Is It Illegal To Take Someone

Unfortunately it isn't illegal for someone to snap a photo of you in public, if it were there would be a lot of things about modern society that would be impossible. Such as artistic photography, tabloid magazines, survalence cameras, etc.   But it is illegal to use someone's likeness for profit or personal gain without the person's permission. So if you find any of the photos that photographer took on the internet, in a mag, on tv, etc... you have the right to sue him. You may be able to file charges on him anyway for invasion of personal space and/ or harassment for continuing to snap photos after you'd ordered him to stop.

Unless you have an expectation of privacy I believe someone could take your picture without violating your rights. For example, if you were working outside in a public area you would have no expectation of privacy. If you were in your car in the parking lot, you would have some expectation of privacy and someone taking your picture may be actionable. Now if the picture taking was part of a series of acts that could be considered harassing, then it might be a violation of your workplace rights. Now if they were taking a picture in a bathroom or a changing room it could be illegal. If you were a woman and the person taking the photo was someone in an authority position above you and the photo could be construed as capturing your private areas then such a photo could be considered sexual harassment. If someone is taking your picture at work and it creeps you out, file a grievance with your union representative or an HR person. Now if the employer is taking your photo without a valid business reason then it maybe illegal, Before consulting with an attorney, review your employee handbook.I think you will find at most work places your photo is being taken repeatedly all day long. This answer is given for entertainment purposes.

Actually the legal answer is it depends. The legal definition of theft is “the intent to as the physical removal of an object that is capable of being stolen without the consent of the owner and with the intention of depriving the owner of it permanently.” It is that last part that makes the answer it depends. If you take someone's phone with the intention if keeping it, even if you do end up giving it back, you are guilty of theft. However, if you hide your friend's phone while they're in the bathroom of a bar as a joke to make them think they lost it or someone stole it, then it is not theft even though you did take the phone. Because you never had any intention of permanently depriving them of their property, it does not meet the legal definition of theft and you cannot be charged with a crime in that situation.

It depends on the circumstances.Pictures of people walking, shopping, etc in most Western towns, no problem.Naturist adults with their permission, finePeople on a naturist beach without their permission, it is not polite.I would never take photos in those circumstances.Young people on a naturist beach if they are naked, no.Not even if you a friend of the family or family.Really it is too easily misrepresented

Is it illegal to take a picture of someone else's car?

It's not illegal to take pictures of a car (or anything else) left in a public place. As long as you weren't trespassing on the lot and the lot is open to the public you did nothing wrong.

It IS illegal to make violent threats toward someone for taking pictures legally in a public place though. That's called "assault". You could have called the cops on HIM for threatening you and showing intent to carry out the threats since he was running out of the store toward you and threating violence.

Fwiw I'll never understand why certain people do everything they can to make their cars stand out but then get pissed when people want to look at them. Don't paint a car bright green if you don't want it to be noticed by everyone with functioning eyesight.

That D-bag was just looking for a fight and the cops would have been on YOUR side if either of you would have called them.

When stated as broadly as you have here, no this is not illegal. But there are many specific situations that are illegal. For instance, many states and countries are making ex-girlfriend revenge-style uploading illegal. And depending on where you live, recording audio of someone might need to have permission to be legal.Videotaping (aside from the concern for audio) is treated exactly like photography. And anyone can take your photo without permission and publish it. The only real exception is that you have to be in public. Where you have a reasonable expectation of privacy (your home, dressing rooms, etc.) filming without permission is almost universally illegal. There is a lot about the restriction on use found on this post: If someone takes a cellphone picture of me without my consent, how can I make sure that they've deleted it?

Is it illegal to take someone's garbage once they put it out to the curb for the trashmen to take?

While it isn't technically illegal to take the trash, it isn't a very good idea. If someone saw you do it, they might report you, thinking you are trying to steal his identity by looking for personal info in the trash. You really couldn't prove that your intentions were honorable (well, they're not really, just nosy) if you were caught.
Also, if your ex finds out, he would be understandably ticked off. He's an adult and can take care of himself, he doesn't need his ex to be checking up on him and he'd likely not take any advice from you anyway, especially if he found out what you were doing. If you want to know if he's seeing someone, just ask him, but I'd say you are better to just get on with your life and leave him to his.

Is it illegal to take a picture of someone without them knowing or giving the photographer consent?

Not in public. One has no reasonable "expectation of privacy" while in public. A factor is if one person or some persons are specifically targeted for "surveillance", etc. PIs do this all the time to get photographic evidence of someone cheating on their spouse or someone bowling or chopping wood that made a workmans comp injury claim, etc. UC (under cover) cops do it all the time. MI (military intel (yes, I know-an oxymoron)) does it all the time.
If you take a photo of the general public, what are you supposed to do-holler, "Excuse me, if you don't want to be in this picture can you please move?" Whoever may turn out to be in the photo does not have to be notified nor give you consent.
Private residences however, are a different matter-someone can't snap pics of you through a window of your house. You also can't follow someone into a public restroom and snap pics of them. This may fall under various criminal codes of various jurisdictions. In mine, it fell on local trespass and stalking/prowling laws. This was taken very seriously in my jurisdiction because of the domestic violence often coupled with the offense. If this is the case (someone stalking/prowling/trespassing near a private residence) call the cops and see what happens - multiple cops usually answer such calls putting the suspect, if they catch them, at gunpoint. Cops don't mess around with stalkers/prowlers.
If someone purposely takes a few snapshots of a complete stranger in public, it's not necessarily illegal, but horrible manner and rude, and the person should be asked, politely at first, to stop. If you tell someone taking pictures of you to stop and they don't, it may start to fall under harassment laws. There's probably also a ton of civil remedies.

Is it illegal to take pictures of someone without them knowing?

No its not illegal if it was the paparazzi would be out of a job and celebrity would be super happy sorry but if you are in a public place anyone can take a pictures of you. It can be very rude an annoying though if people start taking pictures of you. I was at a cell phone store and these two girls had just gotten a new phone that took pictures well while in line to pay they were randomly taking pictures of the people in line and making jokes and saying they would post it online. It upsetting but there was nothing anyone could do except take out there phones and start taking pictures of them. They were none to happy when the show was on the other foot. They stopped immediately and seemed to be embarrassed. Go figure they couldn't take what they were dishing out. Best bet is if someone starts taking pictures of you and you don't want them to, then take out your camera or camera phone and start taking pictures of them. Many celebrity's have started carrying video cameras and digital cameras to record the paparazzi.

Is it illegal to take a picture of someone else's house from the outside without that person's permission?

I agree with John it is legal, but you need to be taking his picture. Make sure he sees you do it. Bring your phone outside and announce loudly that you are dialing 911.

You could try calling the police non-emergency number and say someone who doesn't live on your street appears to be taking an unnatural interest in your house. They may laugh at you but they may actually do something about it. At the very least, they have to write down that you called, so it would be on file in case something did happen.

Did either of you do anything that would make someone want to sic a private investigator on you?
