Is Failing To Produce A Driving Licence A Criminal Offence

Is it true we have some time to produce our driving licence to the traffic police if they demand it and we do not have it on us?

Page 166 of Page on tn.gov.in states that 139. Production of licence and certificate of registration.—The driver or conductor of a motor vehicle shall produce certificate of registration, insurance, fitness and permit, the driving licence and any other relevant documents on demand by any police officer in uniform or any other officer authorized by the State Government in this behalf, and if any or all of the documents are not in his possession, he shall produce in person an extract or extracts of the documents duly attested by any police officer or by any other officer or send it to the officer who demanded the documents by registered post within 15 days from the date of demand.Source Page on tn.gov.in

Is driving without a license an arrestable offense ?

In the great state of Texas, yes you can be arrested for driving without a license. It does not matter the reason why you don't have you license.

In Texas you can be arrested, given a ticket, or given a warning for any traffic violation other than Speeding and Open Container of Alcohol. It is the Police Officers decision on what he does. For Speeding or Open Container of Alcohol, the Officer has to issue a ticket or a warning. Now if you refuse to sign your ticket, you are saying you do not promise to appear in court for the ticket and can now be arrested to ensure that you do.

The charges for not having a license are:

No Valid Drivers License: Meaning you were never issued one.

Display Expired License: Meaning you were issued one and it has expired.

Fail To Display Drivers License: Meaning you have a valid drivers license, ut you do not have it with you at the time of the stop.

Driving Whlie License Invalid (DWLI): Meaning your driving privileges have been suspended for any number of reasons. This use to be called Driving While License Suspended (DWLS). A common misconception with this is that those guilty of No Valid Drivers License seem to think they can not be charged with DWLI, because they were never issued a Drivers License so how can their License be suspended. It is not the License itself that is suspended, it is your driving privileges. For years it was the other way, but the Law is not blind and eventually noticed that people were not getting their License and therefore was able to avoid the more serious crime of DWLS. So recently they changed that law.

Is there a penalty for driving without a physical license?

I was driving a car with an expired registration, and expired inspection (you have to get the inspection to get the registration, to help force people to keep registered).  It was a Saturday morning, and I was going to get inspected.  No really.I manged to leave my wallet at home.  No really.  When I was pulled over, I provided the name, address and DOB of the owner (not me), and my name, address and DOB.  Last name of the driver and owner matched, as did the addresses.  After what felt like an hour (when you are stressing), he came back for a ticket or no insurance (it was in the wallet too), and no license.  Presenting them both at the police station within two weeks got both dismissed.  He could have towed and impounded the car, but didn't.  I went home, got the wallet, went back out, and got inspected and registered.So long as you are not otherwise interesting to the police, you shouldn't have trouble.  If you are interesting to them (I'll leave out the obvious reasons), then they can do lots to you.  So carry it at all times.

How can police demand a drivers license and then use it against a citizen in court, without violating the 5th?

Traffic cases in california are oddly classified as criminal infractions. According to the 5th Amendment in a criminal offense the following applies.

nor shall be compelled in any criminal case to be a witness against himself

So how can an officer lawfully follow the constitution and demand a Drivers license to create a record to charge the citizen with an offense?

The Secretary shall approve the plan if the Secretary decides the plan is adequate to promote the objectives of this section and the plan—

States are only allowed to regulate COMMERCIAL motor vehicles.

Can i join the military with bad driving history.?

it depends on the total number of moving violations you have and your dirivng record in general. i think you can have no more than 3 violations / citations (i.e. 3 speeding tickets) within a 5 year window. if you have more than what is allowed, you will need a waiver, and that won't happen in today's recruiting climate, you would jsut have to wait for it to drop off.

another post is correct: you CANNOT enlist (i don't think you can even PROCESS to enlist, fill out paper work, etc) if you have outstanding civil or legal issues. any case before a court must be fully adjudicated!

i thought you only had points against your license if you were CONVICTED of the offense you were charged with?
