well this should have been incorporated in the contract before the work began as to what delays would cost if timing was that critical but that being said if beach investment can show what their losses were they would be entitled to that, the issue would then be what caused the delay if it was completely Ables fault ie incompetent, not enough resources, failed inspections etc. or was there a design or engineering issue causing a delay, did construction begin April 1 or was there a delay beyond Ables control.
