Is It Normal To Have An Attorney Have You Sign An Undated Form So If Your Not Available He Can Sign

A national magazine printed one of my husband's photos in this months issue without permission. What can he do?

I would contact the magazine, point out that the photo is his property, and ask that they pay the going rate that they would have paid had they bought the photo through the normal channels, and also that they print a correction in next month's issue. And then be happy with that.

Unless the normal fee would have been thousands of dollars, it's probably not worth the cost to get an attorney involved. The legal fees would eat up anything you would get otherwise, and you'd make the magazine mad enough at you that he would never get published there again. But if you handle it with a little less rancor, and treat it as an honest mistake, he may make a friend of them and publish more there.

And it could be an honest mistake. Someone may have mistaken his shot for another, or some other photographer may have turned the work in as his own, and the magazine never knew.

Of course, if they don't work with you, then you can pursue legal means. But I would try to handle it in a less contentious manner first.

It has happened, attorneys have inserted themselves into situations where they were not retained, consulted, or desired.Their was a case here in Florida years ago where an attorney did this, basically for a living…scumIf I remember correctly, the reasoning was since the person benefited from the attorneys services, the attorney was entitled to just compensation.Their were some twists and turns in the situation, however, one thing is for sure, the person in question (very elderly) never met, corresponded with, or talked with the attorney. But hey, this is Florida, it’s perfectly fine with the justice system if a “sexual retainer” is provided in return for legal services. Yes, this went to court, the attorney won, and is still practicing law in Florida. The issue of the sexual retainer was never disputed.

It depends. You don't legally need a lawyer or attorney to write an NDA. You certainly could download one online and use it and it might be legally enforceable. But - and here's the problem - you won't know what you don't know.An NDA technically requires the parties to give up certain legal rights and freedoms, and courts have tended to construe them rather narrowly. And if you write an NDA without knowing what you're doing, you could easily create loopholes or construction errors that mean the entire document is unenforceable. So the question you need to ask yourself is this: will the value of what my NDA protects be greater than 10x my attorney fees of a few hundred dollars? If the answer is yes, then getting an attorney will mitigate your risk for an economically justafiable value. And, finally, yes there are time limits on how long an NDA lasts, but these are very intricate and they depend on how much knowledge is already in the public domain and what is a reasonable length of time, which varies widely between jurisdictions.

(A2A) thank you for asking the question. Let’s get the disclaimer out of the way. I am an attorney but I am not your attorney. This is not legal advice and we do not have an attorney-client relationship. There are a few kinds of power of attorney.Limited power of attorney: I am selling my house. I give someone limited power of attorney to accept any offer over $600,000. They cannot however, except an offer for my car.Durable power of attorney: I own several assets. I give someone durable power of attorney to make decisions about my assets in the event I become incapacitated.Temporary power of attorney: I will be on my honeymoon for one week. I give someone power of attorney to make certain decisions which will expire when I return.Hope this helps.

What to do when I have failed miserably at everything in my life?

Fast forward to today. After prison I was able to land ONE job only teaching medical assistants which was good until a higher up at the school began pressuring me to pass students who didn't even show up to class or read the book. I turneY them in and an investigation ensued and they made my life miserable, So much for that job.

I am awaiting disability for psych reasons but it has been two years since I had any income and can't find ANY job due to my record now. Forget a good paying career....I can't even find minimum wage. Am in crappy subsidized housing. The only thing I have good is a bf who I know loves me, but can't always put up with my depression or understand it. But he has been supporting me except that he has booted me out to the streets twice, I am steadily gaining weight even though I don't eat much and walk almost four miles daily....I think due to meds and a hysterectomy this year,....so I caught the bf looking around at other women....like

Can I be sued for buyers remorse if i was unable to get financing?

