F1 Student Visa and Pregnant?

at the moment, your status remains F1. you don't lose student status simply because you're pregnant, but you don't gain any other status for that reason either. as long as you continue to study on a full time basis, you retain your student status. your child will be an American citizen, and possibly a citizen of your country, depending on your laws. Your child's US citizenship doesn't affect your status at all until the child reaches 21. even then, your child would have to file a petition for you. So, as for adjusting your status, take your child out of the equation and consider what you would have had to do before you became pregnant to adjust status. perhaps you could eventually be sponsored for a skilled worker petition. you could continue your studies, or perhaps marry. however, if you married a permanent resident, as advised by the first answerer, you would have to wait 4 or 5 years to benefit from his petition. if you married a US citizen, you could apply to adjust status and begin to benefit very quickly, although it would take some time to get an actual green card.

How can my pregnant Girlfriend stay in the USA ? She's from Ukraine and is here on a summer work Visa.?

I live in the USA and i met my girlfriend when she came from Ukraine to here on a work visa . She's 18 and im 24 and we started dating 4 months ago. she lives with me now in my house. She is 2 months pregnant has well. I wont her to stay here in USA so we can have our Family. here work Visa runs up sept 20. and We have an immagration Lawyer and she wants 1,235 dollars for a vistor Visa . What should we do ? is there an easier and faster way for her to stay ? and cheaper way ?
Some people tell us its better to do it on your own then get a lawyer . i need help getting her to stay quikley.. TY

My illegal immigrant girlfriend is pregnant...now what?

First of all, thank you for taking responsibility and stepping up to be a good father and for your concern over your girlfriend.

Your situation is very complicated, to say the least, but there are steps that you can take that may help you keep your family together. You sound pretty young and I'm guessing she is too; did your girfriend immigrate before the age of 16? If so, do to a recent change in immigration policy which only happened in the last few weeks, she wouldn't be able to be deported and she could apply for a work visa with an eventual path to permanent residency, as long as she has not committed any crime besides being here illegally.

If she came after the age of 16, that rule would not apply to her, but there might still be hope. You should consider speaking with an immigration lawyer about certain types of temporary statuses she might have access to (I don't know the details). But I don't know how could your chances of success are with that; if it was that easy to remain in this country legally everyone would do it.

Finally, your girlfriend could marry you and obtain legal status that way. I know marriage after only two months is a little bit insane under normal circumstances, but then you would have to weigh that against the risk of deportation. Nowadays immigration officials have really cracked down on people trying to get married just to get into the US, but with a baby coming hopefully that won't be a problem for you. Again, I would strongly advise you to contact an immigration lawyer. You would probably want to leave the country in order to do this and the process might take a while, but it would mean your girlfriend could get a green card and a path to citizenship.

If your girlfriend cannot obtain legal status, there will always be a risk of deportation. Your baby would be a US citizen, but that would not prevent your girlfriend from being deported either with or without your child. If she had to go back to Guatemala she could take the child, but there would probably be some kind of action you could take to try and gain custody. She could also choose to leave the child in the US with you.

If i get my foreign girlfriend pregnant could she become a legal US citizen?

I have a problem with a long distance relationship. I met this wonderful woman while i was in the navy who is filipina. I met her on several occasions in her home province of davao but due to unfortunate circumstances i was discharged right when we were trying to figure out how to make are relationship work. We've been keeping in touch for almost 2 yrs now via yahoo messenger and facebook and i'm currently saving as much as i can so i can take a trip to see her. I don't know what were gonna do when we finally meet again as we both love each other and don't want to wait any longer to be together. I heard somewhere that female immigrants in order to become legal US citizens go out of there way to have a baby on US soil so that her and the child autimatically have citizenship status. I would really like to know just how true this is and if not then if anyone can tell me what we would have to do and how much would i have to pay in order for her to get a green card. Otherwise i need to consider the possibility of moving to the philippines but i'm not sure if i could effectivly support us financially overthere as there is alot of corruption and poverty in the phil.

Getting a British citizen pregnant will gain you no immigration rights.

If you enter the UK on a tourist visa, you cannot change visa categories for ANY reason. You will have to be back in your country, or a country where you are a legal resident, before you can apply for a UK visa.

Good news is if you are in the US, then you can have the visa expedited for an additional $300. Most are processed in 15 days or less, majority processed in 24-48 hours. Mine was processed and approved the same day they received it.

There are proposed changes for sponsoring a spouse for a UK spousal visa.
Right now you have to prove that she (the British spouse) has £105 per week left over after rent, council tax and utilities. Add another £56 per week per child, if any are in the picture.

In April they are proposing that in order to sponsor a spouse for a UK visa, then the British citizen will have to earn between £19,000-£25,000 per year.

I need serious advice...overstayed my visa and pregnant...HELP!!!!!!!!!?

I am 24 and been in the US on an F-1 visa for six years. I completed my undergrad studies and graduated in 07. I have been working in my area of studies ever since graduation, but have never applied for a work visa and am not able to through my current job. I have an immigration lawyer who knew that my status was coming to an end but has yet to guide me to what i should do. My visa officially expired July 17th of this year. I have no desire to return to my home country (UK). Two weeks ago found out I am pregnant and i intend on keeping. What exactly is going to happen with my citizenship (overstayed visa) and that of my unborn child. Also what steps do i need to take as far as that and emergency medicaid so that i may go to the doctor not going to be able to afford toadd the $200 extra dollars a month maternity package to my already $360 monthly health insurance. I'm going to go out on a limb and say that you didn't create that baby all by yourself - you had some help from someone else.If you were pregnant when you came to the US, I don't think there's much you can do, other than of course applying from your home country for some sort of immigrant visa, and noting that your kid is a US citizen.On the other hand, if your kid's other parent is a US citizen, you can go home and they can file paperwork (I-129F, if I recall) to get you a fiancee visa (K-1?), upon receipt of which you would return to the US, get married, and file paperwork (I-485 and some others) for adjustment of status to "conditional permanent resident" which gets you a Green Card, then 2 years later you renew it for a 10-year term, and a year after that, you can apply for citizenship.That is all contingent upon you staying married and all that, of course.Another possibility would be to see if you can enlist in the US armed forces - since 9/11/2001, that's a fast-track to citizenship.
