation, but the Act itself is useless unless it is enforced by a honest judge. In my case, the Estate was assigned to an incompetent hack who regularly ignored the law; required me to submit the same Final Account, over and over again for no good reason, and then invented excuses not to look at what was submitted; allowed one disgruntled beneficiary to defy 14 separate orders of the court, and then forced my father's Estate to subsidize the delay; allowed a beneficiary to embezzle money from the Estate (because she was a "lawyer") and allowed another attorney to extort money from the Estate. By the time the incompetent probate judge finished "probating" the Estate, some four years after the fact, the Estate was bankrupt. So, my advice to you is the following: (1) Before agreeing to become an Executor, convince the person who is the subject of the Will to create a Trust and then make sure all the assets of the Estate are titled to the Trust before the person dies (by doing this, you may avoid probate entirely); (2) make sure the lawyer drafting the Will includes in the Will a clause whereby you are appointed as an Independent Executor (if you fail to do this, any beneficiary can ask a probate judge to have your "independent" status stripped from you and forcing you to undergo "supervised" administration--which basically forces you to go to court to get a judge's permission before you sign a check, pay a bill, or do anything; (3) have a lawyer insert a clause in the Will and Trust whereby any beneficiary who chooses to contest the Will or Trust automatically has their inheritance donated to charity (which will protect you as Executor and Trustee from frivolous litigation); and (4) consider not being named Executor (which will save you years and years of grief if one of the beneficiaries chooses to harass you and abuse the Probate Act, while the probate judge looks the other way). Probate is an archaic process that is supposed to help divide up a Decedent's assets, but in reality does little more than feed lawyers and judges in the legal system at your expense. So, avoid it at all costs!

What is required to set up a non profit NGO in Portugal?

Most non profits in Portugal are registered as associations. I have very recently registered one association so I am still familiar with the process. To start an association you need to go to the offices of the Instituto dos Registos e Notariado: IRN .There, you can open your association, paying a fee of 300€. You will need 75€ if you want to choose a decent name for your association as well (you can opt from a pre approved list and avoid this extra fee, but you won’t like the list for sure). Two people need to go there and provide IDs, and they must provide an address for the association as well. After that, they will immediately give you the important details (fiscal ID) and allow you to start the remaining formalities. You can appoint a board for the association, and open a bank account. You can also request your logins for the social security website and the finances website, which will arrive by mail to the address you provided in the registration. All this process takes around 2 weeks if done at the normal pace. You can try to rush it by going directly to the offices and asking for things in person. If your association plans to have more than 100k€ of reveneues per year (of any kind), you will need to hire the services of an accountant. I would recomend you hire one anyway if you plan to have employees, or if you are not familiar with the portuguese bureaucracy as they will guide you through it much more easily. It will also be very handy if you plan to apply for state funding. In the special case that your NGO is a youth NGO or in any way connect to sports, I would recomend you contact the local branch of Instituto Português do Desporto e Juventude , as they can help you with most of the process.Good luck with your NGO.

Can the judge sentence you for unfinished community service?

No lectures.

Yes, the judge has several options:
More hours of community service
A substantial fine
Jail time
OR he could rescind the original Community Service hours, and reopen the misdemeanor case. with all new punishments.

Is there any non-profit organization that will sign off your community service hours without making you work?

It's highly unlikely that you will find a place that will allow you to do this. Yes, there are dishonest people everywhere - including you seemingly - but I wouldn't go hunting for them if you want to actually make it anywhere and be given respect in this world.

Who gave you the duty of community services hours? If you can, call them up - or call the court or wherever and ask for an extension. Explain your case, give detailed working hours and numbers that employers can be reached at so that the judge or advocate or whatever can make sure you really do work all that you say you do.

Truth be told though, nobody works SO much that they can't find time to do something else. You have to have at least a day or two where you can find a few hours to work at a soup kitchen or women's shelter. Even if you have to spend every weekend doing this.

I get that money is tight and people need to work to catch up on bills and be able to afford the essentials but you really don't want to slack off on this or cheat your way through the system because you will be caught, questions will be asked, and you may even need to give detailed descriptions of the work you did.

Call around to the local charities and tell them about the community service and ask them if you can schedule times to come in. Let them know you may not be able to fill in all 48 hours at their place but would like to be able to do at least part of them. And make sure you know whether or not they will be willing to write down the hours and sign the paper. Some places won't simply because they hate that the only reason some people volunteer is because they have to.

It may be that you just have to start getting up earlier to do this or stay up later to do your own chores and such or even change around your actual work schedules for the next two weeks.
