Is It Legal For An Army Not From Your Town To Tow Your Vehicle

Does the traffic police in India have the right to take our vehicle keys?

No, they can't. There is a set of instructions issued by authorities to be followed in different situations. It doesn't mention anywhere to pull your vehicles keys.1. A motor vehicle shall be stopped for challaning only on the commission of a visible traffic offence. 2.The challaning officer shall walk to the point where the vehicle is stopped and shall first greet the driver and then tell him the reasons for his vehicle having been stopped in polite language.3.The demand for the production of the driving licence and other documents shall be made politely. It is the duty of every motor vehicle driver to carry the original driving licence at all times and produce the same on demand by a police officer in uniform. The production of registration certificate, permit, insurance, pollution under control certificate and fitness certificate can be done within 14 days. In case of failure to produce the driving licence, the registration certificate, insurance etc. the driver shall be challaned under the presumption that the said document does not exist.4.When a driver is challaned he shall be permitted to record his brief comments before signing the challan receipt. In case the driver poses resistance to the challan, the challaning officer shall politely caution him that this shall lead to an enhancement of the penalty under section 179. In case the driver tries to intimidate or influence the challaning officer in any manner the challaning officer shall record the same on the reverse of the original challan form and also inform the Control Room where an entry shall be made in the log book.5. In case the driver uses abusive language and uses or threatens to use physical violence, the Control Room shall be informed by the challaning officer, which shall in turn call for a reserve officer from the Police Station having jurisdiction for initiating legal action. The nearest traffic interceptor shall also be directed to reach the spot for assistance. The voice recorder & video recorder shall be employed to record evidence of the misbehaviour shown by the traffic offender.but you are trying to run away they can pull out your vehicles key as a reflex or primary response to your action. In many cases when the driver trying to run away on a crowded road it causes horrible accident and in some cases it resulted in death of driver so please don't try to run away and follow the traffic rules so don't get caught.

Do I have to pay if my car was towed and auctioned?

My car was towed off my apartment parking lot legally. I didn't want the car and tow driver said they'll just auction it off and they might threaten to send it to collections but they can't. Well now I just got a collections letter for $2300.

The car was auctioned off. Don't the proceeds from the auction settle the lien? Should I dispute the debt? I am going to write them and ask for a break down of the debt to make sure that they atleast deducted the revenue from the auction from the bill.

Also, if I at least attempt to pay the collections do they have to take the payment as long as it is a reasonable for my income? Otherwise the best their best offer would is $200.

DMV appraisal on the title was $2800 for the 77' Cadillac deville.

Now I know just to donate the car next time and they take it away for free.

Thanks!

Would leave your child alone in the car?

i agree that it is wrong! when my son was younger i would too leave him to pay for gas, get a newpaper/milk at a convient. especially when he was asleep. now, he is 3 1/2 yrs old, i take him out for ALL these things because i do not have child safety locks on my door and he can undo his 5-point harness. he will do this and open the door, running across the lot which is unsafe.

p.s. i think a lot of parents are lying. my answer states the obvious that once they can get out, they can't be left. but, i find it hard to believe that so many claim to take their kids in at all times to stores. please, i never see anyone taking the infant carrier into the gas station in the pouring rain or having a gallon of milk in one hand and an infant carrier in the other at the convienant. but i do see a lot of kids in cars at these places. ;)

i live in suburban chicago, very close to tinley park. i can say people are real sticklers here about leaving your kids in the car. but what that woman did is not child endangerment at all! i have been confronted more than once for leaving my infant in the car to pay for my gas in the winter while they were asleep and temps were quite cold. or, leaving him to go grab a gallon of milk. i've only been confronted by citizens who had no kids with them and told me off and said if they ever saw it again, they would call the cops! lots of busy bodies, paranoid people and such around here. i would have to asume this poor woman had some busy body go to a nearby parked car and asumed she was shopping in walmart (which would be child endangerment.) at this walmart there are security officers which circle the parking lot, that is why they arrived so fast. yet, they still should have been able to see the obvious and let her go!!

to Nik, it is NOT laziness to leave a child in the car. this mom wasn't lazy, not sure where you live but in an icy storm on an icy lot, it is more a safety issue and thinking of the comfort of her child that this mom left a sleeping child in the car TO DONOTE TO SALVATION ARMY. People are not too lazy to take their kids out, in fact, sometimes if i have stuff to do, get home, and my son is sleeping in the car (in good weather not hot or cold) i'll think of him first and sit in the yard instead of moving him or leaving him unattended.

