If you are uninsured and cause an accident, you will lose your right to operate (in all 50 states) until you have paid for all of the damages to the other party. In a serious accident that could mean a lifetime of no driving.

You'll also face prosecution for driving without proof of financial responsibility. A fine of a few hundred $$$ and possibly a short license suspension, possibly along with SR-22 filings for a couple of years.

If you're not at fault, you may luck out though some juries have been convinced that you should not have been driving in the first place and had you not been the accident could not have happened. That's a gamble I'd rather not take. You'd still be looking at the citation for driving without proof of financial responsiblity.

If both drivers were uninsured, they'd both be screwed.

Car wreck/no insurance?

No where in the loan documents you signed when you purchased the car does it say "you don't owe the loan if you wreck the car or render it non-drivable". As such - you still owe on the loan.

If you stop making the payments - the loan company will repo the wrecked car. Sell it for what ever tiny amount they can get and sue you for the balance.

If your loan company was notified of the cancellation of your insurance- they may have put "forced coverage" on your car. This is insurance they add to protect their interest only and then add the premium payments for this to your monthly payment. It is very expensive so you should have seen an increase in your monthly payments if this happened. It is usually much cheaper to have insurance through a company than to pay for "forced coverage".

You are required under the law to exchange insurance information at the site. If she wanted to make a stink, there could be trouble for you because you didn't do it. The 2 insurance companies will duke it out over who pays for what, but chances are any damages or injuries that she sustained will be paid by your insurance as you hit her from behind. You are lucky that the police weren't called. They would have ticketed you for failure to control your vehicle and traveling too fast for conditions.

My guess is that this was Ms. X's first accident too. She was shaken and knew she was supposed to provide the insurance information so she did. Next time, make sure you provide that to the other person. It's your legal requirement.

Although you didn't see any damage at the site, I can't imagine that there was none, although it may have been minor. Also, whiplash usually isn't apparent until the next day. She may now be feeling the pain. It is very common with rear impact accidents.

I'm 19, and the car I was driving was constantly breaking down. When it was completely broken for two months, I stopped paying my insurance and instead saved back money to get the car fixed. My insurance canceled during that time. When I got it fixed on Friday, I was planning on renewing my insurance Tuesday, a day I had off work. Unfortunately, Saturday morning I got into a car accident. I was turning out of my apartment entrance to get to a middle lane where I could then get onto another road, and somehow didn't see a car close enough to hit me. He t boned me in the drivers side. Somehow neither of us got hurt. My car is pretty much done and his car, while not as bad as mine, did get some split open damage. The ticket says the damage is worth 3,000. Since I had no insurance at the time, how will this get payed??? I have a court date on the 9th to discuss the fact of my no insurance...I'll have coverage by then of course, but I'd like to know what I should expect...
Update: Also, I know it varies from state to state. I live in FL.

What will happen now is that if her insurance finds that she was liable, it will pay to repair your car. The fact that she admitted she was at fault, despite what so many people think, doesn't count and means nothing. Why? Because she doesn't get to assess fault, only insurance companies get to do that.
You may be arrested for driving uninsured and without a license but her insurance will still pay for your repairs if they determine that their insured was at fault. (If you account of the accident is accurate, It does sound like she should be found at fault)
Getting insurance now will not help you for this situation. That would be like closing the barn door after the horse got out.
By law you need your states minimum liability coverage.
This is a helluva time to be thinking about buying insurance. You apparently weren't worried about it before?
Park the damn car until you get a drivers license and insurance. Remember what my Dad told me once when I got in driving trouble.....................:

You did not say how much the damage was, but I assume you will contact the other motorist and make arrangements to pay in time payments. Even if you had insurance, the insurance company would, and might raise your rates to pay for the damage, so with or without insurance, I assume you know you will have to pay. If you had insurance, you might have to pay more than if you were uninsured becuse the insurance company may not want you anymore and will really raise your rates to get you to go elsewhere.

The insurance industry realizes there are poor people who will avoid buying liability insurance, and have designed collision insurance for this instance. If the other driver had collision insurance, this will cover all of the damage done by an uninsured motorist (minus his deductible). Even if you had liability insurance, you only have to reimburse the other motorist 10,000$. If you did 30,000$ worth of damage, they can go after you for the other 20,000$ since Tennessee law says you only have to pay for 10,000$ of damage if you cause 30,000$

The other driver may have uninsured motorists insurance, which will pay for his injuries if he was hit by an uninsured motorist. The law in Tennessee says you must cover 25,000$ of medical damage to one, and 50,000$ worth of damage to two or more people. (see the above web site)

I hope this clears up some questions. If you cause an accident, you may be better off to pay the damages out of your own pocket, and you may be better off than using the insurance policy since the rates really go up and you may be better off keeping your policy costs down by paying for the accident out of your own pocket if you can keep the insurance company from finding out about the accident.

I got into a car accident with no insurance in indiana. am i screwed?

1. if the plow hit you in the rear or sides....then airbags won't go off as airbag sensors are in the FRONT bumper. (unless you have side impact airbags then there are sensors on the sides).

2. not having insurance is wrong and normally is punishable by 30 days in jail and a fine. normally most judges waive the jail time but make the fine as high as they are legally able to.

3. be happy its not your fault....or you could have a good chance of sitting in jail right now.

4. since you had an accident, even though not your fault, most likely now they will require SR22 insurance on you now (high risk insurance) and this will stick with you for at least 3 years as long as you always pay into insurance. If you stop, then the 3 yr time limit starts fresh. This SR22 insurance is almost twice as much as normal insurance.

5. Since they hit you....their insurance will cover the damage to your car, your medical bills, etc.

6. But you are still screwed.....to have insurance is the law....so sure they hit you....but you broke the law. I wouldn't get too cocky in court over this as you are in the wrong as well.

7. to not afford insurance today....now made it twice as hard to afford for years.....ALWAYS take the first route as its always cheaper (meaning, just pay the insurance like all the rest of us).
