You be better off to put that on your application/interview because they will find out. Most companies do exhaustive background checks. I am sure Wal-Mart will hire you if you have a DUI; however, if the job itself involves you driving, maybe not. If you lie at an interview or on a job application, it will come back to haunt you. You need not provide details; just put down the month and year and where it happened and whether you were found innocent/guilty and if you paid any fines or went to driving school.

Many companies find out and decide whether the misdemeanor relates to their business.

If it were theft, check fraud or other dishonesty involving property and / money, they would not hire you. Why? You are handling money and merchandise.

Otherwise, for disorderly conduct, it probably will not matter.

First off I am not a thief, I was honestly in the wrong place at the wrong time. I had
gone to the grocery store with a friend of mine and her boyfriend. As. She and I were shopping her bf separated from us. When he returned he had a few books and a drink. He said he purchased them and that he didn't want to carry them so my friend put 2 books in her purse ad since the thirddid not fit in her bag I placed the last book in my bag. When we were leaving we were stopped by an employee and askedtp follow her. I didn't know what was happening until my friend's bf tried to run out of the door. The arresting officer tried to let me go with a theft ticket since the book in my bag was under $50. The loss prevention lady told him no and that she was pressing charges to the fullest extent of the law. The three of us were charged with a class b misdemeanor theft $50-500. (The books totalled out to literally $54 or so) I received deferred judication. BUT I ended up not paying my fees on time and received a warrant and had to sit in jail. I'm not 100% sure but I believe that bc of the warrant I am now unable to get it sealed.If that's the case who will hire me now? This happened 3 years ago and I have been out of work for about 4. I have to get a job by June 1st......Who in the Dallas-Fort Worth, Texas will hire me?

Can having to Misdemeanors on my record prevent me from getting a job with Verizon? They are from 7 yrs. ago?

I got into a fight over 7 years ago I was 19 years old and have simple assault and harassment on my record. I finished school as a medical assistant and nobody would hire me because of my record. I tried taking CNA classes they wouldnt accept me into the program. I have been working as a server in resturaunts because they seem to be the only places to work at with a backround. Even JCPenny called back and said I failed the backround check. Come on seriousy? JCPenny? I am getting really discouraged and scared for my future. Im 26 now and want a career. I have two minor misdemeanor disorderly conducts. Will most jobs not hire me because of it?

The manager at circle k said that I "failed the background check" but didn't say why. Now I'm wondering if any job that does a background check will hire me. The application didn't ask about misdemeanors so I didn't say anything about them. They were minor misdemeanors with small fines. One was for a noise violation and one was reduced from misdemeanor domestic violence.

Yeah you will with out any problems. Prolly won't even have to explain in the interview. There is alot of felons that get on so your record wont have any problems as long as you don't have any major traffic accidents/tickets or a really bad driving record. Good luck.

Dismissed Misdemeanor Charges Effecting Job?

Unfortunately, it is not illegal.

Just because the charges were dismissed does not mean you were wrongfully accused or even wrongfully arrested. And the fact that you were arrested is a red flag. Employers who are doing intensive background investigations (i.e. for employees who will be working with children) have the absolute right to the arrest record of an applicant and they have the absolute right to decline to hire based on an arrest record.

Is it a form of discrimination? Absolutely. But this is legally permitted discrimination (illegal discrimination would involve them refusing to hire you based on your race, gender, religion, etc.).

I'm not familiar with North Carolina law but you might consider doing some research to find out of arrest information can be sealed or expunged. (In my state, this would be something you could apply to do 24 months after the case was resolved.)

They can be costly, they can be inaccurate (allowing the company to hire people that they would not) they can be inaccurate #2 ( the company can be sued for refusing to hire someone based upon an inaccurate background check) and there is a very limited pool of talented employees out there.Major corporations do background checks as a matter of course. Smaller firms are less likely to do so (unless they handle money, financial records or do work for a state or government, agency. If you are applying at major firm and they specify ANY convictions which you have, then put it down. If they do not...don't volunteer it.If you are applying at a smaller company, then unless they ask, don't tell. Unless it was a property crime, a drug sales offense (as opposed to a drug usage offense) or it was of a sexual nature, most won't even care as long as you can perform the job for which you are being hired.There are far too few quality employees and far too many open positions for most companies to trifle with misdemeanors. If they don't ask, don't tell and never get so comfortable that you let your past "slip" to a co-worker. This person may become a competitor one day and breach your confidences.