I've had a vehicle fail emissions. The "technician" said it was an EGR valve and the catalytic converter. Estimated cost to repair $800. I disagreed and took it to another mechanic. Found a disconnected vacuum line. Actual cost to repair $25. I've never had to replace a catalytic converter since they were being used starting in 1975. The catalytic converter fault is deduced by the computer system from the oxygen sensor signals. The O2 sensors also have their own diagnostics. There are other faults that can point to a faulty converter when in actuality the fault lies somewhere else. If your car is less than 5 years old, federal law requires the emission system to be covered under warranty. A faulty converter would have lit up the CEL light when you first started the car or within the 1st 5 minutes of driving. Take it to another shop for a 2nd opinion. What were the OBDII codes? Symptoms of a faulty converter are hard starting, poor gas mileage. It will smell like rotten eggs or sulphur. Your car is covered by the Arizona Used Car Lemon Law if a major component of your car breaks before the earlier of 15 days or 500 miles after you buy the car. If it breaks, you’ll still have to pay up to $25 for the first two repairs. The recovery for the consumer is the purchase amount paid for the car. The question is "What is a major component?" Engine and transmission of course. But what else?

Crazy, unprofessional work place... Any imput from professionals? I don't know what my options are anymore.?

The place that I am currently employed is an absolute mess. To start off with, the "boss", who is some 23 year old pot smoker, choses favorites to whom she gives the most hours to. The people that she smokes with BEFORE shift, get 5 days a week, at least. I don't know if she just personally doesn't like me, or what, but I get1 day a week, 2 if I'm lucky, in which they let me go home after an hour or 2 due to low volume of customers. I work my hardest, I have never been late, never called in sick, always arrive to work in a happy, upbeat demeanor, and I go above and beyond my job... Yet I only get one day a week. This girl gave me an evaluation in which I feel was completely false... and I discussed with another manager, who said that I was a good worker and he has no issues with me at all. When I brought this to MY bosses' attention, she basically just beat around the bush and claimed she would start giving me more hours, but I've actually got less since then. Being overstaffed isn't an issue, because 2 people have already quit, and 3 got moved to different departments. And she felt the need to hire ANOTHER person, when I am working an HOUR a week. I am supposed to be a full time employee.

Another issue with this place, is sexual discrimination. While this may not effect me directly, I still feel like it is unfair. But, they absolutely REFUSE to hire any males. I personally witnessed one of the other bosses stating that they will not hire any more males, because they want to have only attractive girls working there. They really base who will be working, when, and where, on the girls appearances.

I don't know if these sort of issues are normal to the workplace, or what but I really feel like I am being taken advantage of in a way, and that I am not getting the fullest opportunities possible with the way things are going. Can anyone please help me to figure out what I can do to maybe fix any of these issues?

You don’t have to sign for it, but you do have to sign for it if you want the postal carrier to give it to you.If you don’t sign for it, then the postal carrier will log it as “Delivery Refused” and the sender will know that you did not actually receive the item.Depending on the actual wording of the contract/statute involved, you may find that you have been “deemed” to have received notice of the contents of the Registered Mail item REGARDLESS of whether you do, or do not, sign for it and actually receive it into your possession.Your refusal to accept delivery of a Registered Mail item may also serve as grounds for the granting of a “Substitutional Service” order which can result in you being “deemed” to have received actual notice of something after the expiry of a certain number of days from the completion of a set of court ordered conditions REGARDLESS of whether you do, or do not, actually have notice.

I asked for a divorce on the grounds of spousal abuse but my then husband (who is a narcissistic and abusive individual) insisted that I was being ‘brainwashed’ by the police, social services, our counsellor, etc. As a result of that he refused repeatedly to sign divorce papers. So we ended in court! There I was with my barrister and solicitor and he, represented by himself (as he claimed he had no money and that all lawyers were crooks anyway). When it came to the signing issue the judge said: “Mr Gandhi, your wife was repeatedly confirmed freely and on her own accord that she no longer wishes to be married to you. I am now asking you to please save the court time and money and sign the divorce papers right now”. He stood a couple of seconds in silence and found that he had no more arguments nor delay strategies available and at last he signed the papers.Had he not attended the court (he was asking for contact with me as an attempt to “win me back because he considered me his one and true wife”) it would have been necessary for me to wait years until I was granted a divorce de facto. As we left the court he asked my barrister if he could “give my wife a good bye kiss” (sigh). My barrister apologised for bringing his request to me because she knew what I had lived with him (I was taken by the police to an abused women refuge on an awful day after he beat me and choked me) but said It was her duty to convey his message to me. I laughed at his total lack of understanding of reality; barrister and solicitor also found the request pathetically funny.I got my divorce!
