What happens when I leave a state during my felony probation?

In Wisconsin where I worked, if you left the state without permission of your Probation and Parole Agent, it was a violation of your supervision rules. THIS IS CONSIDERED A SERIOUS VIOLATION! Your probation can be revoked for this, and you can go to prison for it.Travel passes were fairly easy to get if you are doing the things you are supposed to be doing. Meaning, you were attending classes/treament programming and paying your court ordered financial obligations and supervision fees. If you give your agent enough time to get the paperwork done, your travel permit can be prepared in advance and left at the front desk for you to sign for, all you have to do is pick it up. If you are not up on paying your financial obligations, start catching up on them before you ask for a travel permit, you are not going to get off supervision owing restitution ordered by the judge, you just are not.A person who leaves the state without authorization is still engaging in criminal thinking. Why risk going to prison? A travel permit is not that hard to get. I can tell you I saw some of my offenders in Minnesota without permission, their outcomes were not good.

What happens if you violate probation?

As with any questions regarding law, what may happen will depend on several factors, including the jurisdiction, and the particular probation officer.  If you violate the conditions of probation, the probation officer can file an affidavit alleging a violation.  A warrant may be issued and you might be arrested, or you might just be given a court date.  The State may decide to proceed in proving you willfully violated the alleged conditions of probation (unless you admit to the violations), and if proven or admitted, the Court can violate you.  Your sentence will depend on several factors, including the type of sentence you originally received when you were placed on probation, and the sentencing guidelines applicable to you.  You might be able to be sentenced up to the maximum sentence for the offense you are currently on probation for. Or, the incarcerative sentence may have been suspended pending the successful completion of your probation, and that sentence might be imposed. Or, it might be possible to simply have your probation reinstated.It's best to consult with an attorney to discuss case specific facts, and the law applicable to you.

Can I enlist while on probation?

I want to go enlist for the Air Force Active Duty.

Heres the thing though, I was arrested Friday evening. My uncle, whos used to be a Police Officer, said it would be best if I tried to get PBJ (Probation Before Judgement). He said it would probably be a year for Probation. What I plan to do, at the trial, is to admit that I did what I did and I regret it, apologize for my actions, and tell him that I want to go into the military because that night, the incident made me realize that if I stay here where I am now, that Ill just keep getting into trouble and I do not want that type of life for myself.

Hopefully the charges will be dropped or something like that, or Ill just get PBJ.

How would this affect my chances of enlisting right away?

If someone is in jail and their jail information say they're pending unsentenced charges what does it mean?

could mean already in jail and was involved in a crime while out prior to the incarceration... now was implicated and waiting for the sentancing...
Or can mean was on probation, committed another crime while out. Was placed in jail on a probation hold (from the first crime) and is awaiting sentancing on the 2nd crime.

I live in oregon, i am on unsupervised bench probation for a misdemeanor can i apply/receive my passport still?

I have no felonies or pending charges of any kind. I am on what's called in Oregon: "unsupervised misdemeanor bench probation". I literally just have to behave like every other common citizen, that's it. It was a Driving While Suspended" misdemeanor charge that I pled guilty too and got 18 months of that kind of probation I mentioned above, along with some hefty fines that most are paid in full already and I am current on the monthly fine payments. Can I apply and actually receive my passport while on this kind of probation. I have no other limits put on me when it comes to traveling within this country. I also will be applying for the first time. If that matters somehow.

Will I be automatically violated on probation for catching another charge or is it up to the probation officer?

If your new charge is a felony youll get a violation and possibly suspended from probation until you go to court on your new case. At that time, if convicted,you'll have to go to court on your revocation hearing to see if they want to reinstate your probation or revoke it. If you have to go do time because of your new charge well then of course you'll be revoked . You'll then go to prison to serve the remainder of your time you had left on probation and time you get for the new case. They will usually run the time from both cases together (concurrent). But they can run them consecutive, meaning you would do the time left on your probation in prison first and then stay for the time you got on your new case. If both cases were for drugs, there's a good chance you will get a 120 treatment. Which is at the prison but you are separated from all of general population. You would serve that 4 months in their treatment center.If your new case is a misdemeanor, you will get a violation but won't have to do any time for it in prison. They may have you go to out patient treatment . If that's what happens you better avoid getting anymore violations after that or you will end up eventually going to prison. That's how it usually goes in Missouri. I can't speak for other states as all my charges were in Missouri. Hope this explains it clear enough to you. It can get a little confusing . Good luck!

I Got a possession of Controlled Substance charge, specifically Cocaine, Can I still enlist into the Navy...?

Possession of a controlled substance will be a permanent disqualification only for the Air Force (regardless of misdemeanor/felony). Other branches (yes, including Navy) will allow you after a period of time, but definitely NOT while you are on any sort of probation.

I had a recruit once that was popped at MEPS for using cocaine. Tested positive and his AF enlistment hopes were done. I walked him to the Navy, and the Marines, and both were willing to resend him in 3 months. Apparently past drug use is not that important to them. Army will definitely take you as they DO allow people with felonies to enlist.

The road may be a bit harder for you as you WILL require waivers. As I said though, you can't do anything until after the probation ends... Talk to your recruiter and let them know everything. You'll be surprised to see how effective some recruiters can be with making things disappear... :)
