Is It Legal For Them To Fire Me Or Can Iisue If They Do

Is it illegal to fire someone for a "bad attitude"?

I lost my job because my boss said people told him that I was cmplaining about stuff and that it was creating negativity. By boss rarely spoke to me, and never said anything to me about this issue prior to firing me. Is this legal?

Got fired for pulling soda from a vending machine! Legal issues?

So, this vending machine is not owned by my company, it is in the break room. A fellow employee showed me this trick where you can stick your can into where the sodas come from, and ocassionally you can feel a soda and grab it. So this vending machine is privately owned, and i guess something got damaged in the machine, and I recently successfully pulled a soda from there, I have tried before and was unsuccessful, and they got me on video doing so..and they had me multiple times doing so, but ive actually only taken 2 sodas total...
SO i come into work, and my manager asked me, were you taking stuff from the vending machine, and I said yeah, i didnt lie, and he told me I was fired, the company has zero theft policy, and he took my work badge and escorted me out of the warehouse. I wasnt told to sign and termination papers or anything so I am confused, it that legal? And plus it was over a .75 soda which the company doesnt even own, shouldnt have the police handled it instead of my job terminating me? I just need some advice...OR should i leave it at that?

Can I legally set fire to my house if I owned it?

As with all legal questions, the answer will depend on where you live but assuming there are no local laws regarding open fires (like the ones which stop you having fires in camp sites), the fire will not cause unnecessary pollution in terms of smoke or run-off, oe endanger people, other properties or protected wild-life then I can't see an issue (though IANAL)Imagine you cut your house up with a chain saw. No legal issue, as long as you own it and don't endanger anyone in the process. You then take the bits and use them to fuel a number of camping fires to cook your meals. Again, local legislation aside, no issue. Now lump all the small fires into one - unless the scale of the blaze causes issues, I can't see a problem.

Is it legal to fire yourself when you don't want to leave the job?

No, technically it would not be legal to do this.First of all, how does someone “insist” you do something that you don’t want to do? Gunpoint?Second, what this does is make you “quit” rather than be “fired.” There are several differences between quitting and being fired. The biggest difference is unemployment. If you are terminated, and you are not terminated for cause (meaning you aren’t terminated because you violated company policy, or did something else wrong), generally in most states you are eligible for unemployment compensation. If they try to terminate you for cause, the burden of proof would be on them to show what you did, that they counseled you on the issue, and they gave you an opportunity to answer for what you did. This means they’d have to fabricate a lot of details (lots of paperwork, lots of forged signatures) to terminate you for cause when there was no cause. If they don’t do this, they open themselves up to lawsuit for unlawful termination, even in an “at will” state. Terminating you without cause gives you unemployment benefits. There are other benefits to being fired over quitting as well, and they may be related to things like tenure and vacation balances and re-hire credit and insurance coverage, but those differ based on state as well as industry and job title.I would tell them that if they wanted me gone so bad, they could fire me, but I’m not quitting, and I’m not signing anything. I suspect they’ll try to make my life hell from that point on, but let ’em try. I laugh at their silly attempts to make my life hell. Ha!

Can I sue if I get fired for having a seizure on the job?

If you do not disclose it to your employer, and you are in a position that the seizures can create a safety issue, yes you can be fired for it.

I'm assuming you do not have a drivers license. Why? Because since you cannot control your seizures, you could have one while driving and lose control of your vehicle. This is a major safety issue for both yourself and other drivers on the road. The same can happen at work if you are operating heavy equipment or machinery and you have a seizure.

Can my manger legally fire me for not wearing makeup(fast food)?

i work at burger king and im a crew leader... about to become an assistant manager. there is this woman who is in charge of our district manager who does not like it that i dont wear makeup. she said i am a crew leader and appearance means everything... i dont come into work looking sloppy or anything. I can't just wear any makeup because it irritates my skin and the kind i have found that doesnt bother it that much cost $20 for a little tube. and im also not a makeup fan to begin with... i was just told by another assistant manger that when i go for my managers orientation they will tell me i have to wear makeup to make myself presentable. if i dont wear make up can they legally fire me? as i would think that is discrimination.

My boss fired me for asking for my legally required breaks. What do I do now?

I don’t know what state you’re in…but generally, labor laws require the following: one 15 minute break twice a day…so one prior to lunch, about mid-morning and another about mid-afternoon. Some companies have no issue if you desire to combine them, say, for a one hour lunch or some errand you need to run on occasion, but this must first be discussed with and approved by your management on a case-by-case basis. There’s more. If your company does NOT provide an in-house cafeteria or similar meal opportunity, then by law it must permit you one hour for an off-campus lunch. If the company DOES provide an in-house meal situation, then lunch is reduced to 30 minutes. So, two 15 minute breaks and either a 30 or 60 minute lunch depending on whether or not the company has its own cafeteria facility. Oh, restroom and smoking breaks. You can’t be refused access to a restroom but I suggest not abusing that time - same goes for smoking breaks as well. Any member of a management team denying you such breaks can be taken to task. Report the issue to your human resources department. The best defense? Get a copy of your human resources policies and bring yourself up to speed so you can quote them. Sometimes management is not as aware as they need to be and a refresher can calm a lot of tension. The best method to solve such issues is to request a one-on-one meeting in private and talk to each other to work it out. Hope this helps.

Is it legal to fire an employee because she didn’t have transportation to work?

Once you accept a job, it is the employee’s responsibility to get to the job on time. Whether that be via your own vehicle, public transportation, or carpooling with others it is the employees responsibility to get there. If the employee is constantly late or a no show because of transportation issues the employer would be within their rights to terminate. However, if the employee is having problems, they need to talk to their manager. I have changed employee start times because they used public transportation and the bus they rode was timed so they would never be on time. It was a simple fix and relieved the pressure on everyone. I also arranged for our company delivery person to pickup an employee who worked the 2nd shift and was having a problem. The delivery person was in the area of the employee everyday anyway. After a couple of months the employee solved their problem and was able to get there on their own. Talk to someone before it turns into a problem. There maybe a solution to the problem.

Can I take legal action against a Subway manager who threatens to fire me if I don't shave my beard?

I doubt you can sue him personally but you can report him to the company for religious discrimination.