Can I put a boot on a US Postal Service truck?

I own a deeded parking space in a parking lot downtown. It’s on a crowded street, where there is seldom any street parking and there are no other parking lots within about 2 blocks. My parking space is the first spot as you enter the lot. There is a sign in front of each space saying “No Parking / Private Lot / Violators will be towed” There is also a sign as you enter the lot saying the same.

There is a spot for disabled people on the street, and the mail man usually parks his vehicle in this space, which annoys me. However, when the disables people’s space is taken the mail man has been parking in my space. This wasn’t that big a deal as I was usually not home, however he comes later now, and is often in my space when I get home from work. He walks about 2 full blocks with his cart before coming back to his vehicle; this takes him about one and a half to two hours. I have to either find street parking or go to a pay lot a few blocks away when he is in my spot.

The first time this happened I came back and waited for him and asked him not to park in my space. He told me he doesn’t have time to look for a spot, and as a government employee, he can park wherever he wants and I have to wait. I was quite upset. I called the post office, and they said they can’t do anything, he has to park somewhere, and that if I have a problem I should just have him towed, they take no responsibility for the carrier’s actions or parking. I told the mail man I would have him towed and he laughed at me and said no one will tow a government vehicle.

I then called my towing company a few times, they said they would be more than happy to tow him, they don’t care if it’s a postal truck or not. But they take about 2 hours to get there, and he is always gone before they arrive.

The towing company has offered to sell me a boot. They said I can just lock it on his tire, and call them. They said the mailman will have to wait for them to show up and pay a fee to remove the boot, or if the mail man is not there or does not pay the fee, they will tow the mail truck and hold it until they mail man pays $200 + mileage + storage to get it back.

Do you think this is a good idea? The mail man does know my name and where I live, which makes me think he might mess with my mail if I put a boot on his vehicle.

Who should I call if I get stranded by the highway far away from anyone I know?

Who should I call and what all should I tell them? Is there any certain universal # to call that works in diff states? What should I do about the vehicle? I've never driven a long distance away from home by myself, and I'm paranoid about something like this happening. Anyone ever been in this situation and/or know what I should do if I was?

Fort Bliss, Tx who knows about it?

I enjoyed my time at Bliss. There's not a lot of fishing, unless you want to drive to Elephant Butte in NM, but there is some good hunting. The installation is large, and it's located in El Paso. The Army Airfield there has an air show every summer. There are numerous restaurants, lots of clubs, the people are friendly, the housing was OK. Your close to Alamogordo, NM (1 1/2 hours), home to White Sands National Monument. The Guadelupe mountains are to the east, and southern NM is beautiful.

If a car is sticking 6 inches onto my property and blocking my driveway, am I allowed to push it out of my way and sue him for the damage to my car?

Friend,You need help. You should not consider using your vehicle as a weapon against another person’s property because that’s probably a felony and getting to this point over less than a foot indicates you have some bigger issues going on in your life and maybe this is where it all comes out at? Have you lost a job lately? Divorce? Quit smoking? Quit drinking? got married? all these things are stressful.Anyway - If you live in a town home community or a mobile home community or something like that and is why most driveways would ever touch, you should talk to the property management. You should document the situation with pictures and be really calm about it and never I mean never ever ever ever suggest you would use your car as a weapon to damage property. If you don’t have a home owners association or property manager or anything like that take your pictures to the police and ask them to charge them with trespassing and see what they say, or ask them if you can use your car as a weapon and then sue the people who you attacked and see what they say. Finally I want you to know I’m not saying “you have issues you’re a bad person” I’m saying this is obviously frustrating but it seems like something bigger is going on here for you to consider using your car as a weapon and then wonder if you can sue them when it would be you hoping to avoid jail depending on your local laws and they would definitely sue you or their insurance company would sue yours because you would be in jail.
